Is A Ban On Non-Competes Supported By Empirical Evidence?, Sarah Oh Lam, Thomas Lenard, Scott Wallsten

Fordham Journal of Corporate & Financial Law

The U.S. Federal Trade Commission (FTC) has proposed a rule to declare virtually all non-compete agreements unfair methods of competition under Section 5 of the FTC Act and therefore, illegal. However, the empirical literature on non-compete agreements cited by the FTC in its Notice for Proposed Rulemaking (“NPRM”) shows mixed results on earnings, job creation, firm formation, entrepreneurship, training, investment, and firm value. Evidence in other current studies also does not support an economy-wide ban. The FTC concludes that the proposed rule would yield net benefits even though by its own admission it lacks the information necessary to conduct a …

All entrepreneurs seek favorable legal or regulatory treatment for their businesses. Sometimes this leads an entrepreneur to build a business within a gap in the law—a loophole. In so doing, these “loophole entrepreneurs” may avoid steep regulatory compliance costs that otherwise would beset (or perhaps prohibit) their businesses, thereby gaining advantages over competitors. Despite these benefits, loophole entrepreneurship is fraught with risks. Loopholes, by nature, are fragile, and their contours are often uncertain. Moreover, the stigma of “exploiting a loophole” (which connotes unfairness or deception) can provoke ill will among competitors, policymakers, and the public.

The study investigated entrepreneurship education skills acquisition for self- employment among librarians and library educators in universities in South East, Nigeria. The study guided by five objectives, adopted descriptive survey design with a study population of 149 librarians and library educators from five (5) university-based Library and Information Science schools in South East, Nigeria. This dissertation research identifies the factors that affect self-employment in a three-essay format. Essay one builds a foundation on analyzing the determinants that affect self-employment in the United States through a country-level time-series analysis. Essay two includes a time-series panel analysis and comparative analysis between the United States and United Kingdom by expanding on Meager’s (1992) study of the relationship between unemployment and self-employment. This analysis focuses on the United Kingdom, an outlier in Meager’s (1992) study, which included a structural change to the motivation to enter self-employment after an economic shock in the late 1970s. This research paper proposes a novel methodology for evaluating entrepreneurial activity among engineering education alumni using their public CVs as our main source of information. The objective is to go beyond measuring entrepreneurship intentions or mindset through surveys, and instead analyse actual career data to assess the impact of entrepreneurship education. The study utilises shared user data and employs GPT (Generative Pretrained Transformer) models to infer entrepreneurial activity that extends beyond job titles, delving into the specific responsibilities and achievements associated with each position.

For nearly forty years, scholars have conceptualized the business lawyer as a “transaction cost engineer” who helps contracting parties efficiently break negotiation stalemates to create more valuable deals. This study adds to the current body of research on economic growth by demonstrating how the interplay between financial development and entrepreneurship fosters economic advancement. By utilizing the two-step Generalized Moment Method (GMM), we have identified three primary outcomes. Firstly, entrepreneurship has a beneficial influence on economic growth. Secondly, financial development has a conditional effect that stimulates economic growth. Lastly, the combined effect of entrepreneurship and financial development on economic growth is largely positive, suggesting that financial development can amplify the already positive but weak entrepreneurship’s influence on economic growth. Crowdfunding is an increasingly popular method for entrepreneurial ventures to raise financing from a large number of small supporters (the “crowd”) instead of raising it through a small number of larger supporters.
