This thesis studied the history of the school of sharīʿa judges (1907-1927) as an essential episode of the reform of Sharīʿa courts in Egypt in the early 20th century. The thesis studied the school in connection with the broader context of legal modernization of the Egyptian legal system. The study explored the institutional, pedagogical, and legal aspects of the reform that the school advocated. The study analyzed the impact of the school’s pedagogy on the practice of the Islamic judiciary and the theoretical conception of Sharīʿa. This thesis offers an original translation and analysis of a West African didactic poem in Islamic ethics and law, by the Mālikī-Ashʿarī Mauritanian scholar Aḥmad al-Ṣaghīr (d. 1272 AH/1856 CE) called The Faqīh’s Lantern (Miṣbāḥ al-Faqīh). In addition to the critical translation, I examine the poem thematically through the lens of social virtue epistemology. Chapter 1 sketches the background of the text and author, positioning the author historically as a product of a rich scholarly and pedagogical tradition while noting Mauritania’s contemporary place in the North American Muslim imagination. This study relates to some aspects of the purposeful deletion of the Arabic feminine marker “ha’” in the Noble Qur’anic text. It has resulted in a lot of controversies among Arab grammarians and linguists which, by their turn, have indicated that the Arabic Language uses particles followed by words to serve certain purposes; however, Arabic deletes these particles in special contexts and circumstances. The research engages in an exploration of human rights in Islam. Human rights issues are then contrasted with international law positions. The data gotten is then used for investigating women’s human rights issues in Shariʾa penal tradition regarding zinā (adultery) in Nigeria. The re-emergence of Sharia penal codes adopted by 12 Northern states in Nigeria in 1999 as an operative Islamic law has sparked concerns about rulings amounting to stoning to death in several cases of zinā. Illumination, or knowledge through divine light, is a type of mystical cognition that Abu Hamid Ghazali regarded to be the cause of his rescue from his famous skeptical crisis. According to him, this type of divine knowledge is the apex of knowledge, to which all other sciences are subordinate. The receptive organ of this knowledge is the heart, a divine and cognitive subtlety that is distinct though related to the physical heart. Narrations by notable Islamic personalities are a significant part of the Islamic religious edifice. However, these narrations are of variable quality and authenticity. To evaluate these narrations, standards and tools were developed and used. This study will look into whether or not it is possible to add a new tool that might aid in evaluating the narrations of an individual muḥaddith, using the example of Umm Salama. The architecture of the state mosques of the Arabian Gulf in the 20th century is an overlooked subject. Their various styles of Islamic architecture, lavish details, luxurious decoration and enormous scale are all intended to convey a message of elegance and power. Often the story of the Israeli-Palestinian conflict is portrayed as Jewish vs. Muslim, Hebrew vs. Arab. There is little room in the international dialogue for minorities such as Arab Christians. Though Palestinians have a rich culture of Arabic musical and poetic heritage, they are unable to produce their own new songs. In this study I interviewed three members of Immanuel Evangelical Church on their experiences and opinions on local Christian worship. The findings show that Palestinian Christians may feel unable to write worship music because of a prevalent feeling of inadequacy and a lack of musical training. I propose several …

The Israeli occupation of Palestine and its impact on the proliferation and longevity of transnational Salafi jihad is largely underestimated in current literature. In this thesis, I argue that Palestine, defined as both the nation and physical borders before the Balfour Declaration, largely contributed to the twentieth century revival of transnational Salafi jihad and is used by both Al Qaeda and ISIS as liberation and annihilation movements, respectively. This thesis examines the role of violence in Iraq in establishing the current Iraqi state. My chapters provide historical and theoretical context to the subject before getting into the analysis. The goal of this thesis is to show that violence in Iraq is not only caused by sectarian differences, but has been used and influenced by leaders, outside governments, and non-state institutions for personal gain and political goals at the cost of the Iraqi people.

In Moroccan history, Sufis maintained close ties with the makhzan, the sharifian state. Nevertheless, these ties were predicated on a balance of power relations between the two sides. A great deal of existing sources deal primarily with political activism and mystical aspects of the Sufi orders. Yet, researchers have neglected the rather complicated and nuanced connection between religious dimension and political landscapes of the sharifian state. Thus, this tendency has led to potential bias and, at worst, false pictures of the religio-political role of Sufism in interacting with the central sultanate in pre-protectorate-period Morocco.

While much ink has been spilled by musicologists on the legal standing of music in Islamic jurisprudential scholarship, few scholars have offered as comprehensive a view as Lois Ibsen Al-Faruqi. Thirty-five years after her major works on this issue, this article seeks to reassess her model of musical legitimacy within Muslim scholarship. Al-Faruqi places Qur’ānic recitation at the apex of a unidirectional continuum of sound art, with genres less similar to the recitation of the Qur’ān located progressively further away from it. The story we read in books about the Renaissance tells us that Petrarch and Poggio rediscovered the books of antiquity that had been copied for centuries in medieval abbeys. The re-introduction of Greek science and philosophy, however, began in the twelfth century but occurred mainly in the thirteenth century. These works were first translated into Syriac and Arabic in the eighth and ninth centuries and stored in the House of Wisdom in Baghdad. This thesis advances the study of the legal literature from the madhhab-law tradition by way of studying the Shāfiʿī literary tradition and its two most authoritative classics. These two works are al-Nawawī’s (d. 676/1278) digest Minhāj al-ṭālibīn and Ibn Ḥajar al-Haytamī’s (d. 974/1567) commentary on it, Tuḥfat al-minhāj. This study will provide a typology of the development of the Shāfiʿī juristic texts. The typology is based on an indigenous and coherent periodization centered around an analysis of the intellectual and social developments within the Shāfiʿī legal tradition, not the classical Eurocentric periodization scheme.
