. . . And Law?, John Henry Schlegel Dec 2017

. . . And Law?, John Henry Schlegel

Contributions to Books

Published as Chapter 18 in Searching for Contemporary Legal Thought, Justin Desautels-Stein & Christopher Tomlins, eds.

The locution “law and . . . (some other discipline)” implicitly asserts the primacy of legal doctrine and institutions narrowly conceived for coming to understand phenomena in which law takes a part. The ordinary story of American legal theory – formalism then realism then contemporary legal thought – can be understood to repeat the triumphalism implicit in “law and . . .” Of course, the story of American legal theory could possibly be read differently -- as a series of responses to the inability …

The Retainer-Based Model Of Financial Planning, Savannah Stone Dec 2017

The Retainer-Based Model Of Financial Planning, Savannah Stone

Mahurin Honors College Capstone Experience/Thesis Projects

Through attending my classes and working part-time at a financial planning firm, I have learned about many different types of compensation for financial planners, the most common being commissions and fees. Western Kentucky University allowed me to travel to San Diego in January of 2017 to attend the TD Ameritrade LINC 2017 conference, and it was there that I was introduced to the concept of a monthly retainer model of compensation. This grabbed my attention because it was a relatively new and unusual form of payment for financial planning services. Through curiosity, this topic encouraged my study of the past, …

Venture Capital Contract Design: An Empirical Analysis Of The Connection Between Bargaining Power And Venture Financing Contract Terms, Spencer Williams Dec 2017

Venture Capital Contract Design: An Empirical Analysis Of The Connection Between Bargaining Power And Venture Financing Contract Terms, Spencer Williams

Fordham Journal of Corporate & Financial Law

This Article presents an empirical analysis of the connection between bargaining power and contract design using an original dataset of over 5,500 equity and debt venture financings from 2004–2015. Using the total supply of venture capital in the U.S. as a measure of relative bargaining power between entrepreneurs and investors, this Article finds that venture capital supply has a statistically significant relationship with price and non-price terms in both equity and debt financings. These results contradict one of three theoretical accounts of bargaining power and support the other two.

Implementing The Heston Option Pricing Model In Object-Oriented Cython, Brandon Hardin Dec 2017

Implementing The Heston Option Pricing Model In Object-Oriented Cython, Brandon Hardin

All Graduate Plan B and other Reports, Spring 1920 to Spring 2023

The 1973 Black-Scholes model, a revolutionary option pricing formula whose price is 'relatively close to observed prices, makes an assumption that the volatility is constant and thus, deterministic. This causes some inefficiencies and patterns in the pricing of options due to the model providing evidence of the volatility smile' of the volatility. Many scholars have suggested that the volatility should be modelled by a stochastic process and the (1993) Heston Model is one of many proposed solutions to remedy this problem. The Heston Model allows for the 'smile' by defining the volatility as a stochastic process. This thesis considers a …

Range-Based Volatility, Expected Stock Returns, And The Low Volatility Anomaly, Benjamin M. Blau, Ryan J. Whitby Nov 2017

Range-Based Volatility, Expected Stock Returns, And The Low Volatility Anomaly, Benjamin M. Blau, Ryan J. Whitby

Economics and Finance Faculty Publications

One of the foundations of financial economics is the idea that rational investors will discount stocks with more risk (volatility), which will result in a positive relation between risk and future returns. However, the empirical evidence is mixed when determining how volatility is related to future returns. In this paper, we examine this relation using a range-based measure of volatility, which is shown to be theoretically, numerically, and empirically superior to other measures of volatility. In a variety of tests, we find that range-based volatility is negatively associated with expected stock returns. These results are robust to time-series multifactor models …

Research Project In Finance: Kss Kohl's Corporation, Garrett Blair

Student Scholarship

Kohl’s Corporation ($KSS) is a discount department store. Kohl’s was founded in 1927 as a grocery store, building their first department store in 1962 in Menomonee Falls, Wisconsin. In 1972, British American Tobacco purchased an 80% stake in Kohl’s and took complete control. In 1986, due to the mismatch between Kohl’s and British American Tobacco’s strategies, Kohl’s was purchased by a group of investors led by Kohl’s management. From 1988 to 1992 when they went public, Kohl’s increased their sales from $388 million to $1 billion. Kohl’s completed its initial public offering for 11.1 million shares in May of 1992, …

