More surrogacy contracts are fulfilled in the United States than in any other country (Bromfield, 2016, p. 193). In 2014, there were approximately 2,000 surrogacy arrangements in the U.S., yet the market is totally unregulated (Shellnutt and Grizzle, 2018, p. 31). Given that 1 in 6 American couples face infertility, there will continue to be a demand for alternative and assisted reproductive options (Shellnutt and Grizzle, 2018, p. 34). This paper seeks to explore several areas of surrogacy, including contract enforcement, potential problems parties in surrogacy agreements face, current legislation, the role of religion in surrogacy, and specific case studies. …

Peer Effects And Recidivism: The Role Of Race And Age, Kegon Teng Kok Tan, Mariyana Zapryanova

Recidivism rates are a growing concern due to the high cost of imprisonment and the high rate of ex-prisoners returning back to prison. One policy-relevant and potentially important determinant of recidivism is the composition of peer inmates. In this paper, we study the role of peer effects within a correctional facility using data on almost 80,000 individuals serving time in Georgia. We exploit randomness in peer-composition over time within prisons to identify effects of peers on recidivism rates. We find no evidence of peer effects for property or drug-related crimes in the general prison population. However, we find strong peer …

Liberals and progressives typically look to the national government to make policy aimed at achieving social justice. Historically, that is not without reason. As Professor Kathleen Morris of Golden Gate University School of Law put it in a recent email exchange, "social elites reached for the federal level in large part because the states and localities proved themselves to be genuinely terrifying to marginalized folks between 1860 and 1980.”

Pillars of U.S. social provision, public pension funds rely significantly on private investment to meet their chronically underfunded promises to America’s workers. Dependent on investment returns, pension funds are increasingly investing in marginalized debt, namely the array of high-interest-rate, subprime, risky debt—including small-dollar installment loans and other forms of subprime debt—that tends to concentrate in and among historically marginalized communities, often to catastrophic effect. Marginalized debt is a valuable investment because its characteristically high interest rates and myriad fees engender higher returns. I investigate the constitutionality of hard state border closures in the United States as a prophylactic response to a pandemic. This type of border closure prevents people from entering a State, except for exempt travelers, a category that includes, for example, military, judicial and government officers, and people granted entry on compassionate grounds. Those allowed to enter usually have to then go through a quarantine regime before being released into the community. During the COVID-19 pandemic, no State has attempted such closures. However, epidemiological experts suggest that, in comparison to other border and non-border measures, such closures are more effective. …

"Defunding" The Criminality Of Mental Illness By Funding Specialized Police Training: How Additional Training And Resources For Dealing With Mental Health Will Be Beneficial For All Sides, Margaret Ahern

The momentous public outcry for police reform is the result of police encounters ending fatally, which is notably sixteen times more likely for individuals suffering from mental illness in the United States. These horrific incidents highlight the systemic failings of traditional police departments training and its failure to provide officers with the necessary skills to de-escalate crisis situations involving the vastly overrepresented mentally ill population involved in the United States justice system. Atmospheric Rivers (ARs) can provide much needed water to drought-ridden locations, however, can also lead to potential devastating flooding events. Thus, AR forecasts must be improved to keep the public safe. This case study used the Weather Research and Forecasting (WRF) model to compare the impact of including COSMIC-2 GPS Radio Occultation (RO) measurements using 4D-VAR data assimilation techniques. Each WRF simulation analyzed the vertical motion, pressure, mixing ratios with respect to ice, rain, and vapor, and precipitation fields. Examining Variation In Compliance To A New School Counselor Policy By School And School Counseling Program Variables, Chloe Lancaster, Michelle Welch-Brasfield, Martha F. Burke

Journal of School-Based Counseling Policy and Evaluation

To address a gap in the research, we conducted a policy evaluation to investigate if a recent state policy change had met its intended goals to decrease school counselor ratios and increase their time with students. Participants included 143 PK-12 public school counselors in one state in the southeastern region of the United States. Results of this statewide study revealed; (a) a decline in ratios pursuant to policy adoption; (b) less non-counseling duties when following the policy; and (c) elementary level school counselors were more likely to meet policy guidelines as compared to secondary school counselors. Historians describe the Florida East Coast Railway strike of the 1960s as one of the longest labor disputes in United States history. It was also one of the most violent episodes in recent American labor history. Expected to last only a few weeks, it began in January 1963, when 1,640 workers walked out, and did not end until late 1974. The early years of the strike were punctuated by numerous violent acts, particularly derailments and dynamitings of FEC railway freight trains. On October 20, 1963, four diesel locomotives and fifty-two cars piled up just south of New Smyrna Beach, Florida. …

Abstract The goal of the Elk Grove Village Cares program is to decrease the deaths and overdoses of those who abuse opioids through harm reduction strategies and provide access to treatment. The article is a program evaluation of the Elk Grove Village Cares program. Surveys, interviews and the synthesis of program data is used to evaluate the efficacy of program activities. Results: The rate of death from opioid use has decreased an average of 1.7 deaths since program implementation in 2018. The focus of this study was to develop standards that can be used for establishing and assessing high-quality postsecondary trade and industrial programs. A four-round Delphi technique was used to generate consensus regarding program standards. The panel of experts, comprised of postsecondary administrators of trade and industrial programs, was used to determine which program standards should guide the development and assessment of high-quality trade and industrial education programs. Community colleges are the leaders in facilitating career and technical education (CTE), and faculty help develop program offerings on campus. This study explored faculty perceptions of community college CTE programs using the survey research method. Participants included 36 faculty members from various disciplines from 15 state colleges in Florida. Participants were sent a digital survey and asked to use a scale from 0 (do not agree) to 8 (agree) to score their agreement level with 43 statements of opinion. Moreover, as coyotes increasingly use these urban spaces, human-coyote conflicts have become more common, creating a need for new management strategies. This paper will explore how the city of San Francisco could create a new coyote management plan for its highly visible coyote population. Eighth Amendment jurisprudence has resulted in limited scrutiny of solitary confinement despite the known harms associated with the practice. The two-part test established by the federal courts to evaluate Eighth Amendment claims and limitations on challenging prison conditions under the Prison Litigation Reform Act can make it difficult to establish that solitary confinement is cruel and unusual punishment.

State constitutional challenges to solitary confinement are underexplored. Nearly all state constitutions contain an equivalent provision to the Eighth Amendment’s prohibition on cruel and unusual punishment. State courts need not be bound by federal jurisprudence in interpreting the scope of the state …

The opposite of poverty is not wealth. It is justice. Beginning in the 1980s, a "trail of tax cuts" led to budget shortfalls and revenue gaps throughout the United States. These budgetary problems resulted in many cities and towns shifting their burden of funding courts and the justice system at large "to the 'users' of the courts, including those least equipped to pay." Although "jailing an indigent person for a fine-only, low-level offense is unconstitutional," it is still an ongoing practice in many states, including Arkansas. Recent developments in computerized record-keeping for state-owned arms, ammunition, and explosives now offer simple, affordable solutions in the lowest-capacity environments. A global partnership between Mines Advisory Group (MAG) and the developers of ArmsTracker soft-ware promises to break a twenty-year logjam that, until now, has denied comprehensive, affordable weapon and ammunition record-keeping systems to states in greatest need.
