White Religious Educators Resisting White Fragility: Lessons From Mystics, Mary E. Hess Dec 2016

White Religious Educators Resisting White Fragility: Lessons From Mystics, Mary E. Hess

Faculty Publications

Decades of work in dismantling racism have not yielded the kind of results for which religious educators have hoped. One primary reason has been what scholars term “white fragility,” a symptom of the structural racism which confers systemic privilege upon White people. Lessons learned from Christian mystics point to powerful ways to confront and resist the siren call of such formation and instead to make resisting racism an integral part of Christian identity for White people.

Janice Holt Giles And The "White Caps” Of Kentucky, Michael R. Brown Dec 2016

Janice Holt Giles And The "White Caps” Of Kentucky, Michael R. Brown

Library Staff Presentations & Publications

Janice Holt Giles (1905-1979) has more to say about the Brethren in Christ than any other novelist or popular writer;' in fact, she stands alone. Her 25 books, written from 1950 to 1975, sold four million copies in her lifetime, and some remain in print and have recently attracted renewed interest. Primarily noted for her historical fiction about the Western frontier, she is also noted for novels and memoirs set in her adopted state of Kentucky. Of these, four describe or characterize the Brethren in Christ at varying length and another three mention or make allusions to them. One novel, …

1916 And The Challenges Of Commemorative Exhibitions In Ireland, Siobhan Doyle Dec 2016

1916 And The Challenges Of Commemorative Exhibitions In Ireland, Siobhan Doyle

Conference papers

Like many countries, Ireland has a chaotic and tumultuous past which results in challenges for national cultural institutions in presenting history to satisfy the education and expectation of both national and transnational audiences. The Easter Rising of 1916- a failed rebellion against British rule- is the pivotal event in the creation of the modern Irish state and is synonymous as a moment in the past which represents Irish history, characterizes Irish culture and amplifies national identity.

With 2016 marking 100years since the Easter Rising, my paper will explore how the recent centenary commemorations of this historic event have been a …

The purpose of this paper is to provide a high level overview of some of the issues and stumbling blocks Canada has encountered in building a diverse judiciary. Part 1 of the paper begins by providing a brief overview of the heterogeneous makeup of Canadian society against the homogenous makeup of the judiciary. This will provide a helpful backdrop from which to explore conceptual questions related to the question of why a diverse judiciary matters. Part 2 examines some of the historical questions and milestones in the judiciary related to diversity. Part 3 summarizes the judicial appointments processes and takes …

Martin V. Mott And The Establishment Of Executive Emergency Authority, Eli Berns-Zieve Nov 2016

Martin V. Mott And The Establishment Of Executive Emergency Authority, Eli Berns-Zieve

Legal History Publications

In August of 1814, a New York farmer named Jacob E. Mott refused to rendezvous with the militia pursuant to the orders of Governor Daniel D. Tompkins as commanded by President James Madison. In 1818, Mott was court martialed and fined ninety-six dollars. One year later, Mott brought an action in replevin in the New York state courts to recover chattel taken from him by a deputy marshal in lieu of the ninety-six dollars. Both the New York trial and appellate courts sided with Mott. In a unanimous opinion authored by Justice Joseph Story, the Supreme Court of the United …

Let’S Stop Calling This A Crisis And Start Building More Homes, Lorcan Sirr Oct 2016

Let’S Stop Calling This A Crisis And Start Building More Homes, Lorcan Sirr

Media

Over the past couple of years I have made a concerted effort not to use the phrase “housing crisis”, and I’ve been doing quite well, too. Recently, however, I have been using the dreaded phrase more often than I like. I don’t like the word “crisis” because it often gets abused, and although I’m talking about housing here, the same point can be applied to many economic and social problems and solutions.

The Nonexceptionalism Thesis: How Post-9/11 Criminal Justice Measures Fit In Broader Criminal Justice, Francesca Laguardia Oct 2016

The Nonexceptionalism Thesis: How Post-9/11 Criminal Justice Measures Fit In Broader Criminal Justice, Francesca Laguardia

Department of Justice Studies Faculty Scholarship and Creative Works

Contrary to the assumption that ‘‘9/11 changed everything,’’ post-2001 criminal justice practices in the area of terrorism show a surprising consistency with pre-2001 criminal justice practices. This article relies on an analysis of over 300 terrorism prosecutions between 2001 and 2010, as well as twenty full trial transcripts, content-coding, and traditional legal analysis, to show the continuity of criminal justice over this time in regard to some of the most controversial supposed developments. This continuity belies the common assumption that current extreme policies and limitations on the due process are a panicked response to the terror attacks of 2001. On …

The Terror Exception: The Impact Of The 2001 Authorization For Use Of Military Force On United States Counterterrorism Policy In The Middle East Under The Obama Administration, Benjamin Collinger Oct 2016

The Terror Exception: The Impact Of The 2001 Authorization For Use Of Military Force On United States Counterterrorism Policy In The Middle East Under The Obama Administration, Benjamin Collinger

Undergraduate Student Research Awards

In the traumatic and somber aftermath of the September 11, 2001 terrorist attacks, the U.S. Congress passed a critical piece of legislation to provide the president authority to defend the United States and its interests abroad. The Authorization for Use of Military Force (AUMF), which responded to the horrors of 9/11, began the United States’ longest war—the global war on terror— and serves as its legal basis today. President George W. Bush signed the AUMF into law on September 18, 2001, only a week after the attacks. Congress agreed with the proposition:

That the President is authorized to use all …
