The cultural construction of gender determines the role of women and girls within the family in many societies. Gendered notions of power in the family are often shrouded in religion and custom and find their deepest expression in Personal Laws. This essay examines the international law framework as it relates to personal laws and the commonality of narratives of litigators and plaintiffs in the cases from the three different personal law systems in India.

Marital estrangement and formal divorce are vital conjunctures for married women’s kinship relations and life course, where a horizon of future possibilities are revalued and negotiated at the interstices of custom, law, and social and ritual obligations. In this article, after delineating the forms of customary and civil marriage and the possibilities for divorce or estrangement from each, I describe how some married women in Swaziland and South Africa mediate this complex social field for their children and families through pensions and continuing to pay for their partners’ insurance coverage. There is a general silence in both society and academia surrounding women’s health and the social conception of purity. Purity myths and misconceptions have created stigmas that women of all backgrounds must navigate to manage and care for their reproductive and sexual health. This study investigates the importance of purity and how it is used to define, measure, and categorize women’s bodies and behaviors. Women’s perception of purity, specifically in regards to menstruation and pre-marital sex, were investigated using semi-structured interviews in Dehradun, Uttarkhand. Discourse on women's reproductive rights through the lens of Muslim culture. The use of contraception, assisted fertility and abortion, are analyzed in Iran and Afghanistan. The culture surrounding family planning is detailed through a woman’s community, family, religion and the laws that govern the society they live in, which all influence her decision making in these matters. This piece stands as a cultural analysis of women's agency specifically in Middle Eastern Muslim culture, as it stands as a part of a global women's rights movement.

The Gender Problem Of Buddhist Nationalism In Myanmar: The 969 Movement And Theravada Nuns, Grisel D'Elena

This thesis uses transnational and Black feminist frameworks to analyze Buddhist nationalist discourses of gender and violence against religious and ethnic minorities in Myanmar. Burmese Buddhist nationalists’ marginalization of the Muslim Rohingya ethnic minority is inextricably linked to their attempts to control Buddhist women. Research includes interviews with U Ashin Wirathu, the leader of the monastic-led nationalist group, the 969 Movement, and with other monks of the organization, as well as with non-nationalist monks, nuns and laywomen. Since its 2003 village electrification scheme, the state of Gujarat has been acclaimed for providing rural households with 24-hour access and farmers with uninterrupted 8-hour power supply. The Government of India has emphasized goals of providing electricity for all of its citizens yet has been unable to address glaring discrepancies across the country. For those in rural areas, which is approximately 60-70 percent of India’s population, a varying degree of connection exists plagued by frequent outages, transmission losses, unreliable billing practices, and poor infrastructure maintenance. Law forms one of the major structural contexts within which family lives play out, yet the precise dynamics connecting these two foundational institutions are still poorly understood. This article attempts to help bridge this gap by applying sociolegal concepts to empirical findings about state law's role in family, and especially in marriage, drawn from across several decades and disciplines of South Africanist scholarly research. I sketch the broad outlines of a nuanced theoretical approach for analysing the law-family relationship, which insists that the relationship entails a contingent and dynamic interplay between relatively powerful regulating institutions and relatively powerless regulated populations. …

This paper maps a cartography of struggle to document the dynamic, living legacy of Menominee leader Ingrid Washinawatok El-Issa and her contribution to the decolonial possibilities of transnational Indigenous feminism. I propose that mapping a cartography of struggle is a useful way for movements to consider how the past informs the present and future possibilities of resistance and decoloniality.

Because women encounter unique geographic, social, political, religious, economic, and temporal conditions, applying the particular agendas of traditional western feminism to countries like India can easily become a form of cultural imperialism or lead to Orientalism. Therefore, in this essay I argue that in order to support the agency of Indian women, western feminists must step back; Indian women and men who seek women's uplift must claim post-patriarchal expressions of traditional Indian culture.
