In the first and fourth speeches of Zarathustra titled "Three Metamorphoses of the Spirit" and “The Despisers Of The Body,” Nietzsche articulates his own views on themes central to Kant’s theoretical philosophy. In so doing, he articulates two systems of reason: consciousness or "little" reason, which he conceptualizes in the same way that Kant conceptualizes theoretical reason, and "the great reason of the body." This paper is about some theoretical and methodological problems of law and economics. I will use game theoretical insights to address an issue which is relevant both for law and economics and legal philosophy: How should a social scientific analysis of law account for the normativity of law, i.e. the non-instrumental reasons for rule-following while retaining the observer’s (explanatory or descriptive) perspective. My goal is to offer a constructive critique of both traditional law and economics scholarship and mainstream analytical legal philosophy in this respect. That is, how could an exchange of words between analyst and analysand effect a cure to neurosis? To answer such questions would be to uncover the therapeutic action of psychoanalysis. This paper argues that though Derrida is correct to bring to the fore the undecidability that is contained in his political notion of the democracy to come, his account does not extend the aporia of undecidable politics far enough. Derrida himself makes evident this gap. Though politics may be structured with undecidability, there are times when direct, decisive and definitive political interventions are required. In his campaign against capital punishment, the blitzing campaigns in Bosnia and Iraq, and in his call for les villes-refuges, Derrida makes decisive appeals which somehow seem to contradict the undecidability he sees as arch-structuring. If the individual self is not equal to the subject self and “agency”, as Wimal Dissanayake defines it, is seen as the link between the two: can the agency of Gandhi be described as utilizing the Freudian mirror stage development to overthrow subjectivity? I believe that, in fact, Gandhi’s reaction to British imperialism projects a reflected ego ideal which is used to combat the subjectivity of colonization and create an Indian “self”.

Our first aim in this paper is to respond to four novel objections in Jason Stanley's 'Context and Logical Form'. Taken together, those objections attempt to debunk our prior claims that one can perform a genuine speech act by using a sub‐sentential expression—where by 'sub‐sentential expression' we mean an ordinary word or phrase, not embedded in any larger syntactic structure. Our second aim is to make it plausible that, pace Stanley, there really are pragmatic determinants of the literal truth‐conditional content of speech acts. We hope to achieve this second aim precisely by defending the genuineness of sub‐sentential speech acts. …

The question "When are research risks reasonable in relation to anticipated benefits?" is at the heart of disputes in the ethics of clinical research. Institutional review boards are often criticized for inconsistent decision-making, a problem that is compounded by a number of contemporary controversies, including the ethics of research involving placebo controls, developing countries, incapable adults and emergency rooms. If this pressing ethical question is to be addressed in a principled way, then a systematic approach to the ethics of risk in research is required. Component analysis provides such a systematic approach.

Research in the intensive care unit (ICU) is commonly thought to pose 'serious risk' to study participants. This perception may be at the root of a variety of impediments to the conduct of clinical trials in the ICU setting. Component analysis offers a promising approach to the ethical analysis of ICU research. Because clinical trials commonly involve a mixture of study interventions, therapeutic and nontherapeutic procedures must be analyzed separately. Therapeutic procedures must meet the requirement of clinical equipoise. Risks associated with nontherapeutic procedures must be minimized consistent with sound scientific design, and be deemed reasonable in relation to the …

In recent years, many business ethicists have raised problems with the "ethics pays" credo. Despite these problems, many continue to hold it. I argue that support for the credo leads business ethicists away from a potentially fruitful approach found in Hume's moral philosophy. I begin by demonstrating that attempts to support the credo fail because proponents are trying to provide an answer to the "Why be moral?" question that is based on rational self-interest. Then, I show that Hume's sentiments-based moral theory provides an alternative to the credo that points toward a more fruitful approach to business ethics. Along the …

The Utility Of Offshoring: A Rawlsian Critique, Julian Friedland

Most prominent arguments favoring the widespread discretionary business practice of sending jobs overseas, known as ‘offshoring,’ attempt to justify the trend by appeal to utilitarian principles. It is argued that when business can be performed more cost-effectively offshore, doing so tends, over the long term, to achieve the greatest good for the greatest number. This claim is supported by evidence that exporting jobs actively promotes economic development overseas while simultaneously increasing the revenue of the exporting country. After showing that offshoring might indeed be justified on utilitarian grounds, I argue that according to Rawlsian social-contract theory, the practice is nevertheless …
