Party Autonomy And Consumer Arbitration In Conflict: A “Trojan Horse” In The Access To Justice In The E.U. Adr-Directive 2013/11?, Norbert Reich

Arbitration clauses in consumer contracts have been subject to controversy in many jurisdictions; recent U.S. and Canadian Supreme Court case law have been used as examples. European Union (E.U.) law, which originally excluded arbitration in general from the Brussels/Rome regimes, has recently taken a mixed, and to some extent limited, approach by including Alternative Dispute Resolution (ADR) entities “imposing” a solution in its recent ADR Directive 2013/11. There seems to be an indirect encouragement to develop consumer arbitration schemes in E.U. Member States as a second route to justice. It is too early to evaluate this new and somewhat clandestine …

The momentum behind development of global online fast track low value high volume dispute resolution (hereafter ODR) continues to accelerate. Consumer and business groups around the world are promoting fair, proportionate, effective, online, fast track redress for low value high volume cross border e-commerce disputes. As a result, there will continue to be increasing demand for a variety of effective ODR systems design and procedural rules. Best practices developed by entities like eBay and lessons learned from the work of UNCITRAL Working Group III can be helpful in developing framework models for fast track low value high volume e-commerce ODR …

In order to escape increasing political violence in the Middle East and Africa, many refugees are fleeing by sea to seek asylum in Europe. As a result, Europe has witnessed the highest influx of refugees since World War Two. European Union member states have scrambled for a solution, seemingly unable to form a collective response. The reemergence of nationalism amid the arrival of thousands of refugees not only clouds Europe’s moral compass, but also weakens the EU and its founding principles. Finding aid only for Manuscripts Small Collection 2965. Letter, 3 August 1828, from Abraham Larsh, Bowling Green, Kentucky, to his cousin John Gardner, York County, Pennsylvania. He discusses the emboldening of opposition in Tennessee to Andrew Jackson, President John Quincy Adams’s rival, despite a recent assault by Jackson supporters. He also discusses the likelihood of Jackson’s alliance with former Vice President Aaron Burr in a plot to separate western states from the Union. While pleased with local crop yields and an expressed supporter of internal improvements, Larsh looks “with anxiety” to the completion of the railroad at the Ohio River, …

Building Canadian National Identity Within The State And Through Ice Hockey: A Political Analysis Of The Donation Of The Stanley Cup, 1888-1893, Jordan Goldstein

The Stanley Cup elicits strong emotions related to Canadian national identity despite its association as a professional ice hockey trophy. This strong link between the Cup and Canadian national identity emerged in its creation and donation. Lord Stanley, in addition to his love of ice hockey, donated the Cup partly as a political action. The cup stood as a physical symbol to unite the disparate Canadian population around a new national sport. Given Lord Stanley’s position as Governor General (1888-1893) this donation carried political authority. The purpose of this study is to investigate the donation of the Stanley Cup as …

"As the president and his war managers increasingly saw Vietnam as a 'race between accomplishment and patience,' publicizing progress became an integral part of the war. Yet far from a unique case of bureaucratic dishonesty, the 1967 salesmanship campaign demonstrates the reality, even necessity, of conversation gaps when one is assessing progress in wars where the military struggle abroad matters less than the political one at home."
