Party Autonomy And Consumer Arbitration In Conflict: A “Trojan Horse” In The Access To Justice In The E.U. Adr-Directive 2013/11?, Norbert Reich

Arbitration clauses in consumer contracts have been subject to controversy in many jurisdictions; recent U.S. and Canadian Supreme Court case law have been used as examples. European Union (E.U.) law, which originally excluded arbitration in general from the Brussels/Rome regimes, has recently taken a mixed, and to some extent limited, approach by including Alternative Dispute Resolution (ADR) entities “imposing” a solution in its recent ADR Directive 2013/11. There seems to be an indirect encouragement to develop consumer arbitration schemes in E.U. Member States as a second route to justice. It is too early to evaluate this new and somewhat clandestine …

The momentum behind development of global online fast track low value high volume dispute resolution (hereafter ODR) continues to accelerate. Consumer and business groups around the world are promoting fair, proportionate, effective, online, fast track redress for low value high volume cross border e-commerce disputes. As a result, there will continue to be increasing demand for a variety of effective ODR systems design and procedural rules. The Half-Life & After-Life Of New Media, Nancy Austin
Journal of Contemporary Archival Studies
It is fitting to think of the half-life of new media using the time-based metaphor of radioactive decay. As a metaphor, an object’s half-life can be a useful way to talk about the potent technological modernity of new media and, like Walter Benjamin’s well-known notion of the aura, call attention to an object’s performativity. However, Benjamin’s aura remains a constant reminder of irrevocable originality whereas remarking on half-life references a quality that changes over time. Cesarean section in the late fourteenth and early fifteenth century was entangled in a web of legal, political, religious, medical, and ideological tensions. An act of desperation to save the child after the mother died, the procedure was embedded in the popular imagination and imbued with symbolic power. While it was promoted by the Catholic Church to save the souls of the infants through baptism, Jewish communities viewed the procedure with wariness due to its perceived unnaturalness. At the turn of the 20th century, the practical examination of caves went through a radical change. Governmental organizations and private clubs were founded in an attempt to establish speleology as an independent academic subject. In contrast to earlier cave visitors, travelers began entering underground areas and attributing the names of “explorers” or “researchers” to themselves. Fieldwork—especially cave surveying and cartography—became common practice in speleology and such work provided important clues on speleogenesis, which was a controversial issue in the first half of the 20th century. Old Roots And New Shoots: How Locals And Back-To-The-Landers Remade Maine's Local Food Economy, Eileen Hagerman

Back-to-the-landers who relocated to Maine in large numbers during the 1970s often lacked traditional rural skills and encountered a variety of agricultural challenges related to the state’s harsh climate and poor soils. Many who remained on the land often did so, at least initially, because they received support from elderly neighbors who still practiced low-input, small-scale farming. These neighbors tended to freely share their knowledge and skills and, in return, often benefited from the young newcomers’ assistance with laborious on-farm tasks. The newcomers worked with their local allies to form organizations, share knowledge, and coordinate marketing efforts tailored to meet …