Instance Selection Using Genetic Algorithms For An Intelligent Ensemble Trading System, Youngmin Kim, David Lee Enke Oct 2017

Instance Selection Using Genetic Algorithms For An Intelligent Ensemble Trading System, Youngmin Kim, David Lee Enke

Engineering Management and Systems Engineering Faculty Research & Creative Works

Instance selection is a way to remove unnecessary data that can adversely affect the prediction model, thereby selecting representative and relevant data from the original data set that is expected to improve predictive performance. Instance selection plays an important role in improving the scalability of data mining algorithms and has also proven to be successful over a wide range of classification problems. However, instance selection using an evolutionary approach, as proposed in this study, is different from previous methods that have focused on improving accuracy performance in the stock market (i.e., Up or Down forecast). In fact, we propose a …

Voter Primacy, Sarah C. Haan Sep 2017

Voter Primacy, Sarah C. Haan

Sarah Haan

This Article argues that Citizens United v. FEC expanded the audience for campaign finance disclosure to include a group that had never before been held relevant to campaign finance disclosure—corporate shareholders—and explores the constitutional, policy, and political consequences of this change. In part IV of Citizens United, the U.S. Supreme Court departed from more than thirty years of campaign finance disclosure analysis to treat corporate shareholders as a target audience for corporate electoral spending disclosure, holding that the governmental interest advanced by campaign finance disclosure laws includes an interest in helping corporate shareholders “determine whether their corporation’s political speech advances …

Essays On Tax Avoidance, Monetary Policy And International Trade, Giulia Zilio Aug 2017

Essays On Tax Avoidance, Monetary Policy And International Trade, Giulia Zilio

Economics Dissertations

This dissertation consists of three distinct essays on tax avoidance, monetary policy and international trade.

The first chapter focuses on profit shifting. Multinational enterprises (MNEs) manipulate the prices that they use for intracompany transactions (known as transfer prices) to shift profits to countries with more favorable tax treatments. I improve upon the current practice to estimating this elasticity by constructing a measure of the stringency with which countries enforce their anti-tax avoidance rules and take into account their incentive to enforce them. I report evidence showing that the failure to account for the enforcement of anti-tax avoidance rules and the …

Healthcare Sector Stock Returns And The Election Of Donald J. Trump, Cordell Hull Aug 2017

Healthcare Sector Stock Returns And The Election Of Donald J. Trump, Cordell Hull

All Graduate Plan B and other Reports, Spring 1920 to Spring 2023

The 2016 US Presidential Election was hallmarked by significant policy differences between the Democratic and Republican parties. Healthcare reform was one of the most significant and highly debated issues between the candidates; Hillary Rodham Clinton (D-NY) and Donald J. Trump (R-NY). The Republican platform of repeal and replace was in direct opposition to the expansionary viewpoints of the Democratic Party which was to promote increased regulations on the healthcare and pharmaceutical industries. The media narrative in the months preceding the election assumed a Democratic victory as a sure thing. The New York Times gave Hillary Clinton a 98.5% chance of …

Railways And Regret: Revising Mobility Myths In Victorian Literature And Culture, 1857-1891, Kathryn Winslow Powell Aug 2017

Railways And Regret: Revising Mobility Myths In Victorian Literature And Culture, 1857-1891, Kathryn Winslow Powell

Doctoral Dissertations

Since 1979 when Wolfgang Schivelbusch applied Marx’s phrase “annihilation of time and space” to the nineteenth-century railways, the idea that locomotives revolutionized mobility and restructured life has undergirded historical analysis. Recent scholarship challenges this long-standing assumption, countering that transportation networks expanded through evolutionary change and that cultural adaptation occurred by resisting the imposing forces of modernity. My study joins this critical departure but proposes a new conceptual model defined by regret and revision. This dissertation argues that fiction written between 1857-1891 illustrates railway growth as a recursive and participatory process. I show through the writing of Elizabeth Gaskell, Charlotte Riddell, …

