From time to time during the five years I have worked with Louis Loss on what will be a 12-volume work on Securities Regulation, I have been asked what treatise writing is like. Normally the question is posed with the unspoken assumption that it must be a little like a serious case of leprosy or perhaps a violation of the 13th Amendment. For example: "Is it horribly depressing?" Or: "How many years do you think it will take?" My interest in the detention of citizens, without trial, in Britain during the war of 1939-1945 arose as a byproduct of a more general interest. The study of cases has long been central to the common law tradition. But the legal dramas we examine so minutely are too often both contextless and dehumanized. Real people assume the masks of the law, becoming plaintiffs and defendants, offerors and offerees, grantors and contingent remainderpersons, concealed from us by the forms into which their problems have been packaged for legal analysis. Reforming The Ncaa Drug-Testing Program To Withstand State Constitutional Scrutiny: An Analysis And Proposal, Thomas P. Simon

Shortly after year-round testing went into effect, the California Court of Appeal held that the NCAA's original drug testing program violated a student-athlete's right of privacy as protected by the California Constitution. This Note examines the impact of that decision and attempts to design a program that will withstand state constitutional scrutiny. Part I describes the current NCAA drug-testing program. Part II looks at the fourth amendment argument against drug testing of student-athletes. Part III assesses the viability of a federal constitutional attack on NCAA testing, while Part IV discusses a state constitutional challenge. Finally, Part V proposes reform of …

Mormons On The Warfront: The Protestant Mormons And Catholic Mormons Of Northern Ireland, Claudia W. Harris

The conflict in Northern Ireland between Catholics and Protestants places Mormons, members of The Church of Jesus Christ of Latter-day Saints, in an impossibly difficult position, being shunned by both sides. Claudia Harris tells of her research in both the Republic of Ireland and Northern Ireland in the 1980s, staying the homes of Mormons and hearing of their experiences. Many Mormons were serving in various security forces and thus were paramilitary targets. Harris tells the stories and explores the cultural mindset of Irish Mormons.

Satire And Science: Some Restoration And Eighteenth-Century Links, Jo Allen Bradham

Linking satire and science evokes the standard response that late seventeenth- and eighteenth-century satirists, individually and practically in chorus, attacked the foolishness and the excess of scientific experimentation, especially that demonstrated by the Royal Society. Satirists, so conventional wisdom holds, argue that the so-called natural philosophers' farfetched projects have nothing to do with the understanding of human beings, the strengthening of a wise society, or the improvement of the moral state. On Being A Republican In Massachusetts: Notes Of A Party Chairman, Andrew Natsios

New England Journal of Public Policy

In the 1970s the Democratic and Republican national and state parties initiated efforts at party renewal in order to reverse their declining institutional power. Between 1980 and 1987 the Massachusetts Republican Party undertook a renewal effort modeled after that of the Republican National Committee under William Brock. This model emphasized the provision to candidates and to the grassroots party organization of campaign sendees such as literature design, polling, direct mail fund-raising, telephone banks, and campaign schools. The Massachusetts Republican Party concentrated these services to candidates for the state legislature, achieving the largest net gain in seats since 1962. Campaign technology …

What goes into the making of a president? To what extent are the mind and character of the American commander in chief determined by his background, his family — and his education? This article represents a transcript of two lectures Nigel Hamilton presented in the spring and fall of 1989 at the Massachusetts State Archives. They were derived from the preliminary sketches for the author's full-scale biography of John F.
