The unique and antidemocratic power of judicial review by the United States Supreme Court is not a bug, but a feature. Its role was critical in establishing and affirming a separation of powers horizontally among the federal branches as well as vertically between the federal government and the individual states. More than this, the Court's power of judicial review acts as an instrument of rights theory and is informed by a rich and rarely-discussed intellectual history. While Margaret Sanger made great strides in the crusade for legalization and open access to birth control for women, groups paired her work with ideologies such as Social Darwinism to arm the eugenics movement throughout the Twentieth-century. The eugenics movement was a culmination of racism and newly found scientific theories which led a crusade to purify the American population through reproductive cherry-picking on the basis of race. This paper focuses on the Philippine-American conflict that occurred in the late nineteenth century and the beginning of the twentieth century. It investigates the instances in which imperialism were justified by the American people. The Philippine-American war was a conflict that brought the morality of traditional American values into question. Americans were forced to face a backlash of rebel resistance on the islands as well as anti-imperialist movements at home. This war defined not only America as a world power, but as a symbol. It paved the road for the century of Americanism to come.

Communities across the United States are experiencing a "civic revival" that is reconnecting community members with local decision-making and civic life in their communities. Since the 1980s, academic researchers and local governance reformers have advocated for a shift away from the traditional top-down, expert-driven approach to governance and toward a governance model in which government leaders and staff and community members work as partners to shape the community and make local decisions. The Suits That Counted: The Judicialization Of Presidential Elections, Charles Anthony Smith, Christopher Shortell

The litigation resolving the 2000 election received extensive attention, but there was also an increase in pre-election litigation in 2000, suggesting an increased reliance on courts even prior to Bush v. Gore. Did this trend of judicialization of presidential elections in the United States accelerate in 2004? To answer this question, we collect data on pre-election litigation from 1992, 1996, 2000, and 2004. Our findings show that the rate of prospective litigation increased dramatically in the 2004 election, even accounting for state and federal electoral reform from 2001-2004. Beyond the increase in raw numbers, we find that the litigation was …

Theoretical literature on the politics of land use is so limited that original research into the problem was required. The drafting and enactment of Senate Bill 100 by the Fifty-seventh Session of the Oregon Legislature provided the basis for researching my premise of need equals want. In late Spring of 1969, shortly before the Oregon Legislative Session adjourned, House Bill No. 1302 as amended passed the last legislative hurdle and was signed by the Governor. The new statute recognized steelhead trout as a game fish and provided for an incidental catch of these fish by the commercial fishery.

HB 1302 was a turning point in a century of conflict over anadromous fish of the Columbia River. The bill served as an armistice in a long sports-commercial steelhead conflict by providing some protection for these fish from commercial fishing. However the bill held off a major shift …

This thesis examines the implications that the Nixon “shocks” may have on Japan’s foreign policy. The data used consisted of books, articles, periodicals, government publications and newspapers. Examined were such important factors as: the attitudes of the political parties in Japan on foreign policy questions, the rapid rise of the Japanese economy and the implications this has had on Japan's relations with other countries, and the question of Japan's possible remilitarization, both in conventional and nuclear terms.
