Some Ethical Issues In Treating And Caring For People With Dementia, Robert Scott Stewart Ba, Ma, Ph.D.

This paper explores several issues regarding the treatment and care for patients suffering from dementia, including a discussion of the relatively low time and money spent on dementia research compared to research on cancer and cardio-vascular disease. It will also discuss the special relationship between the person suffering from dementia and their carer, who is often a loved one. The paper employs principlism and so examines these issues from a consideration of autonomy, non-maleficence, beneficence, and justice.

Ethical theories of justice and care are often presented in opposition to each other. Eleonore Stump argues that Aquinas’s moral theory has the resources to bring justice and care together. There is, however, a potential worry for her view raised by the ‘Confucian Puzzle’. The puzzle poses a moral dilemma between care and justice that serves as a test case for Stump’s picture. In this paper, I provide a brief overview of the justice and care debate along with the subsequent challenges that both positions face in order to situate Aquinas’s position as Stump defends it. Sheathing The Sword: Augustine And The Good Judge, Veronica Roberts Ogle

In this article, I offer a reading of City of God 19.6 that is consonant with Augustine’s message to real judges. Often read as a suggestion that torture and execution are judicially necessary, I argue that 19.6 actually calls such necessities into question, though this is not its primary purpose; first and foremost, 19.6 is an indictment of Stoic apatheia. Situating 19.6 within Augustine’s larger polemic against the Stoics, I find that it presents the Stoic judge as a man who lacks fellow feeling, and therefore, has only a parodic happiness, costly to himself and those judges. The Subversions And Perversions Of Shadow Vigilantism, Paul H. Robinson, Sarah M. Robinson

This excerpt from the recently published Shadow Vigilantes book argues that, while vigilantism, even moral vigilantism, can be dangerous to a society, the real danger is not of hordes of citizens, frustrated by the system’s doctrines of disillusionment, rising up to take the law into their own hands. Frustration can spark a vigilante impulse, but such classic aggressive vigilantism is not the typical response. More common is the expression of disillusionment in less brazen ways by a more surreptitious undermining and distortion of the operation of the criminal justice system.

Capturing Transitional Justice: Exploring Colleen Murphy’S The Conceptual Foundations Of Transitional Justice, Margaret Urban Walker

Colleen Murphy’s impressive book presents a unified theory of transitional justice as a single, novel, distinct kind of justice, intended to guide normative evaluation of the choices transitional societies make in dealing with the past. I raise three central challenges to Murphy’s theory. First, how do we know that transitional justice is fundamentally a single special kind of justice that permits a grand unified theory? Second, is it plausible to hold, as Murphy claims, that societal transformation is the overarching aim or objective of transitional justice?
