Politics, Players, And Legislation In The California Housing Crisis, Andy Daly
All Theses
California has faced a statewide housing shortage for three decades, particularly in exclusive job-rich cities that are becoming increasingly unaffordable. In response, the state has passed pro-housing legislation that bypasses local zoning regulations, focusing on increasing the construction of affordable housing units. I conducted a convergent content analysis of over 80 articles and eight expert interviews. I found that state-led housing legislation is most effective when politicians align their messaging with other pressing issues, such as climate change, transit, and homelessness. Even if bills are rejected, progress is made by opening conversations about the importance of density and housing affordability. …

Saving The World Through Zoning: The Sustainable Development Code, Regeneration, And Beyond, Jonathan Rosenbloom, Chris Duerksen

The land use and planning community began to address sustainability at the local level in the 1990s, but in reality, state-of-the-art development codes drafted in the 1990s and early 2000s did little to address climate change, energy conservation, community health, loss of biodiversity, shifting biochemical cycles, racial justice, food supply, and other key sustainability issues. This article reviews past challenges that had to be overcome for sustainable development codes to become mainstream. The good news is that an increasing number of local governments are adopting ambitious sustainable development codes that hold great promise to not only protect the environment and …

The state of Vermont faces increasing risk of costly damage from catastrophic flooding events as climate change increases the frequency of heavy rains and cumulative precipitation. In addition to increasing flood inundation risk, extreme precipitation events are leading to high rates damage from fluvial erosion—erosion caused by the force of floodwater and the materials it carries. As in all U.S. states, flood hazard governance in Vermont is shared by multiple levels of government and involves a complex compliance model that relies on local governments to regulate private property owners to achieve community, state, or federal goals.

Environmental Justice In Little Village: A Case For Reforming Chicago’S Zoning Law, Charles Isaacs

Chicago’s Little Village community bears the heavy burden of environmental injustice and racism. The residents are mostly immigrants and people of color who live with low levels of income, limited access to healthcare, and disproportionate levels of dangerous air pollution. Before its retirement, Little Village’s Crawford coal-burning power plant was the lead source of air pollution, contributing to 41 deaths, 550 emergency room visits, and 2,800 asthma attacks per year. After the plant’s retirement, community members wanted a say on the future use of the lot, only to be closed out when a corporation, Hilco Redevelopment Partners, bought the lot …

This paper seeks to understand how zoning, urban design, and use value control the dynamics of a city and the public space, from the way they are shaped, to the way they are built, and finally to the way they are used. Of all powers given to local governments, the power to zone is one of the most significant. Zoning dictates everything that gets built in a locality—and thus effectively dictates all of the key activities that take place within it. Nationwide, most zoning codes were adopted in the first half of the twentieth century. Many, including the zoning codes of New York City and Chicago, were significantly revised in the 1960s. While these codes have been revised piecemeal, just a few American cities have undergone a comprehensive revision: replacing the old code with a completely new one.

This paper investigates a common mode of visual communication in planning practice, the use of maps to regulate urban development. Holding equal legal status with the text, the zoning map was invented in the early twentieth century as a tool for implementing municipal policy and, although debated, modified, and sometimes repurposed over the past nine decades, it remains standard. Mundane and largely taken for granted, the zoning map itself has aroused little scholarly interest. However, as an image of the city and as a graphic intermediary used in administrative processes, it reveals how planning thought is embedded in planning tools.

Increasingly, senior only residences are zoning seniors out of mainstream residential areas and into segregated living and mature communities. Senior gated communities are variations on a theme of gated communities in which lifestyle is packaged and sold. Active adult retirement communities exclude the young and offer active lifestyle living, with diverse levels of senior living choices. Such an approach contrasts with policies designed to encourage aging in place. It is also distinct from Golden Age Zoning districts designed to allow affordable housing for senior citizens in a public/private partnership. The goal of the Master of Regional Planning Studio is to develop a student’s techniques for collecting, analyzing, and synthesizing spatial and non-spatial data and then presenting that collective data in a manner (i.e., report, video, presentation, and charettes) that is understandable to academics, professionals, and the public. Planning Studio allows students to integrate knowledge from coursework and research, and apply such knowledge to resolving representative planning problems. At UMASS Amherst, these problems are found in neighborhood, rural, urban, and/or regional settings.

