English Justices And Roman Jurists: The Civilian Learning Behind England's First Case Law, Thomas J. Mcsweeney
English Justices And Roman Jurists: The Civilian Learning Behind England's First Case Law, Thomas J. Mcsweeney
Faculty Publications
Article looks at a historical problem—the first use of case law by English royal justices in the thirteenth century—and makes it a starting point for thinking about the ways legal reasoning works in the modern common law. In the first Part of the Article, I show that, at its origin, the English justices’ use of decided cases as a source of law was inspired by the work civil and canon law scholars were doing with written authorities in the medieval universities. In an attempt to make the case that English law was on par with civil law and canon law, …
Working-Class Students And Historical Inquiry, Leslie Schuster
Working-Class Students And Historical Inquiry, Leslie Schuster
Faculty Publications
For the past twelve years, I have been teaching a lower division introductory historical methods course that uses active learning to introduce students to the issues and practices of historical methods, the "how to" of historical inquiry, research and writing. While there are many models for such a course, including the one described by Jeffrey Merrick in the February 2006 issue of this journal, the design of such a course at my institution requires consideration of an often-overlooked dimension. The student body at Rhode Island College (RIC) is primarily working class, mirroring a significant transformation in the traditional college student …

Italy At Home And Abroad After 150 Years: The Legacy Of Emigration And The Future Of Italianità, Mark I. Choate
Italy At Home And Abroad After 150 Years: The Legacy Of Emigration And The Future Of Italianità, Mark I. Choate
Faculty Publications
Shortly after unification in the Risorgimento, mass emigration stretched Italy in unforeseen ways, changing its culture, economics, and politics, and even its state, territory, language, and population. This enforced globalization polarized Italy and radically changed Italy as a nation-state and as a national culture. Controversies over emigration sharply divided Italian Liberals from the Nationalists and Fascists. The ideals of the nation-state, articulated by Mazzini, have been transformed by emigration in ways that have anticipated the twenty-first century global world. Today Italy faces similar challenges with rising immigration, together with the potential for constructive solutions.
The Nation Before Taste: The Challenges Of American Culinary History, Andrew P. Haley
The Nation Before Taste: The Challenges Of American Culinary History, Andrew P. Haley
Faculty Publications
Food is material and familiar, and because it is, we are often overconfident about our ability to understand the culinary past. It is easy to believe that if we can discover the recipe for some forgotten dish, the history of the dish becomes intelligible. When it does not, it tempts those who consume culinary history to impose modern sensibilities on our predecessors. The Nation before Taste" argues that historians and museum curators must be especially vigilant when presenting the history of food. Reviewing a series of historical challenges that stemmed from studying the United States in the late nineteenth and …
Village Elections And The Rise Of Capitalist Entrepreneurs, Yusheng Yao
Village Elections And The Rise Of Capitalist Entrepreneurs, Yusheng Yao
Faculty Publications
This study examines a series of four direct elections and their impact in an industrialized Chinese northern village. It finds that direct elections empowered villagers and the new economic elite to remove the old, entrenched and corrupt leadership. However, the few capitalist entrepreneurs who dominated elections and the new leadership neither abided by the rules for political competition nor tried to govern democratically. On the other hand, villagers did not feel empowered to participate in the governing process or to make officials accountable. They either became politically apathetic or hoped for a return of a benevolent authoritarian leader. This study …

Albert Einstein In Switzerland: The Education Of The Most Famous Swiss American, Kurt Winkler
Albert Einstein In Switzerland: The Education Of The Most Famous Swiss American, Kurt Winkler
Faculty Publications
The most famous Swiss American, by far, was Albert Einstein. It is well known that Einstein worked in Germany starting in 1914, but he was forced to leave in 1933 as someone the Nazis had "not yet hanged," and he came to the United States where he taught at Princeton University for many years. However, Einstein had earlier lived in Switzerland for many years. Even though he became an American citizen in 1940, the great physicist retained ties to Switzerland, and he kept his Swiss passport all his life. Einstein spent his most productive years in Switzerland where he matured, …

Florida: The Mediated State, Julian C. Chambliss, Denise K. Cummings
Faculty Publications
"The Mediated State" addresses the perceived and the real experience linked to Florida and demonstrates the state acts as a bellwether for understanding postwar America in the late twentieth and early twenty-first centuries. Examining historical shifts linked to perceptions of the state, Chambliss and Cummings argue contemporary observers, like their historical antecedents, look to Florida to glean some greater understanding of the broader national experience.

This report presents an idea for such a solution: a metadata scheme for oral histories with the working title Oral History Core.
