United States Immigration and Customs Enforcement (“ICE”) significantly relies on state and local personnel and resources to carry out enforcement of immigration law. California Senate Bill 54 (“SB 54”), the “California Values Act,” is California’s attempt to disentangle local law enforcement from federal civil immigration enforcement.
This Article offers an in-depth evaluation of SB 54’s mechanics; identifies vulnerabilities that exist despite SB 54 and potential means for law enforcement agencies (“LEAs”) to combat these issues; and comments on how local individual LEAs and the California Department of Corrections and Rehabilitation have chosen to exercise the discretion to comply (or not …

A Controversial Transplant? Debate Over The Adaptation Of The Napoleonic Code On The Polish Territories In The Early 19th Century, Michał Gałędek, Anna Klimaszewska
Journal of Civil Law Studies
This article focuses on the attitude of the Polish legal elite regarding the adaptation of French civil law introduced on the Polish territories in the Duchy of Warsaw, established by Napoleon in 1807. While addressing the Polish example, it underscores the universal nature of problems engendered by legal transfer and by the social reactions to foreign solutions. It sheds light on the state of mind of Polish enlightened elites, on their approach toward new legal instruments and on the challenges of adapting them to the socioeconomic conditions of a semi-peripheral country. Journal of Civil Law Studies
Data has become one of the most important resources in post-modern information society. However, European civil law does not reflect this development adequately. In fact, so far, European civil law seems to struggle with handling data as a legal entity. Against this background, the article provides a transnational overview and a comprehensive analysis of the legal situation in Europe. It discusses why data ownership is widely perceived as a problem on this side of the Atlantic and how this perception can be overcome by a fundamental property law approach. Pursuing A Universal Threshold For Regulating Incitement To Discrimination, Hostility Or Violence, Rebecca Meyer

The International Covenant on Civil and Political Rights (ICCPR) recognizes that although the right to freedom of expression is essential, it is not absolute. The ICCPR prohibits speech that incites to discrimination, hostility, or violence. The provision prohibiting such speech is important to protect individuals and communities. Yet, not all countries are adequately enforcing its mandate. Such countries are letting inciting speech spread and, in some instances, violence has ensued. Conversely, some countries are taking enforcement too far, using the criminalization of inciting speech as a tool to silence political dissent. The rights of freedom of religion and beliefs are constitutionally guaranteed, both in Indonesia and Germany. However, the right of freedom of religion is not unlimited. This paper aims to identify and analyze (1) Why there is the right of freedom of religion is restricted, (2) What product of the law is that regulates restriction on the right of freedom of religion in Indonesia and Germany, and (3) What purpose do Indonesia and Germany have in restricting the right of freedom of religion? This paper attempts to shed the light on challenging issues affecting travel and tourism industry especially in the Middle East such as political, socio-economic and security instability. Due to its geopolitical and historical importance, the paper focuses on the situation in Egypt as a descriptive case study. The methodology relies on historical review and impact assessment to understand the roots and extended branches of instability in the Middle East that led to the Arab Spring, by focusing on the Egyptian case in the last half century. Working out of the social and philosophical revolutions from the Enlightenment, contemporary action theory has unwittingly inherited several Cartesian ideas regarding the human mind: that it is unified, rational, and transparent. As a result, we have for too long conceived of action as intimately bound up with reason such that to act at all is to act for a reason, leaving us with theoretical difficulties in accounting for the behavior of non-human animals as well as irrational behavior in human beings.
But rather than propose that such difficulties can be resolved by retreating to a pre-Enlightenment view of human nature, …

A right to housing is a central iteration of the broader demand for a democratic right to the city. The perpetual housing crisis for lower-income people results from a commodified system in which access to housing is based on the exchange value interests of property owners, rather than a universal right to a decent, affordable home. This system is a pillar of neoliberal urban governance and justified by a hegemonic ideology that equates speculative homeownership with the American Dream. Achieving a right to housing, even at the local scale, requires a radical movement that cultivates individual and collective consciousness, discredits …

This dissertation is composed of three essays which evaluate financial strategies used to manage cash flows and the broader working capital management process in local governments. The objective of this dissertation is to address unresolved questions in the literature regarding the use of short-term financial resources to improve a government’s internal operating process and successfully navigate challenging fiscal environments. Together, the three essays contribute to our understanding of cash flow management strategies and the consequences of their implementation in United States local governments.

This dissertation summarizes research examining watershed processes across Northern New England, with an emphasis on the Central and Coastal regions of Maine. The research presented here focuses on the linkages between watershed geomorphic conditions, climate, and surface flow regimes driving stream channel hydraulic conditions and bed dynamics governing channel geometry. The geologic and human history of the landscape provides the context in which earth surface processes are examined within the dominant physiographic settings in Maine to describe vulnerabilities to climate change. As exposed through a variance of media outlets, the United States is often inept in its endorsement of farm animal welfare laws; while incidents depicting the cruel mistreatment of farm animals are plentiful, the federal government enforces only two laws that address the issue directly. The 28 Hour Law and the Humane Methods of Slaughter Act, however pure in intent, are severely limited in scope, and according to reports from the USDA, handling violations are frequent yet rarely result in longstanding consequences. 2008 - Managing An Uncertain Future - Climate Change Adaptation Strategies For California's Water
Miscellaneous Documents and Reports
This report recommends a number of adaptation strategies for California and local water managers to improve their capacity to handle change. Many of the strategies will also help adapt California's water resources to accommodate non-climate demands including a growing population, ecosystem restoration and greater flood protection. Several of the recommendations in this report are ready for immediate adoption, while others need additional public deliberation and development. Some can be implemented using existing resources and authority, while the majority will require new resources, sustained financial investment and significant collaborative effort.

Virtual Life Sentences: An Exploratory Study, Jessica S. Henry, Christopher Salvatore, Bai-Eyse Pugh
Jessica S. Henry
Virtual life sentences are sentences with a term of years that exceed an individual’s natural life expectancy. This exploratory study is one of the first to collect data that establish the existence, prevalence, and scope of virtual life sentences in state prisons in the United States. Initial data reveal that more than 31,000 people in 26 states are serving virtual life sentences for violent and nonviolent offenses, and suggest racial disparities in the distribution of these sentences. This study also presents potential policy implications and suggestions for future research.

Nursing ETDs
Healthcare that includes high performing interprofessional clinical teams (IPTs) is one recommended strategy to provide optimal quality and cost-effective care delivery. Highly functional IPTs are characterized by effective communication, trust, respect, collaboration, information-sharing, and conflict resolution and are more efficient than individual providers working alone. Internally, IPT members’ relationships and understanding of both one’s own professional identity and others’ role and responsibilities are crucial to team functionality and effectiveness. Externally, factors including regulatory practice environments might influence the effectiveness and performance of both individual team members and the team overall.
