Queering Pentecost(Alism): Advocating For Inclusion Of Affirming Pentecostal Congregations, Telaireus Herrin Dec 2020

Queering Pentecost(Alism): Advocating For Inclusion Of Affirming Pentecostal Congregations, Telaireus Herrin

Conexión Queer: Revista Latinoamericana y Caribeña de Teologías Queer

Modern understandings and constructions of sexuality challenge the heteronormative hegemony of most Christian denominations. Pentecostalism faces similar challenges. For LGBTIQ+ Christians, affirmative congregations have been places of refuge to counter destructive doctrines and teachings related to sexuality, marriage, membership, and participation in the church. The taxonomy of Pentecostalism typically includes four movements within Pentecostalism. I postulate a fifth type of Pentecostalism —Affirmative Pentecostal Congregations— which disrupts and dismantles exclusive constructions of sexuality and affirms an inclusive faith.

Trinity Monotheism And Daniel Howard-Snyder's "Diminished Divinity Problem", Kevin Watson Jr. Nov 2020

Trinity Monotheism And Daniel Howard-Snyder's "Diminished Divinity Problem", Kevin Watson Jr.

The Corinthian

In this paper, I summarize and defend a model of the Trinity proposed by William Lane Craig and J.P. Moreland, which is called trinity monotheism. An important element of this model is that there are two ways to be divine; either one must be a proper part of the Trinity or the Trinity itself. I answer one objection in Daniel Howard-Snyder’s thorough critique of this model. He calls this objection the Diminished Divinity Problem and supposes that if the property of divinity is exemplified in two different ways, either by being a proper part of the Trinity or by being …

The Role Of "Commercial Morality" In Trade Secret Doctrine, Lynda J. Oswald Nov 2020

The Role Of "Commercial Morality" In Trade Secret Doctrine, Lynda J. Oswald

Notre Dame Law Review

The approaching anniversary of E.I. duPont deNemours & Co. v. Christopher is the impetus for this exploration and evaluation of the role of “commercial morality” in trade secret misappropriation doctrine. Christopher is the well-known industrial espionage case in which the U.S. Court of Appeals for the Fifth Circuit held that flying an airplane over an under-construction manufacturing facility to take photos of briefly-but-inevitably exposed trade secrets was an “improper means” of accessing a trade secret and was contrary to standards of “commercial morality.”

Commercial morality has played a significant but shifting role in trade secret law over the past seven …

Humans, Elves, And Greenland Sharks: Against Kagan’S Distributive Argument For Hierarchical Moral Status, Dustin R. Crummett Nov 2020

Humans, Elves, And Greenland Sharks: Against Kagan’S Distributive Argument For Hierarchical Moral Status, Dustin R. Crummett

Between the Species

Shelly Kagan argues that “unitarianism,” the claim that animals and humans have equal moral status, has intuitively implausible distributive implications. I argue that Kagan’s reasoning can, with certain modifications, be applied equally well to undermine his own view, and that the responses Kagan can make to this modified reasoning are also available to the unitarian responding to Kagan’s original argument. Accordingly, Kagan cannot consistently hold his own view while also endorsing his main against unitarianism.

Experiences Of Divine Grace Among Christian Friends, Kyle T. Webster Nov 2020

Experiences Of Divine Grace Among Christian Friends, Kyle T. Webster

Doctor of Psychology (PsyD)

Though topics of prayer, forgiveness, and gratitude have received attention in the psychology of religion, there is sparse literature regarding the concept of grace. This study explored how Christians who identify as Friends (Quakers) experience grace from God. Thirty interviews were conducted with Friends in the Pacific Northwest, using a standardized semistructured interview developed for a larger study of how Christians from various denominations experience grace. Four organizing themes were derived from the interview questions and then grounded theory was used to uncover associated sub-themes within each organizing theme. The organizing themes include the nature of God, the nature of …

Struggle And Martyrdom: Abusive Power And Root Narrative In The Aftermath Of The Eritrean Revolution, Solon Simmons Nov 2020

Struggle And Martyrdom: Abusive Power And Root Narrative In The Aftermath Of The Eritrean Revolution, Solon Simmons

Peace and Conflict Studies

In this paper I have applied root narrative theory to the case of conflict in Eritrea, a small African country along the Red Sea that has been embroiled in conflict with its neighbors and the international community on and off since at least 1961. Examining a small sample of representative texts from the government of Eritrea and from international critics of the regime, I demonstrate that these parties—different moral languages that make it almost impossible for each side to see the point of view of the other. Using the semiotic structure of the story system implied by root narrative theory …

Unearthing The Origins Of Quasi-Property Status, Alix Rogers Nov 2020

Unearthing The Origins Of Quasi-Property Status, Alix Rogers

UC Law Journal

Under contemporary American law, human corpses and some bodily parts are classified as quasi-property. Quasi-property is an American legal conception composed of limited interests that mimic some of the functions of property, but does not formally qualify as property. It is a uniquely American, idiosyncratic and misunderstood legal category. Quasi-property status is most typically associated with intellectual property given the Supreme Court decision of International News Services v. Associated Press. That human remains and bodily materials are classified as quasi-property is less well known. The confusion surrounding the quasi-property status of the dead has negative implications for current and future …

