This article offers a reading of Hilary Brougher’s film Stephanie Daley (2006), in which a teen is accused of murdering her newborn (neonaticide). Brougher depicts a “phenomenology of unwanted pregnancy” and an example of therapeutic jurisprudence. Part One examines Brougher’s treatment of the “shadow side of pregnancy,” and highlights barriers to the empathetic treatment of neonaticide. Part Two emphasizes the process of therapeutic jurisprudence as experienced by the two main characters. Brougher’s film provides a social narrative and phenomenology that may influence laws and legal responses and enlarge social understanding of unwanted pregnancy.

Despite apparent feminist advancements within contemporary South Africa, gender transformation in the South African media industry has been both limited and irregular in terms of the ways in which newsroom cultures are being transformed, and the ways in which this impacts on the production of gendered media texts. Based on interviews with journalists and editors from three weekly South African newspapers, the Sunday Times, the Sunday Sun and the Mail & Guardian, this article explores the ways in which journalists articulate their understandings of gender and gender transformation within the media, and reflects on the ways in which these articulations …

Reconsiderations of home have been crucially examined in Caribbean cultural productions. As Jamil Khader argues in her article on “Subaltern Cosmopolitanism: Community and Transnational Mobility in Caribbean Postcolonial Feminist Writings,” Caribbean feminists are faced with the task of challenging a conventional idea of home that has historically located women and other marginal subjects under conditions of oppression and exploitation. This article explores the competing discourses of radical feminism and sex radicalism on the international sex trade. These voices have been dominant in feminist debates on this issue and both have proved significant forces when it comes to legal reform. Radical feminists characterize prostitution as an abuse of human rights, regardless of whether it is forced or voluntary, and have fought for its abolition. They have had a substantial impact on the development and adoption of anti-trafficking legislation and instruments in various countries and at the international level. Infertility can be an agonizing experience, especially for women. And, much of the agony has to do with luck: with how unlucky one is in being infertile, and in how much luck is involved in determining whether one can weather the storm of infertility and perhaps have a child in the end. We argue that bad luck associated with being infertile is often bad moral luck for women. In a number of international fairy tale types, such as ATU 451 ("The Maiden Who Seeks Her Brothers"), the female protagonist voluntarily stops speaking in order to attain the object of her quest. In ATU 451, found in the collected tales of the Grimms and Hans Christian Andersen as well as in oral tradition, the protagonist remains silent while weaving the shirts needed to disenchant her brothers from their birdlike forms. While this silence is undoubtedly disempowering in some ways as she cannot defend herself from persecution and accusations of wickedness, here I argue that the choice to remain silent …

In this paper, I explore how contemporary American practitioners of belly dance (as Middle Eastern dance and its many varieties are often called in the English-speaking world) conceptualize not only the spiritual dimensions of their dance, but also how the very notion of performance affects sacred and spiritual dance practices. Drawing on interviews with this community, I describe the techniques of sacred and spiritual belly dancers, how these dancers theorize performance, and how the conflicts inherent to patriarchal mind-body dualism are resolved in these practices. In a context of great technological and social change, existing intellectual property regimes such as copyright must contend with parallel forms of ownership and distribution. Proponents of open access question and undermine the paradigm of exclusivity central to traditional copyright law, thereby fundamentally challenging its ownership structures and the publishing practices these support. In this essay, we attempt to show what it is about the open access endeavour that resonates with a feminist theory of law and society - in other words, we consider what is “feminist” about open access. Copyright law is fundamentally concerned with the value of cultural works — both the recognition and the creation of this value. Yet it is seldom acknowledged that copyright law makes or requires any value judgment in the sense of an aesthetic evaluation of copyright’s subject matter. What happens to feminism in the university is parallel to what happens to feminism in other venues under economic restructuring: while the impoverished nation is forced to cut social services and thereby send women back to the hierarchy of the family, the academy likewise reduces its footprint in interdisciplinary structures and contains academic feminists back to the hierarchy of departments and disciplines.
