Following are reproduced the title pages of the five printed editions of Joshua Scottow’s Old Mens Tears for Their Own Declensions. It is certainly unusual for such a work to have been reprinted so many times over such a long period, 1691–1769, and it must testify to the continuing appeal of the tract in New England. Scottow died in 1698, and so had no hand in any of the editions except the first. A multi-edition collation might yield a genetic tree, showing which editions derived from which others. This is an open-access electronic text edition of Filson’s seminal work on the early history of Kentucky, including the first published account of the life and adventures of Daniel Boone. Filson’s work was an unabashedly optimistic account of the western territory, where Filson had acquired large land claims, whose value he sought to enhance by the publication of this advertisement and incitement for further settlement. Scarcely two years after the violent and tragic British and Indian invasion of 1782, Filson portrayed Kentucky as a natural paradise, where peace, plenty, and security reigned. A Brief History Of Oyster Aquaculture In Rhode Island, Michael Rice

The history of the development of oyster aquaculture is reviewed, beginning with pre-colonial shellfishing by the Native American Narragansetts and Wampanoags of Narragansett Bay. Leasing of estuarine waters for aquaculture of oysters began with legislation by the Rhode Island General Assembly before the turn of the 19th Century. Legal developments during the 19th Century led to the expansion of oyster aquaculture to the point that about 21,000 acres of Rhode Island's estuarine and coastal waters were leased for oyster farming by 1910. Industrialization, sewage pollution, siltation, the Hurricane of 1938 and socio-political changes in the 1920s and 1930s led to …

Copyright law's default settings inhibit sharing and adaptation of creative works even though new digital technologies greatly enhance individuals' capacity to engage in creative conversation. Creative Commons licenses enable a form of conversational copyright through which creators share their works, primarily over the Internet, while asserting some limitation on user's right with respect to works in the licensed commons. More specifically, this chapter explains the problems in copyright law to which Creative Commons licenses respond, the methods chosen, and why the machine-readable and public aspects of the licenses are specific examples of a more general phenomenon in digital copyright law …

Curry On Long, 'Mapp V. Ohio: Guarding Against Unreasonable Searches And Seizures' (Book Review), Lynne E. Curry

In June, 1961, the U. S. Supreme Court delivered its opinion in Mapp v. Ohio, thereby launching the "due process revolution" in which the Court, under Chief Justice Earl Warren, expanded the universe of rights and protections guaranteed to individuals in the criminal justice system. Justice Tom C. Clark's majority opinion held that the "exclusionary rule," by which judges barred evidence gathered in the course of violating the Fourth Amendment's protections against unreasonable searches and seizures from being entered in federal trials, was constitutionally required and thus also applied in state criminal proceedings. By Custom and By Law: Black Folklore and Racial Representation at the Birth of Jim Crow establishes folklore as a contested site in the construction of racial identity during the emergence and solidification of legalized racial segregation at the end of the nineteenth century. By examining institutional interests, popular culture performances, and political rhetoric, I demonstrate how representations of black folklore played a seminal role in perpetuating a public discourse of racial difference. At midlife one tends to see life differently; in that, the meaning and purpose of the first half of life begins to fail us… and our whole agenda changes. Reaching midlife for many of my clients brings with it feelings of fracturing, alienation and lustiness. This paper is a reflective examination of how midlife changes bring out what Jung emphasized about the anima's role: as that factor in the male psyche responsible for the process of projection, not just for projections of and onto women- but all projection.

This paper offers a few preliminary reflections on some ethical implications stemming from the disconnect between the moral rhetoric and the reality of the War on Terrorism. I suggest that the Bush Administration certainly shares a large part of the responsibility for constantly attempting to justify a war that, by the standards of traditional just war theory, is almost impossible to see as just. However, I also suggest that part of the responsibility lies with a public that demands high ethical standards of its public officials, but appears to be ultimately unprepared to face the full consequences of acting ethically …

The late twentieth century is fascinated by the phenomenon of the gothic child, the child who manifests evil, violence, and sexual aggression. On the face of it, this evil is “caused” by either medical or social factors: medicinal drugs, radiation, or the corrupting influences of political others. However, this essay argues that the gothic child actually arises from conflicting forces of child-philosophies, the intersection of Romantic childhood innocence with Freudian depth models. These models tacitly point to a child that “is” rather than “is made”, a child that belies contemporary parental attempts to make it be otherwise. Moreover, the idea …

In November, 2005 a landmark government report entitled the National Review of School Music Education was released. The report found that there was a great variability in the quality of music education in schools. It was acknowledged that although there are some excellent music programs in schools, there is 'cycles of neglect and inequity' and greater support is required for teachers and the subject itself. The report acknowledged the influence of recent curriculum developments in Australia including integrating the arts into one subject.
