This thesis studied the history of the school of sharīʿa judges (1907-1927) as an essential episode of the reform of Sharīʿa courts in Egypt in the early 20th century. The thesis studied the school in connection with the broader context of legal modernization of the Egyptian legal system. The study explored the institutional, pedagogical, and legal aspects of the reform that the school advocated. The study analyzed the impact of the school’s pedagogy on the practice of the Islamic judiciary and the theoretical conception of Sharīʿa. The research engages in an exploration of human rights in Islam. Human rights issues are then contrasted with international law positions. The data gotten is then used for investigating women’s human rights issues in Shariʾa penal tradition regarding zinā (adultery) in Nigeria. The re-emergence of Sharia penal codes adopted by 12 Northern states in Nigeria in 1999 as an operative Islamic law has sparked concerns about rulings amounting to stoning to death in several cases of zinā. These events raised concerns about Shariʾa penal traditions’ legality and relationship with other legal traditions operational in Nigeria, a secular political space. …

Illumination, or knowledge through divine light, is a type of mystical cognition that Abu Hamid Ghazali regarded to be the cause of his rescue from his famous skeptical crisis. According to him, this type of divine knowledge is the apex of knowledge, to which all other sciences are subordinate. The receptive organ of this knowledge is the heart, a divine and cognitive subtlety that is distinct though related to the physical heart. Narrations by notable Islamic personalities are a significant part of the Islamic religious edifice. However, these narrations are of variable quality and authenticity. To evaluate these narrations, standards and tools were developed and used. Texts, Language, And History In The Madhab-Law Tradition: A Study Of The ShāfiʿĪ School, Tarek Ghanem

This thesis advances the study of the legal literature from the madhhab-law tradition by way of studying the Shāfiʿī literary tradition and its two most authoritative classics. These two works are al-Nawawī’s (d. 676/1278) digest Minhāj al-ṭālibīn and Ibn Ḥajar al-Haytamī’s (d. 974/1567) commentary on it, Tuḥfat al-minhāj. This study will provide a typology of the development of the Shāfiʿī juristic texts. The typology is based on an indigenous and coherent periodization centered around an analysis of the intellectual and social developments within the Shāfiʿī legal tradition, not the classical Eurocentric periodization scheme. Man as a being has always been concerned with seeing the unseen; each individual who ventures upon this search has a different trajectory. Since Quranic inscriptions dominate the epigraphic decoration of Cairene Islamic religious monuments, the target of this thesis has been to investigate the Quranic inscriptions of some selected religious monuments of each main era of the Islamic history of Cairo: Fatimid, Mamluk and Ottoman.
