Judicial Review As An Instrument Of Natural Rights Theory: An Intellectual History, James M. Masnov Jun 2021

Judicial Review As An Instrument Of Natural Rights Theory: An Intellectual History, James M. Masnov

Dissertations and Theses

The unique and antidemocratic power of judicial review by the United States Supreme Court is not a bug, but a feature. Its role was critical in establishing and affirming a separation of powers horizontally among the federal branches as well as vertically between the federal government and the individual states. More than this, the Court's power of judicial review acts as an instrument of rights theory and is informed by a rich and rarely-discussed intellectual history. Though judicial review as a mode of constitutional law and the legal history surrounding it has been discussed by various legal scholars, political scientists, …

Evangelizing Neoliberalism Through Megachurches In Latin America And The United States, William O. Collazo

Dissertations and Theses

The most prominent and influential feature of worldwide Evangelicalism, is the megachurch. In Latin America megachurches have proliferated and grown in political influence when they first came into contact with neoliberalism during Pinochet's dictatorship in Chile. As Latin America's poor first migrated out of rural areas into Latin American cities, then north, to the United States, they have brought with them their religion. Increasingly, this religion is Protestant, evangelical, and for many, it is Pentecostalism. Misunderstood by the early literature on Pentecostalism, is the strain of neoliberalism that has become infused in the religion's most powerful institution - the megachurch. …

Dissertations and Theses

Communities across the United States are experiencing a "civic revival" that is reconnecting community members with local decision-making and civic life in their communities. Since the 1980s, academic researchers and local governance reformers have advocated for a shift away from the traditional top-down, expert-driven approach to governance and toward a governance model in which government leaders and staff and community members work as partners to shape the community and make local decisions. Portland, Oregon, since the 1970s, has been known nationally and internationally as a city with a tradition of strong community involvement. Portland's successes and failures offer a valuable …

Politics Of Land Use : The Lengthy Saga Of Senate Bill 100, Kathleen Joan Zachary Jan 1978

Politics Of Land Use : The Lengthy Saga Of Senate Bill 100, Kathleen Joan Zachary

Dissertations and Theses

Theoretical literature on the politics of land use is so limited that original research into the problem was required. The drafting and enactment of Senate Bill 100 by the Fifty-seventh Session of the Oregon Legislature provided the basis for researching my premise of need equals want. The bill designated state land use planning organizational structure.

The Land Use Policy Committee minutes and Legislative minutes were merged with information attained through personal interviews from a variety of participants in the drafting of the Senate Bill 100. Theoretical literature was equally available in Public Administration, Law and Land Use Planning. The Constitutions …

House Bill 1302 : An Armistice In The Fish War On The Columbia, Emery Lewellyn Albertson Aug 1975

House Bill 1302 : An Armistice In The Fish War On The Columbia, Emery Lewellyn Albertson

Dissertations and Theses

In late Spring of 1969, shortly before the Oregon Legislative Session adjourned, House Bill No. 1302 as amended passed the last legislative hurdle and was signed by the Governor. The new statute recognized steelhead trout as a game fish and provided for an incidental catch of these fish by the commercial fishery.

HB 1302 was a turning point in a century of conflict over anadromous fish of the Columbia River. The bill served as an armistice in a long sports-commercial steelhead conflict by providing some protection for these fish from commercial fishing. However the bill held off a major shift …

Truman's Election In 1948, Mary Peter Kump Feb 1975

Truman's Election In 1948, Mary Peter Kump

Dissertations and Theses

You can't judge a book by its cover. The cliche may be trite, nonetheless it is applicable to Harry s. Truman. The feisty Missourian wrested greatness from the hands of his challengers who would have denied it to him because of his background. His lack of a college degree seemed to rankle the press, and as far as they were concerned disqualified him as President of the United States.

Based largely on contemporary accounts, this thesis traces the color and drama of Truman's 1948 campaign. In order to appreciate fully the triumph of the President’s victory, it was necessary to …

This thesis examines the implications that the Nixon “shocks” may have on Japan’s foreign policy. The data used consisted of books, articles, periodicals, government publications and newspapers. In addition, Japan's relations with the other three Great Powers in Asia, (China, the Soviet Union and the United States), are also studied. …
