Barriers To And Facilitators Of Care: Exploring How Low-Income Women Access Reproductive Healthcare In A Rural Community, Sydney Taylor Casey
Electronic Theses, Projects, and Dissertations
The purpose of this research study was to gain a comprehensive understanding of the experiences of low-income women living in a rural community when accessing reproductive care and bring awareness to the barriers and facilitating factors they encounter. The present study adopted a post positivism paradigm and was conducted in a rural county in Northern California. A combination of quantitative and qualitative data was gathered through demographic surveys and individual interviews with twenty-two participants. A bottom-up approach was utilized for the phases of qualitative data analysis, which included open coding, axial coding and selective coding. Data analysis revealed thirteen open …
Preempting Private Prisons, Christopher Matthew Burgess
Preempting Private Prisons, Christopher Matthew Burgess
Washington Law Review
In 2019 and 2021, respectively, California and Washington enacted laws banning the operation of private prisons within each state, including those operated by private companies in contracts with the federal government. Nevertheless, the federal government continues to contract with private prisons through Immigrations and Customs Enforcement for the detention of non-United States citizens. In 2022, the Ninth Circuit Court of Appeals held in GEO Group, Inc. v. Newsom that federal immigration law preempted California’s private prison ban.
Preemption—when federal law supersedes state law—is a doctrinal thicket. Federal courts analyze preemption issues in multiple different ways in a particular case, often …
The Black Arts And Black Power Movements In The Artwork Of John T. Riddle, Jr., Isabella Vitti
The Black Arts And Black Power Movements In The Artwork Of John T. Riddle, Jr., Isabella Vitti
Theses and Dissertations
This thesis examines the under-studied work of the Black sculptor John T. Riddle, Jr. and how he was influenced by the politics of Los Angeles in the 1960s and 1970s. Police brutality, the Vietnam War, the Black Power Movement, and the Watts uprising had a major impact on Riddle’s work.
Improving Minors' Access To Treatment For Opioid Use Disorder: A Policy Analysis, Sara Jane Hamilton
Improving Minors' Access To Treatment For Opioid Use Disorder: A Policy Analysis, Sara Jane Hamilton
Master's Projects and Capstones
As the opioid epidemic continues to have devastating effects on our communities, medications to treat opioid use disorder (MOUDs) are severely underutilized especially for adolescents. Unlike adults, minors need parental approval before obtaining MOUDs presenting a key barrier to timely treatment. Being able to treat adolescents as soon as they are ready is critically important for people with OUD, and while cost and other barriers have been addressed in the literature, there is a paucity on how parental consent affects the accessibility of treatment. This paper aims to explore a potential policy in California that addresses the lack of access …
The Health Impacts Of The Trump Administration Among California Immigrants, Claudia M. Calhoon
The Health Impacts Of The Trump Administration Among California Immigrants, Claudia M. Calhoon
Dissertations and Theses
Immigration policy was a marquee issue in the US presidential administration of Donald Trump. Trump’s administration employed both policy and rhetoric related to immigrants to mobilize voters, alter immigration policies and practices, and sustain a narrative of a nation under attack by immigrants. Administration officials were able to undertake these approaches because of existing immigration law, but they did so in more explicitly punitive ways than in recent administrations. The goal of this dissertation is to explore the health impacts of the administration’s practices and their effects. Paper 1 analyzes the immigration rhetoric and policies of US president Donald Trump …

