Law's Haze, Police Ways, And Tech's Maze: Relationships Between American Law, Crime, And Technology, Meghan Peterson

In this dissertation, I explore the role of law in policing operations targeting cyber sex offenders in the United States. Specifically, I examine enforcement in this crime arena as part of an ongoing expansion within the carceral, surveillance, risk-based state. I argue that imprecision and lack of clarity within American law – particularly in the evolving world of online interactions – generate hazy, arbitrary applications in law enforcement. On this point, I submit that absence of legal clarity undermines law enforcement efforts to address crimes – both within and beyond the cyber world. Although it has long been in vogue to discredit the judiciary, it remains the most trusted of the three branches of government. However, empirical evidence supports the idea that judicial campaign donations affect judicial decision making. The reality of political campaigns under Citizens United has the potential to further undermine the public perception of judges and to enhance the potential for corruption of the judiciary.

CCSI helped launch a letter signed by over 230 law and economics professors urging President Trump to remove ISDS provisions from NAFTA. On August 10, 2017 President Trump announced his intention to declare a national emergency following the recommendation of the White House Commission on Combating Drug Addiction and the Opioid Crisis. Opioid abuse is among the most consequential preventable public health threats facing the nation. More than 600,000 deaths have occurred to date, with 180,000 more predicted by 2020. Of the 20.5 million US residents 12 years or older with substance use disorders in 2015, 2 million were addicted to prescription pain relievers. Removal Of Women And African-Americans In Jury Selection In South Carolina Capital Cases, 1997- 2012, Ann M. Eisenberg

The Supreme Court’s May 2016 decision in Foster v. Chatman involved smoking-gun evidence that the State of Georgia discriminated against African-Americans in jury selection during Foster’s 1987 capital trial. Foster was decided on the thirtieth anniversary of Batson v. Kentucky, the first in the line of cases to prohibit striking prospective jurors on the basis of their race or gender. But the evidence of discrimination for Batson challenges is rarely so obvious and available as it was in Foster.

Where litigants have struggled to produce evidence of discrimination in individual cases, empirical studies have been able to assess jury selection …

Though it may seem like an obvious analogy, a comparison of consent to sex and consent to contract has rarely been explored in such detail. The legal concepts protecting bargainers to a contract can be applied to analyses of sexual coercion in consent to sexual encounters, thereby affording survivors with greater protection against instances of sexual violence that seem to consistently slip through the cracks of our criminal justice system. The Ace Attorney video game series is a game series developed by Capcom since 2001 that can be described as an interactive visual novel in the criminal courts. Despite claims that the Ace Attorney video game series is inaccurate to court proceedings, these arguments are made in comparison to the American criminal justice system, and not the Japanese courts that the series was originally modeled after. It asserts that the purpose and definition of justice and the law can be determined by the utilization of literal, grammatical, historical, and contextual hermeneutic principles on the biblical text. The uniqueness of this approach is that the Bible will be used as an exclusive source for determining the definition, purpose, and operation of justice and the law.

This article describes economic research on models of legal disputes. Concepts such as rational choice and static equilibrium are often used inaccurately in the noneconomic research presented in this issue. This article critiques the longitudinal studies, illustrating a number of problems of conceptualization and data analysis. Finally, the authors consider normative models of dispute resolution and the evolution and effects of judge-made law.
