Ethics Or Law: Which Should Prevail In Conflicts Regarding The Restitution Of Nazi-Looted Art?, Anthony Caruso

Museums and sovereign states often face a dilemma when confronted with a claim seeking restitution of Nazi-looted artwork. The assertion of legal technicalities may allow an institution to maintain possession of its artwork whereas ethics would dictate its return. This paper discusses three cases where legal technicalities take precedence over ethics. This conflict demonstrates the need to have such disputes addressed in a forum other than a court system.

In several of Jane Austen’s novels, her heroines are confronted more than once with the proposition of marriage. Many of the primary proposal scenes in these tales contain violent language seemingly at odds with the romantic context, and the romance convention, of a proposal scene. Austen’s rhetoric of violence functions as a critique of contemporary laws defining and regulating marriage, particularly Blackstone’s Commentaries on the Laws of England, published in 1765. In Jewish tradition the five books of Moses hold the place of honor in Israel's sacred writings as the Torah or "instruction" of God. Some people, even in ancient times, seemed to emphasize the legislative teachings or commandments, so the Greek translators chose the word "Nomos" or "Law" to render Torah. Indeed, laws provide the practical norms whereby people guide their lives and teach their offspring. However, in most cultures legislation has its complement in inspiring narratives. Heroes and heroines of times long past are presented as worthy of imitation. They exemplify the ideal that offers a synthesis about the …
