Political Public Relations As A Tool For Combating Vote Buying In Nigeria For Development Purposes, Jacob Gbaden Chiakaan, Chamberlain Chinsom Egbulefu, Wombu Richard Kpera, Pius Kwapsoni Kaigama
ASEAN Journal of Community Engagement
The main aim of the study is to identify political public relations approaches that can be applied by the government and other bodies responsible for conducting elections in Nigeria to mitigate and eliminate vote buying. The study adopted a qualitative approach in the contextual analysis of data collected specifically from secondary sources. The results revealed that vote buying has become synonymous with elections in Nigeria. After reviewing some related empirical studies, several factors responsible for vote buying in Nigeria have been identified, including poverty, lack of education, high cost of buying forms to contest elections, and many others. Moreover, where …

Indonesian Notary
Notary is an authorized Public Officer who is under supervision to carry out their position as a noble, integrous and professional notary. With regard to conducting criminal offense, a notary could be accounted for the deed that they make, based on what they see, what they witness and what they experience in a legal act. In this discussion, a notary often repeats a mistake, and upon their violation, a Notary is bound to be accounted for the mistake. Thus, the research is concerning with the responsibility of a notary who has made a violation that causes a loss to other …

Struggle For Substantive Justice And Community Development: Transgender Subjects In Contemporary India, Pushpesh Kumar
ASEAN Journal of Community Engagement
This paper discusses the transgender community's fight for justice and developmental rights since 2014 and the response of the Indian Government toward this assertion. The point of choosing 2014 as the starting point is not because the fight for their justice actually begins in this year but because India witnessed an intensification and an increase in public visibility of transgenders’ mobilization following the recognition of members of transgender communities as legal citizens through the landmark Indian Supreme Court (Court) verdict called the National Legal Services Authority Union of India (NALSA). In documenting transgenders’ mobilization and the state's response, the author …
Beyond "Bad" Cops: Historicizing And Resisting Surveillance Culture In Universities, Amy J. Wan, Lindsey Albracht
Beyond "Bad" Cops: Historicizing And Resisting Surveillance Culture In Universities, Amy J. Wan, Lindsey Albracht
Publications and Research
In this article, we define and examine surveillance culture within US college classrooms, a logical extension of pervasive carceral and capitalist logics that underlie the US educational system, in which individual success is tied to behavior monitoring, rule following, and sorting, particularly within marginalized student populations. Reflecting anxieties about the expansion of educational access, we argue for how crisis and change have historically contributed to the
urgency and opportunity to expand surveillance culture and consider why this has continued to happen as a result of the COVID-19 crisis. We offer suggestions and alternatives to surveillance culture that have helped us …
State Securities Enforcement, Andrew K. Jennings
State Securities Enforcement, Andrew K. Jennings
BYU Law Review
Each year, state securities regulators bring over twice the enforcement actions brought by the Securities and Exchange Commission, yet their work is largely missing from the literature. This Article provides an institutional account of state securities enforcement and identifies two key advantages — detection granularity and institutional decentralization — that states enjoy over their federal counterparts in policing localized frauds involving individual, often small-dollar, victims. Although states share enforcement jurisdiction with the SEC and DOJ, their enforcement activity reflects their institutional advantages and constraints and thus largely does not overlap with that of federal authorities. Instead, states serve as the …

Aceh's Special Autonomy In The Perspective Of Asymmetric Decentralization Policies, Suharno Suharno
Aceh's Special Autonomy In The Perspective Of Asymmetric Decentralization Policies, Suharno Suharno
Jurnal Civics: Media Kajian Kewarganegaraan
This paper aims to reveal the implementation of autonomy in Aceh by using descriptive research methods through literature review. Based on the analysis of the literature sources, it can be found that the policy of regulation and division of territory as well as the pattern of relations between the Central Government and Regional Governments at the beginning of independence were pragmatic and tended to generalize, this could lead to armed conflicts such as in Aceh. Thus, an asymmetric decentralization policy is needed so that it can meet the demands of the Acehnese people, which historically, geographically, and socio-religiously have their …

Corruption In University Admissions And The Administrative Allocation Of Scarce Goods, L. Burke Files, Roger E. Meiners, Andrew P. Morriss
Corruption In University Admissions And The Administrative Allocation Of Scarce Goods, L. Burke Files, Roger E. Meiners, Andrew P. Morriss
BYU Law Review
The Varsity Blues investigation uncovered a seamy side of university admissions. Multiple wealthy parents were indicted for securing their children s admission to selective institutions through bribery. Despite the publicity the indictments and guilty pleas received, and the public schadenfreude over the sight of celebrities being arrested, the investigation is most notable for what it did not do: it did not deploy the federal government's arsenal of anti-money laundering and anti-corruption tools against the universities involved. This represents a significant missed opportunity to address the serious problems that arise from rationing access to selective institutions via opaque, easily manipulated admissions …
The Process And Role Of The Judiciary In Election Administration Dispute Resolution In Indonesia, Eny Kusadarini, Anang Priyanto, Sri Hartini
The Process And Role Of The Judiciary In Election Administration Dispute Resolution In Indonesia, Eny Kusadarini, Anang Priyanto, Sri Hartini
Jurnal Civics: Media Kajian Kewarganegaraan
Election administrative violations occur at the time of the implementation of the general election by election organizers and contestants. Sometimes, they do not realize that they have committed a violation. Since the general election during the reformation period after the fall of the New Order in Indonesia, there have been frequent violations of election administration resolved through administrative courts through the State Administrative Court. The dispute resolution was carried out after complaints were made through Bawaslu and DKPP as administrative dispute resolution (ADR) institutions and did not bring results. This administrative violation is considered detrimental to the candidate contesting the …

