Flouting The Law: Does Perceived Injustice Provoke General Non-Compliance?, Janice Nadler

What happens when people's common sense view of justice diverges from the sense of justice they see enshrined in particular legal rules and legal outcomes? In particular, does the perception of one particular law as unjust make people less likely to comply with unrelated laws? This article reports an experiment that empirically tested the Flouting Thesis - the idea that the perceived justice of one law can influence the intention to comply with unrelated laws. Participants who were exposed to laws they perceived as unjust were more willing, as a general matter, to flout unrelated laws, compared to participants exposed …

As the professor on the panel, I feel that I should start by putting our subject into a bit of context. Then I will focus on the criminalization of depictions of imaginary children before saying a few words about the overbreadth of this statute.
By way of context, then, the problem that we are discussing is one that is characteristic of the introduction of new communications technologies.

Learning And Living Difference That Makes A Difference: Postmodern Theory & Multicultural Education, Walter R. Jacobs

The application of postmodern theory to a transformative understanding of multiculturalism can make a difference. Multicentered culture, antiessentialist race consciousness, and political equity—aspects of a transformative multiculturalism put forward in 1996 by Newfield and Gordon—can be juxtaposed with elements of a postmodern theorization of society as a consumer-driven economy saturated with multiple mediated unstable, fragmented, and evolving discourses and cultural interaction. This theoretical construct can be illustrated with research data from college classrooms and specifically an analysis of the television show The X-Files. This analysis shows how a discussion of whiteness creates larger discussion of transformative multiculturalism in which difference …

Gallery Of The Doomed: An Exploration Of Creative Endeavors By The Condemned, Roberta M. Harding

This Article examines creative expressions produced by the death row faction of the incarcerated population. Looking at these works provide insights about what it means to live as a condemned person in our society, and about the people who occupy the death rows across our nation. After reviewing and analyzing a substantial amount of the enormous body of work of this genre, it became apparent that the condemned's creative endeavors reflect how they address and handle serious issues such as their executions and the ways spirituality influences their life.
