The paper analyses and evaluates the linguistic policy of the Court of Justice of the European Union against the background of other multilingual courts and in the light of theories of legal interpretation. Multilingualism has a direct impact upon legal interpretation at the Court, displacing traditional approaches (intentionalism, textualism) with a hermeneutic paradigm. It also creates challenges to the acceptance of the Court’s case-law in the Member States, which seem to have been adequately tackled by the Court’s idiosyncratic translation policy.

Despite the extraordinary amount of attention critical thinking has received in the last few decades, the teaching and fostering of critical thinking in higher education is largely failing, and critical thinking has become an empty buzzword. However, given its importance as an aim of education, it needs to be “refilled”, but that is possible only after identifying the causes of the current failure, i.e. the obstacles to fostering critical thinking. Rhetoric scholars (Predergast, Leweicki-Wilson, Pryal) have examined the rhetorical disempowerment of the mentally ill, whose perceived lack of reason isolates them from public discourse. Such isolation can be explained using Kenneth Burke's theory of identification (and its "ironic counterpart," division) which shows how the discursive markers of "sane" and "insane" function to create an in-group, the sane, that relies upon the rhetorical and physical isolation of the insane. The article argues that the mentally ill make an ideal Burkean scapegoat, and that the criminal acts of a few mentally ill people provides the necessary justification for the scapegoating of the …

A study of twenty-five newly returned adult students finds that students with more process experience used more and more specific process analogies to construct their writing processes for school assignments than those with less process experience. Cues from peers and sense of academic identity also influenced transfer of process knowledge.

Employers bemoan that new lawyers cannot write. Professors teaching upper-level law school courses wonder why students cannot apply their first-year (1L) legal writing skills. Law students worry that their legal writing courses have not prepared them to write all of the document types they will encounter in practice. In response to these complaints and fears, law school administrators push legal writing professors to squeeze more and more different document types into first- year legal writing courses.

Judicial intuition is misunderstood. Labeled as cognitive bias, it is held responsible for stereotypes of character and credibility. Framed as mental shortcut, it is blamed for overconfident and mistaken predictions. Depicted as flashes of insight, it takes credit for unearned wisdom. The true value of judicial intuition falls somewhere in between. When judges are making judgments about people (he looks trustworthy) or the future (she will be the better parent), the critics are correct: intuition based on past experience may close minds. This article explains how lawyers like Christopher Columbus Langdell and James Barr Ames, a disciple of Langdell, employed rhetoric between 1870, when Langdell assumed the deanship at Harvard Law School, and 1920, when law had emerged as a credible academic field in the United States, to construct a persona, that of a scholar, appropriate for the law professor situated within the university. To discuss spirit injury, it is at first necessary to articulate a space in the theoretical diaspora to conceptualize spirit injury as a concept deeply tied to the historical tradition of several theoretical frameworks. “Spirit injury” is a phrase popularized by critical race feminist Adrien Katherine Wing. It is a term utilized in critical race feminism (CRF) that brings together insights from critical legal studies (CLS) and critical race theory (CRT).
