Survivors Of Sexual Assault On The Stand: A New Feminist And Victim-Centered Bioethical Framework To Discuss Justice And Trauma, Mathilde Genest

This essay argues that neuroscientific knowledge of trauma should be utilized to address injustices experienced by survivors of sexual assault (SA) in the courtroom and introduces a new feminist and victim-centered bioethical framework. Survivors face several injustices during a SA trial. Rape myths and victim stereotypes, which stem from gender discrimination, create unrealistic expectations for survivors’ behaviors and engender epistemic injustices. Other injustices are inherent to SA trials. Notably, the justice system fails to protect survivors and actually harms them by granting them little agency while risking secondary victimization. Issuing citations in lieu of arrests, or field booking arrests, is touted as beneficial by reducing the costs for the criminal legal system; reducing the burdens placed on individuals by avoiding arrest records, possible pretrial detention, and financial obligations; bettering community relationships with officers; increasing officer safety and efficiency; and reducing jail overcrowding. Yet, there are still substantial concerns that the practice may be disproportionately utilized and lead to net-widening. Responses to harm and crime in the United States typically utilize the criminal legal system’s retributive approach, which often contributes to cycles of harm rather than facilitating healing (Davis, 2019; Lenzen & Stahler, 2020). In response, alternative responses to harm like transformative and restorative justice are growing in popularity (Fileborn & Vera-Gray, 2017). These approaches to justice are often conflated, but rarely compared (Nocella & Anthony, 2011). First, a systematic literature review of transformative and restorative justice utilizing a qualitative content analysis (QCA) identified the two interventions' definitions, comparisons, and perceived attitudinal outcomes. The stigma of corrections being labeled as a “male” workplace is a factor in the male/female ratio gap; thus, the new question is how to bridge the gender gap. In response to this human resource managers have implemented affirmative action strategies to ensure more females were being hired and promoted in corrections. Though unofficial in most areas, some state correctional agencies incorporated “quotas” in their affirmative action HRMS. The article discusses the failures of the American justice system to find and punish offenders for the majority of serious crimes. It highlight the low clearance and conviction rates for crimes such as murder, rape, and assault. It further argues that these failures of justice have practical consequences on crime rates and also disproportionately affect racial minorities and low-income communities.

In Ellisville, Mississippi, some heroes do not wear capes. The Jones County Drug Court, located in rural Mississippi, fights drug and alcohol addiction daily. This drug court program, led by the tough but compassionate Consuelo Walley, supervises about 70 to 90 participants in their recovery journey. In recent years, this program has grown to be known as one of the most efficient in its region, and I made it my mission to uncover why that is. It turns out staff members are themselves recovering addicts, who utilize their own experience as a way to connect and relate to their participants. …

The Russian Federation's full-scale military invasion of Ukraine on February 24, 2022, has been marked by numerous documented atrocities, potentially falling under the categories of war crimes and crimes against humanity. This thesis aims to explore whether these apparent human rights and humanitarian law violations merit international prosecution. It also assesses the suitability and feasibility of various mechanisms, such as establishing national courts, "internationalized" or "hybrid" tribunals, or resorting to the International Criminal Court (ICC), drawing insights from past experiences in transitional and retributive justice.

AbstractThe purpose of this transcendental phenomenological research was to describe the lived experiences of investigative civilian review board (CRB) members. The central research question of the study examined the lived experiences of investigative civilian review board members as it related to recruitment and selection, training, and support. Eight participants from two CRBs in the Northeast and Midwest formed a random sample of six females and two males. Three data collection instruments were used in this research (in-depth interviews, writing prompts, and personal narratives) to elicit information.