The Effect Of Ethnic Studies On White Student Populations, Kelly Coffey
The Effect Of Ethnic Studies On White Student Populations, Kelly Coffey
Education | Master's Theses
The effect of Ethnic Studies courses have shown to impact People of Color in a positive way academically, socially, and emotionally (Cabrera et al., 2014; Cammarota & Romero, 2009; Dee & Penner, 2017), however, for White students the effect is less clear. Often there are feelings of guilt, shame, and embarrassment for White students when confronted with the exposure to the individual and systemic oppression of People of Color by White colonialism and much of this oppression still resonates today (Sleeter & Zavala, 2020). Research also shows that there could be a link between Ethnic Studies coursework and anti-racist behavior …
Voter Influencing In State Trial Court Judicial Elections In Los Angeles, San Francisco, And Houston, Myanna Dellinger
Voter Influencing In State Trial Court Judicial Elections In Los Angeles, San Francisco, And Houston, Myanna Dellinger
Dissertations and Theses
This dissertation examines select key factors that influence voter choices in state trial court judicial elections in three large, cosmopolitan counties in California and Texas. These include ballot designations (i.e., professional titles of candidates), “evaluations” of candidates by local bar associations, newspaper endorsements, political party affiliation, and gender. Focus here is on ballot designations and local bar association evaluations; the subjective opinions issued by local bar associations as official-sounding, objective and qualitative evaluations. In turn, local bar associations are private, voluntary associations consisting of fee-paying members and not overseeing state bar associations as many laypeople believe. Judicial elections remain low-information, …
Deportations For Drug Convictions In The United States And The European Union: Creating A More Compassionate Approach Toward Drug Convictions In The Immigration Law, Megan Smith
San Diego International Law Journal
This Comment begins by examining and comparing the legal framework for deportation and other immigration consequences for convictions of drug offenses in the United States, the European Union, and the United Kingdom. This Comment then looks at the harsh effects of current immigration policy on individuals and marginalized communities. Finally, this Comment argues that immigration law should be reformed to adopt a more humanitarian approach toward non-citizens convicted of drug offenses. Deportation and other harsh immigration consequences for drug offenses levy disproportionately severe punishments toward vulnerable minority immigrant communities, exposing them to consequences much harsher than non-immigrants would face for …

Formal And Informal Labeling Of Adolescents: The Consequences Of Cumulative Disadvantage On Deviance During Emerging Adulthood, Chijioke Onyekonwu
Electronic Theses, Projects, and Dissertations
Despite the recent developments in labeling theory, there are still a lot of gaps in research on this theory. To begin with, studies continue to attach too much attention to the effects of formal labeling to the neglect of informal labeling. Secondly, prior research has not paid full attention to a variety of mediating factors involved in the relationship between informal labeling, formal labeling and delinquency.
This study seeks to address these limitations by investigating the overall effects that formal and informal labeling has on young people while considering the differential impact of mediating variables. The data for the study …
Frequency Of Marijuana Use By California University Students Based On Gender And Ethnicity: A Quantitative Analysis, Evelyn Lorraine Anderson
Frequency Of Marijuana Use By California University Students Based On Gender And Ethnicity: A Quantitative Analysis, Evelyn Lorraine Anderson
Doctoral Dissertations and Projects
The purpose of this quantitative causal-comparative study was to determine the frequency of marijuana use by California university students based on gender and ethnicity. This study was important because marijuana is the most used illicit substance in the United States, and there is limited research regarding the demographic characteristics of California university students who use marijuana. The quantitative research design was used to describe the patterns of marijuana use by California university students. The setting was online. The participants included a random sample of 167 college students from five California state universities. The Daily Sessions, Frequency, Age of Onset, and …

The Correlation Between Laura’S Law And The Incarceration Of The Mentally Ill In A Southwestern State, Aaron Alarcon-Bowen
The Correlation Between Laura’S Law And The Incarceration Of The Mentally Ill In A Southwestern State, Aaron Alarcon-Bowen
Walden Dissertations and Doctoral Studies
Assisted outpatient treatment and involuntary outpatient treatment laws refer to the power of the court system to order community-based treatment without hospitalization to individuals with a mental illness diagnosis. Studies have linked these laws to a decrease in the use of incarceration among this population. The effectiveness of the assisted outpatient treatment law in a Southwestern state, known as Laura’s Law, has not been studied. With a theoretical foundation based on the social contract and multiple streams analysis theories, a quantitative, casual, comparative study using an independent t test was centered on determining whether the mean numbers of incarcerated individuals …
Task Force Rattlesnake: A Cost Analysis Of Fire Crew Base Pay In California, Galen R. Yusufzai-Boggs
Task Force Rattlesnake: A Cost Analysis Of Fire Crew Base Pay In California, Galen R. Yusufzai-Boggs
Master's Projects
Wildfire management in California is an expensive program totaling over $3 billion in 2020, where the state provides two-thirds of the budget from the general fund (Peters et al., 2020). California has consistently used the state military to assist in wildland fire mitigation efforts; however, for the first time it has created a year-round team to reduce fuels to clean up the state’s forests. Further analysis would determine if Task Force Rattlesnake is an effective use of the state’s budget for wildfire mitigation.