This research analyzes the relationship between local land use regulations and commercial development in the City of Bakersfield, California, specifically focusing on how the regulations are used to inform commercial development to be sustainable or not. This research contributes to similar research efforts through its contribution of the Sustainable Development Indicator Checklist, the tool used to measure sustainable development within the regulations as well as the built environment. The City of Arroyo Grande, California has a problem administering the
regulations of five Planned Developments in the City. This problem arises
from these regulations being included in a 167-page appendix at the back of
the City’s Development Code. This appendix includes the original approvals
for the Developments. It also includes amendments to those approvals.
These amendments are only added to the appendix. Therefore, changes to
the regulations governing the Planned Developments are not tracked. It
takes City staff considerable amounts of time to research answers when

Euclidean land use regulations that segregate different kinds of uses from one another can present significant barriers to achieving the land use-related principles of New Urbanism on a foundational level. This research evaluated the zoning ordinance of the city of Lincoln, Nebraska, with a special focus on the Community Unit Plan and Planned Unit Development processes, in order to determine its openness to mixed housing and mixed uses, using a combination of policy analysis and Geographic Information System (GIS). The purpose of this Article is to ascertain whether (1) suburban sprawl is as widespread in Canadian metropolitan areas as in their American counterparts, and (2) Canadian government policies, and in particular Canadian zoning law and transportation policies, encourage sprawl. The article concludes that Canadian metropolitan areas are in fact somewhat less sprawling than most of their American counterparts, but that in Canada, as in the United States, government land use regulation and government transportation policy do favor sprawl to some extent. Local governments are beginning to require new, privately constructed and funded buildings to be “green” buildings. Instead of creating their own, locally-derived definitions of green buildings, many municipalities are adopting an existing private standard created by members of the building industry: LEED (Leadership in Energy and Environmental Design). This Article explains and assesses the privately promulgated LEED standards. It argues that the translation of LEED standards, which were intended to be voluntary, into law raises several theoretical and practical problems. Specifically, private green building ordinances that rely on LEED do not ensure a reduction in the negative local environmental impacts …

A Study Of American Zoning Board Composition And Public Attitudes Toward Zoning Issues, Jerry L. Anderson, Aaron Brees, Emily Renninger

The authors surveyed zoning boards in the over 100 of the largest U.S. cities to determine the occupational composition of board members. It comes as no surprise that the boards are overwhelming populated with white-collar citizens, with business owners and real estate development the most prevalent occupations represented. The authors then conducted a survey of citizens to determine whether this skewed board composition makes any difference to the decision-making process. The study concludes that the composition of the board does matter, but not always in ways one might predict.

In Sprawl: A Compact History, Robert Bruegmann, an art historian, has painted a superficially convincing case for the status quo, asserting that sprawl is “a natural result of affluence that occurs in all urbanized societies.” Bruegmann's book has generated glowing media publicity. This article suggests that Bruegmann overestimates the universality of sprawl, by overlooking the differences between pedestrian-friendly cities with some sprawling development and cities in which automobile-dependent sprawl is the only choice available to most consumers. In addition, Bruegmann understates the harmful social effects of sprawl, especially the effect of automobile-dependent development upon non-drivers. Bruegmann also consistently underestimates the …

This study reviews Clark County's non-conforming zone change process from 1990 to 2002. A non-conforming zone change, sometimes known as a non-conforming zone boundary amendment is a proposed request that is not within the range of residential densities and/or non-residential intensities indicated on the applicable land use plan map, master plan, or concept plan.