Surviving A Divorce With An Intact Faith: A Strategy For Ministering To Those Experiencing Divorce In The Church, Brandon Paul Wells Nov 2020

Surviving A Divorce With An Intact Faith: A Strategy For Ministering To Those Experiencing Divorce In The Church, Brandon Paul Wells

Doctoral Dissertations and Projects

Effectively ministering to divorcees is a unique aspect of church leadership. The majority of church leaders have never experienced divorce, so the unique problems that divorce presents are not familiar to them. The purpose of this D. Min Thesis Project is to investigate those problems and develop strategies that will allow church leaders to minister to divorcees effectively. This will be accomplished using questionnaires and interviews where difficult questions are asked to divorcees, and honest answers are revealed. Church leaders will also be interviewed about their positions on divorce and their responses compared to those given by divorcees in order …

Transcendentalist Sympathies: A Contextual Study Of The Wound-Dresser, Jared Hiscock Nov 2020

Transcendentalist Sympathies: A Contextual Study Of The Wound-Dresser, Jared Hiscock

Glenn Korff School of Music: Dissertations, Theses, and Student Creative Work, and Performance

My document takes as its subject The Wound-Dresser by American composer John Coolidge Adams (b. 1947). Published in 1988, this twenty minute work for baritone voice and orchestra remains Adams’s sole contribution to the non-operatic solo voice repertoire.

In The Wound-Dresser Adams grapples with the historical churning of his own times by looking to Ralph Waldo Emerson, Walt Whitman, and Charles Ives. A brief biography of Ralph Waldo Emerson begins the document in order to elucidate Emerson’s connection to Adams and Whitman. I then introduce Walt Whitman, the author of the text used in The Wound-Dresser and suggest that Whitman’s …

The Unitary Executive Theory In Comparative Context, David M. Driesen Nov 2020

The Unitary Executive Theory In Comparative Context, David M. Driesen

UC Law Journal

The debate over the unitary executive theory—the theory that the President should have sole control over the executive branch of government—has proven extremely parochial. Supporters of the theory argue that the original intent of our country’s founders requires presidential control, including a power to remove federal officials from their posts for political reasons. Opponents of the theory rely on functional considerations and our practice of dispersing power more widely. But neither side examines developments abroad to see what light other countries’ experience might shed on the question of whether the Supreme Court should craft a new rule of constitutional law …

Saints, Sinners, And Scoundrels: Catholic Law Faculty And A Light Unseen: A History Of Catholic Legal Education In The United States, Teresa Stanton Collett

Journal of Catholic Legal Studies

(Excerpt)

As a faculty member at a Catholic law school for the past seventeen years, I have often been frustrated with the inability of many professors and administrators at Catholic law schools to describe what makes a law school “Catholic.” As Professors Breen and Strang report in A Light Unseen: A History of Catholic Legal Education in the United States, too often the description is limited to something like “a commitment to social justice,” or “inculcating a strong sense of professional ethics.” Yet as the authors observe, “Catholic law schools do not have a monopoly on or even a …

Ghostly Others: Limiting Constructions Of Deserving Subjects In Asylum Claims And Sanctuary Protection, Maria E. Vargas Oct 2020

Ghostly Others: Limiting Constructions Of Deserving Subjects In Asylum Claims And Sanctuary Protection, Maria E. Vargas

Journal of International Women's Studies

In this article, I examine the different constructions of deserving subjects in the new Sanctuary Movement and how sexuality, gender, whiteness, and class create an ostensibly inclusionary agenda that produces ghostly others. Punitive anti-immigrant legislation in the United States has incited mass protests to defend the rights of undocumented migrants. In 2007 this pro-immigrant movement sought to deploy the sanctuary strategy as practiced in the Central American Sanctuary Movement of the 1980s. Using the case of Sulma Franco, a Guatemalan lesbian who was granted Sanctuary by the First Unitarian Universalist Church in Austin, I illuminate the limitations of deservingness under …

"Water Is Life!" (And Speech!): Death, Dissent, And Democracy In The Borderlands, Jason A. Cade Oct 2020

"Water Is Life!" (And Speech!): Death, Dissent, And Democracy In The Borderlands, Jason A. Cade

Indiana Law Journal

Decades of stringent immigration enforcement along the Southwest border have pushed migrants into perilous desert corridors. Thousands have died in border regions, out of the general public view, yet migrants continue to attempt the dangerous crossings. In response to what they see as a growing humanitarian crisis, activists from organizations such as No More Deaths seek to expand migrant access to water, to honor the human remains of those who did not survive the journey, and to influence public opinion about border enforcement policies. Government officials, however, have employed a range of tactics to repress this border-policy "dissent," including blacklists, …
