Today, the Missouri Nonpartisan Court Plan-known informally as the "Missouri Plan"-informs the judicial selection processes in 38 of the 50 states. Put simply, the Plan operates through a nonpartisan commission that produces a list of potential judges to fill judicial vacancies. The state's governor then selects from the commission's list when making judicial appointments. After one year of service, the judges' names are then placed on a nonpartisan and noncompetitive retention ballot, in which the voters simply select whether the judge will retain his or her position or be removed. Much has been written about the pohtical origins of the Mormon conflicts in Nauvoo, Illinois, between 1839 and 1844, but relatively little scholarship has analyzed the role of the partisan press in that conflict. George Gayler and other historians claim that· Mormon political activity ... must be singled out as the chief source of irritation between [ the Mormons] and the Illinois citizens." According to Joanne Freeman's recent book on congressional violence, in the years between 1830 and 1860, members of Congress engaged in 'manly' violence against one another more than seventy times. However, no issue caused more violent personal disputes in the legislature than slavery. In particular, the debate over the legal status of slavery in the Kansas Territory caused a panoply of incidents in Congress, including near-duel between John C. Breckinridge and Francis Cutting in 1854, Preston Brooks' caning of Charles Sumner in 1856, and a brawl in the House of Representatives in 1858. This article examines how these lawmakers' views …

In 2019, Pope Francis, leader of the global Catholic Church, celebrated an outdoor Mass at the Our Lady of Csíksomlyó Hungarian national shrine in Romania. When the Franciscan Order that runs the shrine published renovation plans for the altar where the pope would appear, the Facebook post received over 800 outraged comments, including one man who asked, “How can such a beautiful Hungarian symbol, so perfectly integrated into the landscape, be humiliated like this?” By situating these expressions of outrage in the history of Eastern European material politics, I argue that the aesthetic value the commentators were defending – a …

In the late 18th century and early 19th century, European embassies eagerly interacted with Qing China (1644–1912). In 1792, Lord George Macartney (1737–1806) led the first British mission to Qing China. During this mission, even though Lord Macartney met with the Qianlong emperor (r. 1735–1796), his goal of establishing free trade and diplomatic relations with the Qing court was rejected. In 1959, Alan Abel began sending out a series of press releases to American media outlets credited to a new organization, The Society for Indecency to Naked Animals. Using the language of conservative moralists opposed to the changes in postwar society, he argued that ‘naked’ animals were scandalous and needed to be clothed. Pets, farm animals, and wildlife were all included, as the organization hued to slogans like ‘a nude horse is a rude horse’ and ‘decency today means morality tomorrow’. This paper attempts to explain the New England Counter-Revolution through two very different men--H.P. Lovecraft (1890-1937) and T. Lothrop Stoddard (1883-1950). While one was a respected and popular scholar, and the other was a little-known pulp writer, both men combined New England regionalism, a belief in Anglo-Saxon superiority, the primacy of modern science, and a belief in racial/eugenic differences to create a unique political paradigm little recognized at the time but influential today.

This article enters into the modern debate between “consti- tutional departmentalists”—who contend that the executive and legislative branches share constitutional interpretive authority with the courts—and what are sometimes called “judicial supremacists.” After exploring the relevant history of political ideas, I join the modern minority of voices in the latter camp.

This is an intellectual history of two evolving political ideas—popular sovereignty and the separation of powers—which merged in the making of American judicial power, and I argue we can only understand the structural function of judicial review by bringing these ideas together into an integrated whole.
