In popular consciousness and culture, equality is often considered to be the preeminent socialist value. Equality, on this view, sits at the heart of the socialist ideal, and those who ascribe great value to equality will, other things being equal, find themselves more predisposed towards socialism than those who do not. However, in recent years egalitarian accounts of the socialist ideal have increasingly come under criticism from defenders of an alternative, freedom-based approach to understanding the values that underpin socialist commitment. For Axel Honneth, not all social problems can be understood as injustices. Therefore, he introduces the additional diagnostic concept of social pathology. In his book Freedom’s Right (FR), it is defined as an accumulation of persons’ inability to adequately participate in social institutions due to misunderstanding them. In contrast, injustices consist in the denial of access to social institutions for certain groups. According to the aim of presenting an ‘extended’ theory of justice in FR, Honneth intends to reconstruct all institutions necessary for realizing individual freedom in a liberal-democratic society. I develop and defend a positionalist theory of identity as a basis from which to resist identity-based violence. On this account, identities are the social positions that individuals occupy due to belief that operate upon them. This contrasts with and is intended to replace the dominant intrinsicist model, which conceives of identity as something about individuals in and of themselves. Taking gender as a focal point, I develop three overarching positionalist kinds: monogyne, polygyne, and androgyne. In Righting Health Policy, D. Robert MacDougall argues that bioethics needs but does not have adequate tools for justifying law and policy. Bioethics’ tools are mostly theories about what we owe each other. But justifying laws and policies requires more; at a minimum, it requires tools for explaining the legitimacy of actions intended to control or influence others. It consequently requires political, rather than moral, philosophy. After showing how bioethicists have consistently failed to use tools suitable for achieving their political aims, MacDougall develops an interpretation of Kant’s political philosophy. Canadian courts have struggled with delay for decades. The advent of the COVID-19 pandemic added to an already difficult situation. Courts were required to take swift action, which they did. Despite this, they have faced criticism concerning the approach taken. I will argue that this criticism is not warranted and has more to do with the perceptions of the courts’ past performance than it has to do with their response to the pandemic. Regardless, the systemic delay in Canadian courts has become an issue of ethics which overshadows any success they have had in the current pandemic.

John Rawls’ influential A Theory of Justice presents a liberal theory in which individuals gain “a sense of justice” that commits them to the success of the just society above other interests or life plans. Critics of Rawlsian liberalism such as Taylor, Sandel, MacIntyre, Walzer, and the communitarians have variously complained that his theory inadequately accounts for individual commitment to community as distinct from commitment to the whole of society. The article focuses on a troubling aspect of contemporary judicial morality.

Impartiality—and the appearance of impartiality—are the foundation of judicial decision-making, judicial morality, and the public’s trust in the rule of law. Recusal, in which a jurist voluntarily removes himself or herself from participating in a case, is a process that attempts to preserve and promote the substance and the appearance of judicial impartiality. Nevertheless, the traditional common law recusal process, prevalent in many of our state court systems, manifestly subverts basic legal and ethical norms.

In this dissertation, I advance a novel eco-political theory of territory that grounds a people’s territorial rights in its right to political self-determination understood as inextricably and normatively bound up with its right to ecological integrity and duty of ecological sustainability. I develop a social ontology of the people as the holder of territorial rights based on its members’ place-based common activities that aim at their own independent governance rather than in terms of state institutions, cultural nationhood, ethnogeography, political identity, or shared conceptions of justice. Hegel’s early philosophical writings, though primarily on the Natural Law essay (1802/3), and how, through those writings, Hegel positions himself in relation to other thinkers, such as Fichte. Although there are existing philosophical accounts of útang-na-loób (debt of good will) and the suggestion that this Filipino cultural practice can be considered a virtue is not new, questions remain about how morally desirable forms of útang-na-loób can be separated from its problematic involvement in nepotism, patronage politics, life-long servitude, corruption, and other forms of injustice. In this paper, I develop a practical and empirically grounded account of útang-na-loób as a Filipino virtue by using a neo-Aristotelian framework that allows for the incorporation of research from the social sciences into virtue-theoretic recommendations for action. Human capacities are adequate for interpreting and defining many non-human animal needs. This excerpt from the recently published Shadow Vigilantes book argues that, while vigilantism, even moral vigilantism, can be dangerous to a society, the real danger is not of hordes of citizens, frustrated by the system’s doctrines of disillusionment, rising up to take the law into their own hands. Frustration can spark a vigilante impulse, but such classic aggressive vigilantism is not the typical response. More common is the expression of disillusionment in less brazen ways by a more surreptitious undermining and distortion of the operation of the criminal justice system.

Martha Nussbaum’s work Political Emotions: Why Love Matters for Justice identifies the role that compassion plays in motivating citizens in a just society. I expand on this discussion by considering how attitudes of indifference pose a challenge to the extension of compassion in our society. If we are indifferent to others who are in situations of need, we are not equipped to experience compassion for them. Building on Nussbaum’s account, I develop an analytic framework for the public emotion of Civic Tenderness to combat indifference.