The Government’S Role In Unleashing Impact Investing’S Full Potential, Chelsea Mcgrath Jul 2017

The Government’S Role In Unleashing Impact Investing’S Full Potential, Chelsea Mcgrath

Pepperdine Law Review

Impact investing refers to investments made in organizations, companies, or funds with the intent to generate measurable social or environmental impact along with a financial return. Since its start in 2008, this industry has become a vibrant tool to address a wide variety of local and global issues, resulting in higher standards of living, lower rates of prison recidivism, clean technology and more. Impact investing is no longer a novel concept. Rather, it has successfully pushed the boundaries from the separate methods of conventional investing and philanthropy, blending them together to create sustainable solutions to social and environmental problems. By …

Evaluating Financial Planning Advertisements For Retirement In India: A Content Analysis, Ritu Gupta, Sudeepta Pradhan Jul 2017

Evaluating Financial Planning Advertisements For Retirement In India: A Content Analysis, Ritu Gupta, Sudeepta Pradhan

The Qualitative Report

For Indians, retirement is neither a formal stage of life nor an issue that people dwell upon while planning their future. Despite the lack of preparation for retirement, a burgeoning population indicates a huge mass of retirees in the coming decades. These statistics trigger the need for individuals to prepare for their retirement appropriately, while accounting for factors like inflation. To highlight the significance of retirement planning and create awareness among the masses, pre-requisites to retirement planning should be effectively communicated. Extant literature suggests advertising to be one such measure of effective communication. This study intended to capture the extent …

Financing Natural Infrastructure For Coastal Flood Damage Reduction, Charles Colgan, Michael W. Beck, Siddharth Narayan

Publications

This paper explores financial tools for investing in natural infrastructure to reduce current and future risks from flooding. The key conclusions are:

1) There is a large and growing pool of funding for natural infrastructure, but the availability is geographically uneven and providing sufficient resources will require significant actions by industry, government, scientists, and communities.

  • There are both public and private sources that can fund natural infrastructure for flood risk reduction. Approaches vary among the U.S., Europe, and international development organizations. For example, funding for natural flood control infrastructure is a byproduct of other purposes in the U.S., but recognized …

This symposium piece offers several approaches to bridging this gap between entrepreneurs and business finance lawyers.

Trauma is the leading cause of death among individuals 1 to 44 years of age. Nationally, one individual dies of traumatic injuries every three minutes. In the United States, the financial impact of trauma is estimated to be approximately $671 billion annually, spent on direct trauma care and associated costs, such as loss in productive days and rehabilitation. The New Mexico trauma system registered dramatic development over the past 10 years. In 2007, the state had only three designated trauma centers, and today there are 12. The Impact Of The 2016 Election On The Financial Performance Of Major Healthcare Companies, Joshua T. Blotter

All Graduate Plan B and other Reports, Spring 1920 to Spring 2023

Healthcare reform was a significant political issue during the November 2016 US general elections, and played an important role in campaigning and political discourse leading to the election. Donald Trump, the Republican presidential candidate, and Republicans running for congressional office, campaigned on a platform advocating for the repeal and replacement of the Patient Protection and Affordable Care Act of 2010 (ACA), among other changes. Hillary Clinton, the Democratic presidential candidate, and Democrats running for congressional office, campaigned on a platform that included support for the ACA, as well as increased regulations on the pharmaceutical industry and health insurers, among various …

Financial Management Issues Of College-Aged Students: Influences And Consequences, Katharine N. Widener Apr 2017

Financial Management Issues Of College-Aged Students: Influences And Consequences, Katharine N. Widener

Selected Honors Theses

College students have acquired a reputation of irresponsibility and impulsivity, which has contributed to the perception that they are poor managers of money. This researcher sought to establish a clearer picture of the full story behind how college students handle their finances through a comprehensive literature review. Several searches were conducted on the topics of college students, finances, money management, debt levels, and other related terms. Scholarly articles were analyzed for common themes and research patterns, and the various strings of research identified were categorized into three main headings: Financial situation, financial influences, and financial consequences. The three major headings …