American Surrogacy: Babies For Sale?, Madison Edwards
American Surrogacy: Babies For Sale?, Madison Edwards
Honors Projects
More surrogacy contracts are fulfilled in the United States than in any other country (Bromfield, 2016, p. 193). In 2014, there were approximately 2,000 surrogacy arrangements in the U.S., yet the market is totally unregulated (Shellnutt and Grizzle, 2018, p. 31). Given that 1 in 6 American couples face infertility, there will continue to be a demand for alternative and assisted reproductive options (Shellnutt and Grizzle, 2018, p. 34). This paper seeks to explore several areas of surrogacy, including contract enforcement, potential problems parties in surrogacy agreements face, current legislation, the role of religion in surrogacy, and specific case studies. …
Forming A More Perfect Honor System: Why The Trend Of Over-Legalizing Academic Honor Codes Must Be Reversed, Christopher M. Hartley
Forming A More Perfect Honor System: Why The Trend Of Over-Legalizing Academic Honor Codes Must Be Reversed, Christopher M. Hartley
Catholic University Law Review
Legal processes dominate many honor systems at schools and universities. The negative impacts of this legal saturation include time-consuming, overly burdensome, and seldom understood honor systems as well as a shift of student focus from compliance with honor codes to a fixation on exoneration, given the increased opportunity for fighting and defeating honor allegations using legal recourses. This article is a clarion call for higher education immediate action: schools must scrutinize their honor systems to ensure they are legally efficient, not legally saturated. Authors of books and law journal articles have meticulously reviewed the academic honor system history and legal …

But We Didn’T Agree To That!: Why Class Proceedings Should Not Be Implied From Silent Or Ambiguous Arbitration Clauses After Lamps Plus, Inc. V. Varela, Andrea Demelo Laprade
Catholic University Law Review
The application of class arbitrability when a contract is silent on the matter remains a mystery. The Supreme Court has not clarified its stance on class arbitrability and preemptive effects of the Federal Arbitration Act on state law when applied to determine if class arbitrability is available. The purpose of this Paper is to address how the Lamps Plus v. Varela decision created more confusion about the question of class arbitrability. It argues that the failure to address the particulars of the availability of class arbitration will perpetuate litigation on this issue. This Paper suggests that the FAA’s purpose supports …
Acknowledgment Of Culture And Stereotypes: Black Participants’ Perceptions Of Specific Therapist Behaviors, Tsotso T. Ablorh
Acknowledgment Of Culture And Stereotypes: Black Participants’ Perceptions Of Specific Therapist Behaviors, Tsotso T. Ablorh
Graduate Masters Theses
Mental health disparities for Black people of diverse ethnicities compared to people of other racial identities has been well-documented (Alegría et al., 2008; Maura & Weisman de Mamani, 2017). Research addressing this pervasive systemic and interpersonal problem often focuses on client-related factors that create or intensify barriers to care. However clinician-related factors (i.e., racial identity, multicultural training, implicit biases, behavior, etc.) also have a significant impact on barriers to care, retention in therapy, and clinical outcomes for people of African descent (Larrison & Schoppelrey, 2011; Owen, Imel, Adelson, & Rodolfa, 2012). Researchers suggest that the favoring of historically white perspectives, …
Relational Enforcement Of Stock Exchange Rules, Geeyoung Min, Kwon-Yong Jin
Relational Enforcement Of Stock Exchange Rules, Geeyoung Min, Kwon-Yong Jin
BYU Law Review
Stock exchanges, as regulating entities supervised by the Securities and Exchange Commission (SEC), have wielded their rulemaking power on various corporate governance issues, ranging from the independent board committee requirement adopted in 2003 to the board diversity requirement approved in 2021. Simultaneously, as for-profit corporate entities, major stock exchanges have been competing against each other to attract and retain more companies. This dual status of stock exchanges — as regulators and as profit driven entities — brings into question the stock exchanges' incentive to enforce their own rules against listed companies. What happens if a listed company violates stock exchange …

Advocating The Temporary Rights To Work For Refugees And Asylum Seekers In Transit In Indonesia, Marupa Hasudungan Sianturi, Nino Viartasiwi
Indonesia Law Review
Refugees and asylum seekers are stuck in three to unknown years of protracted transit in Indonesia in their route to reach a destination country. The status of foreign refugees and asylum seekers has deprived them access to basic human needs such as the right to earn a living, education, and healthcare service. This study focuses on the issue of the prohibition to work for refugees and asylum seekers by reviewing the law and regulation concerning refugee protection, rights to work for foreigners, and fundamental human rights. In addition, a review of international norms and conventions on human rights, as well …
Legal Introspection Towards The Development Of Right To Privacy As Fundamental Right In India, Payal Thaorey
Legal Introspection Towards The Development Of Right To Privacy As Fundamental Right In India, Payal Thaorey
Indonesia Law Review
Privacy of the individual is an essential aspect of dignity. The ability of the individual to protect a zone of privacy enables the realization of the full value of life and liberty. Liberty has a broader meaning of which privacy is a subset. All liberties may not be exercised in privacy. Yet others can be fulfilled only within a private space. Privacy enables the individual to retain the autonomy of the body and mind. The autonomy of the individual is the ability to make decisions on vital matters of concern to life. The journey of right to privacy has been …