The perceived high unemployment rates of certain majors due to circulating misinformation presents a need for comprehensive research on college majors and their associated unemployment rate. This paper dives into a ten year trend of unemployment rates by college major, and state to state variabilities of majors and their rates.
Tax Evasion And Illicit Cigarettes In California: Prevalence And Demand-Side Correlates, James Prieger
Tax Evasion And Illicit Cigarettes In California: Prevalence And Demand-Side Correlates, James Prieger
School of Public Policy Working Papers
Unlike some areas of crime, participation in illicit tobacco markets is not rare and spans most sociodemographic groups. Measurement of the scale of illicit trade in cigarettes usually are for markets with recently increased (or continually increasing) excise taxes. This study examines survey data from adult cigarette smokers in California at a time when prices and taxes had been fairly stable for many years. Even with no recent price shocks in the market, the results indicate that one-third of cigarette packs may lack a valid tax stamp and that between 18% to 25% of smokers avoided taxes by bringing cigarettes …
Biometric Data Regulation And The Right Of Publicity: A Path To Regaining Autonomy Over Our Commodified Identity, Lisa Raimondi
Biometric Data Regulation And The Right Of Publicity: A Path To Regaining Autonomy Over Our Commodified Identity, Lisa Raimondi
University of Massachusetts Law Review
This Note explores how a right of publicity action might be used to address present day concerns regarding biometric data ownership rights where an individual’s likeness can essentially be bought and sold. As social networking and use of the internet has grown, so has the opportunity for people to engage with others and share their lives. However, that opportunity also comes with risk. More and more, people are required to accept the terms of use and privacy policies detailing how their biometric data will be collected and stored if they want to download and use certain technological applications. Most of …

California’S Prisoner Rehabilitation Effort: Ex-Lifers’ Perceptions On Achieving Sustainable Social Reintegration, Kimberly L. Martin
California’S Prisoner Rehabilitation Effort: Ex-Lifers’ Perceptions On Achieving Sustainable Social Reintegration, Kimberly L. Martin
Walden Dissertations and Doctoral Studies
Prisoners sentenced to a life term in California’s state prisons are being found suitable for parole at record-high rates. Although macro-level policy guides California’s prisoner rehabilitation process, a specific policy does not exist to guide the rehabilitation of the lifer population. Research shows a compelling relationship between public safety resulting from reduced recidivism and an inmate’s participation in rehabilitative programming during incarceration. There is a gap in the literature about ex-lifers and their ability to achieve sustainable social reintegration upon release from incarceration. Ostrom’s institutional analysis and development framework guided this study’s examination of the gap in literature and the …

Accounting For Adolescents’ Twice Diminished Culpability In California’S Felony Murder Rule, Raychel Teasdale
Accounting For Adolescents’ Twice Diminished Culpability In California’S Felony Murder Rule, Raychel Teasdale
Loyola of Los Angeles Law Review
In 2018, the California legislature passed S.B. 1437 to narrow California’s felony murder rule and theoretically apply the rule only to those with the greatest culpability in a murder. However, whether intentionally or negligently, the law leaves room to disproportionally and unjustly affect adolescents by charging those with “reckless indifference” with first-degree murder. Imbedded in psychology and neuroscience research is the conclusion that adolescent brain structure and function are still rapidly developing. As a result, adolescents are less able to weigh the risks of their actions, resist peer pressure, regulate their emotions, and control their impulses. Therefore, this Note argues …
The Future Of Bail In California: Analyzing Sb 10 Through The Prism Of Past Reforms, Adam Peterson
The Future Of Bail In California: Analyzing Sb 10 Through The Prism Of Past Reforms, Adam Peterson
Loyola of Los Angeles Law Review
The cash bail system is the cause of numerous injustices. It favors the rich over the poor, it packs jails to the breaking point, and it forces those who have yet to be found guilty to sit in jail—often for weeks or months at a time. In 2018, the California legislature passed SB 10. The bill purported to abolish cash bail wholesale and replace it with a risk assessment program. While SB 10 is a step in the right direction, it faces many obstacles before it accomplishes its goal. This Note examines the bill in light of past attempts at …

