Miller V. Johnson: Drawing The Line On Racial Gerrymandering, Darin R. Doak

By rejecting the Georgia State Legislature's attempt to redraw its political districts to ensure election of black representatives, the Supreme Court in Miller v. Johnson exposed a fallacy that served as the foundation for eighteenth-, nineteenth-, and twentieth-century barriers to minority franchise rights: the idea that minority groups act and vote similarly. Treading lightly through the political thicket of redistricting, the Miller Court eliminated this threat by prohibiting political districts drawn with substantial reliance upon race. This article discusses the merits of the Miller decision and its place in the evolution of minority voting rights. The article also suggests that …

Beginning with a discussion of the United States Supreme Court’s decision in McLaurin v. Oklahoma State Regents for Higher Education, this article discusses the meaning of “integration.” In McLaurin, the University of Oklahoma was forced to abandon its segregation policy and not separate black students from their white classmates in all settings (not just the classroom). The McLaurin decision raised the fundamental questions: "What is integration?" and "How is integration related to racial equality?" Significantly, the McLaurin Court clarifies that equality is premised on integration and that integration means more than just having a presence in an institution. …

Using concepts both from gender studies of literature and from discourse theory, this thesis explores the relationship between race, masculinity, and dialogue in Ernest Gaines's "The Sky is Gray," "Three Men," and A Gathering of Old Men. In these works, Gaines demonstrates that manhood can be achieved by a process of linguistic appropriation. His African-American male characters become men through the utterance, not the violent act. This thesis examines how Gaines's black men appropriate language among distinct groups: themselves, the extended black community, and the white community.

This Article explores some of the difficulties involved in designing genuinely effective and broadly inclusive legal strategies for eliminating women's sexual oppression. Part II.A begins the analysis by using Gary LaFree's empirical studies of rape enforcement practices to develop some observations about the kinds of legal strategies most likely to foster women's sexual autonomy.' LaFree's studies illustrate how the institutional structures and decision making procedures of the criminal justice system create the opportunity for rape processing practices to reproduce relations of race and gender subordination. While the lead title of this book, Re-Situating Identities, is entirely on target, the subtitle, The Politics of Race, Ethnicity, and Culture, is far off the mark. The book is primarily about identity. It has precious little to do with politics. This might be apparent from the contributors, whom the editors identify as sociologists, anthropologists, and cultural theorists. There is not a political scientist among them. The omission, however, is not necessarily indicative of an absence of politics, because sociologists, anthropologists, and cultural theorists often write good politics. This Note examines the intersection of race and gender in the context of sexual harassment jurisprudence. Since the arrival in this country of the first female African slaves, Black women have experienced sexual harassment on the job. This Note discusses the failure of sexual harassment theory to acknowledge the unique sexual harassment experience of Black women. From the very earliest discussions of sexual harassment, the impact of the race of the victim on the experience and resulting legal claim was ignored. Feminist legal theorists, leaders in issues affecting women, have been slow to acknowledge and integrate the role of race …

This paper examines the interrelations of whiteness, gender, class and nationalism as represented in popular media discourses surrounding the coverage of the assault on Olympic ice skater Nancy Kerrigan and the investigation of her rival, Tonya Harding. As with other recent works that have refocused the issue of "race" on whiteness, this essay seeks to unveil the exclusionary social processes in which boundaries are set and marked within the" difference" of whiteness. The concepts of habitus and historicity are used to understand how Tonya Harding became marked as "white trash," and the implications of her "flawed" qualifications are explored. Furthermore, …

The research goal of the following culminating project is to identify the role of non-verbal communication in the maintenance of social stratification based on gender and race in America.

The first chapter seeks to clarify the two main components: social stratification and non-verbal communication. Social stratification is defined and a summary is given of several theories regarding stratification and of how, in various religious, political and social movements, it is a significant factor. In January 1996 a panel of the American Bar Association released a report concluding that "discrimination continues to permeate the structures, practices and attitudes of the legal profession." It has been a long journey in women's efforts to obtain equity in both law schools and in the legal profession generally. This article is composed of two interviews with University of Kentucky College of Law graduates: Norma Boster Adams (’52) and Annette McGee Cunningham (’80).
