This paper discusses software patents’ unique attributes, challenges in trying to address problems with software patents, and some ideas for fixing the problems with software patents. It was written in connection with a November 2012 conference at Santa Clara University School of Law entitled “Solutions to the Software Patent Problem,” and the initial version of this paper was published in three posts at the Tertium Quid blog at Forbes.

On October 26, 2012, the University of Akron School of Law’s Center for Intellectual Property and Technology hosted its Sixth Annual IP Scholars Forum. In attendance were thirteen legal scholars with expertise and an interest in IP and public health who met to discuss problems and potential solutions at the intersection of these fields. This report summarizes this discussion by describing the problems raised, areas of agreement and disagreement between the participants, suggestions and solutions made by participants and the subsequent evaluations of these suggestions and solutions. Debates about patent policy often focus on the potential for the threat of a court-imposed remedy for patent infringement to cause manufacturing entities and others to suffer patent holdup, especially when standardized industries are involved. This article uses lessons from the broader economics and political science literatures on holdup to explore various approaches to setting remedies for patent infringement—namely injunctions and money damages in the form of lost profits or reasonable royalties—with an eye towards the nature and extent of various forms of holdup they each might generate. Social Networks, Individual Orientations, And Employee Innovation Outcomes: A Multi-Theoretical Perspective, Travis J. Grosser

I examine individual innovation in organizations from a social network perspective. I employ two theoretical lenses to examine innovation outcomes in three separate empirical studies. First, I use a sociopolitical framework to examine how political skill and social network structure interact to predict successful innovation initiation and, ultimately, career success. I find that innovation initiation mediates the relationship between political skill and career success. Moreover, structural holes in employees’ social networks moderate the mediated relationship between political skill and career success such that the relationship is stronger for employees with many structural holes in their social network. This case study dissertation examines the implementation of digital technology in a mid-sized public school district in southern Minnesota. The methodology involved unstructured interviews and close observation of several teachers, administrators and related staff in the junior-senior high building. These observations were presented in informative vignettes that help to tell the story of the culture of innovation in this school, as well as highlight some of the implementation strategies that aid this school and district in meeting its goal to meet all learners in a 21st century society. Industry reports that benefits of PLM are difficult to assess because the same benefit can be expressed as a function of time, cost, quality, or any combination. Based on a review of the PLM literature in an earlier study, a PLM Process Model and an initial list of PLM related metrics was generated and later confirmed through interviews with experienced PLM users. The purpose of this study was to examine the perceptions of South Carolina public school superintendents regarding individual and organizational attitudes toward innovation. Specific characteristics of South Carolina public school superintendents and public school districts, including enrollment, poverty level, school report card grades, age, gender, and years of experience, were analyzed to determine individual superintendents' and their school districts' orientations toward innovation. Bringing innovation to the marketplace for new products and services involves creativity, a culture in which change flourishes, and leadership that thrives on transformation and complexity. This study explored the potential for market disruption or change based on innovations involving patents granted to nonfinancial services organizations that could affect financial services, specifically consumer or retail bank products. It involved analyzing documents related to recently granted patents and completing a mixed methods survey integrating the Delphi research technique. This Article presents the first in a series of studies of stock market reactions to the legal outcomes of patent cases. From a sample of patents litigated during a 20-year period, we estimate market reactions to patent litigation decisions and to patent grants. These estimates reveal that the resolution of legal uncertainty over patent validity and patent infringement is, on average, worth as much to a firm as is the initial grant of the patent right. Each is worth about 1.0-1.5% excess returns on investment. There are significant differences between such market reactions before and after the establishment in 1982 …

This case study surveyed faculty members and information technology (IT) leaders within the State System of Higher Education (SSHE) and at Southern Regional State University (SRSU) to examine their perceptions of technological innovation, adoption, and diffusion in higher education. The data gathered identified seventeen critical success factors affecting technological innovation, adoption, and diffusion and was used to evaluate how the perceptions faculty compared to those of IT leaders within a single university setting. The translation of advances in clinical research into clinical practice in a manner that provides benefits while reducing potential harm is a challenge within the health care delivery system. Data from a phase III multicenter clinical trial led to the 2012 US Food and Drug Administration (FDA) approval of a 90-minute infusion of rituximab (Rituxan) starting at Cycle 2 for patients with non-Hodgkin’s lymphoma who did not experience a Grade 3 or 4 infusion-related adverse event during Cycle 1. Using the value chain model which provides a process view, this longitudinal case study and simulation modeling analysis of a Canadian third-party logistics (TPL) supply chain provides some empirical support for the enabling role of RFID technology in effecting warehouse process innovation and optimization for the focal TPL firm. However, the findings of our study also reveal the RFID technology implementation costs as the key inhibitor of RFID widespread adoption and usage among suppliers. This, in turn, precluded the focal TPL firm from implementing the best optimum RFID solution to create better business value from the RFID project.