Navigating The Shadows: Intersecting The Undocumented And Undocuqueer Identities, Iriana Balbian
Electronic Theses, Projects, and Dissertations
This project analyzes the navigation of social experiences of Undocumented and Queer individuals amidst broad anti-queer and anti-immigration sentiment prevalent throughout American society. To achieve this goal, this project seeks to resolve three questions. First, what are the social services that Undocuqueer and Undocumented adults need? Second, are their needs fundamentally distinct? Finally, to what extent have they been able to access those services? Crenshaw’s (1994) theory of intersectionality will serve as the overarching theoretical framework of this project, in order to better understand the multifaceted marginalization that Undocumented and Undocuqueer individuals face with everyday institutions.
In this research, I …

Burning A Hole In The Pocket Of Justice: Prop. 66'S Underfunded Attempt To Fix California's Death Penalty, Flavia Costea
Loyola of Los Angeles Law Review
California has struggled with the administrative and financial burdens of a flawed death penalty system for decades. In an effort to save the death penalty, the voters of California enacted Proposition 66, which promised to deliver a quicker and more cost-effective system. This Article focuses on the provision of Prop. 66 that expands the number of lawyers who can act as defense lawyers for inmates on death row. While this provision superficially seems to solve the shortage of defense attorneys willing to take on death penalty cases, without significant funding, the shortage of resources and pressure to speed up executions …

The Trump administration has taken a firm stance against marijuana legalization at the state level. While an official federal policy is still pending, this Article focuses on whether the Trump administration’s threats to preventCalifornia from pursuing its duly enacted marijuana legalization law violates the Tenth Amendment. This Article then addresses how the federal government could achieve its goal while remaining within the bounds of the Constitution.
What's Going Wrong In Nevada? A Comparative Analysis Of California And Nevada Gun Control Laws As They Relate To Gun Violence, Danielle Chami
What's Going Wrong In Nevada? A Comparative Analysis Of California And Nevada Gun Control Laws As They Relate To Gun Violence, Danielle Chami
CMC Senior Theses
The recent mass shooting on October 1, 2017 in Las Vegas, Nevada has been marked in history as the worst mass shooting in the United States to this point. The details of the shooting beg the question, is it coincidence that it happened in Nevada, a state with some of the least restrictive gun control laws? Mass shootings have become an unfortunate part of reality in the United States, but these are fairly uncommon occurrences. While they are horrific and deserve attention, daily gun violence cannot be forgotten. In the face of such a multitude of gun violence, what can …
Ethical Cannabis Lawyering In California, Francis J. Mootz Iii
Ethical Cannabis Lawyering In California, Francis J. Mootz Iii
St. Mary's Journal on Legal Malpractice & Ethics
Cannabis has a long history in the United States. Originally, doctors and pharmacists used cannabis for a variety of purposes. After the Mexican Revolution led to widespread migration from Mexico to the United States, many Americans responded by associating this influx of foreigners with the use of cannabis, and thereby racializing and stigmatizing the drug. After the collapse of prohibition, the federal government repurposed its enormous enforcement bureaucracy to address the perceived problem of cannabis, despite the opposition of the American Medical Association to this new prohibition. Ultimately, both the states and the federal government classified cannabis as a dangerous …

Legal Deserts: A Multi-State Perspective On Rural Access To Justice (Forthcoming), Danielle M. Conway
Faculty Publications
Rural America faces an increasingly dire access to justice crisis, which serves to exacerbate the already disproportionate share of social problems afflicting rural areas. One critical aspect of that crisis is the dearth of information and research regarding the extent of the problem and its impacts. This article begins to address that gap by providing surveys of rural access to justice in six geographically, demographically, and economically varied states: California, Georgia, Maine, Minnesota, South Dakota, and Wisconsin. In addition to providing insights about the distinct rural challenges confronting each of these states, the legal resources available, and existing policy responses, …
