This Note will focus on consumer bankruptcy related to chapter 7 and chapter 13 filings. Section I provides an introduction to DSOs and the goals of enforcing them through bankruptcy. Section I also discusses the impact of DSO status on the automatic stay, discharge, priority status for property distribution of the bankruptcy estate, capability to reach exempt property, and application to attorney fees. Section II argues that, where attorney fees are not owed to a spouse, former spouse, or child, and do not fit within an impact exception, the fees are not DSOs, but instead are merely general non-secured claims. …

To squarely address this decisional quagmire, this article examines the binding effect of ICJ orders, entered pursuant to its compulsory jurisdiction, on American courts; earlier decisions of the Supreme Court penalizing foreign nationals for failing to timely raise individual treaty claims; the effect on treaty enforcement in domestic courts after the executive branch’s recent foreign policy decision to withdraw from compulsory ICJ jurisdiction; the current policy disputes dividing the United States and the ICJ; and, the national interest, or lack thereof, in treaty compliance. In some cases, singers have been able to vindicate property rights in their identities when advertisers have featured sound-alike singers in commercials. However, there is no case law to support that an instrumental musician can protect herself from an advertiser imitating the characteristic sound of her playing. This Comment will explore whether and how the law should protect “musical identities”, particularly when the plaintiff is an instrumental musician rather than a singer.

Smoking material fires are the leading cause of residential fire deaths and the third leading cause of residential fire injuries. Cigarettes are the primary source of ignition in smoking material fires. Several policies and regulations have attempted to mitigate the risks associated with smoking cigarettes. This study specifically examines the impact of the states’ fire standard compliant legislation as it relates to smokingrelated residential civilian fire deaths, civilian fire injuries, and fire incidents. Functional fixedness is a cognitive function whereby an individual becomes fixated on a given function of an object, which prevents the individual from using the object in an alternative fashion to solve a problem (Duncker, 1935/1945). The current study analyzed the effect of functional fixedness on 36 children from three different age groups, preschool, second grade, and ninth grade. The children were presented with a problem solving activity based on a problem used by German and Defeyter (2000), in which they concluded that young children are immune to the effects of functional fixedness. Cisgenesis is the genetic modification of a recipient plant with natural gene(s) from a sexually compatible plant. Unlike transgenesis, which is the genetic modification of a recipient plant with gene(s) from any non‐plant organism, or from a donor plant that is sexually incompatible with the recipient plant, the results of cisgenesis could occur naturally over time. The Indiana House Enrolled Act 1481 (HEA-1481) requires that the Indiana Department of Transportation (INDOT) adopt final rules by December 31, 2014, for the issuance, fee structure and enforcement of permits for overweight divisible loads, fee structure of permits for loads on extra heavy duty highways, and fee structure of permits for overweight loads. On December 26, 2013, INDOT adopted the Emergency Rules regarding these items, as required by HEA-1481, effective January 1, 2014. This study informs holistic policy, planning, and management of parks to balance the multiple goals of sustainability region-wide. A vision for a sustainable urban park system is introduced, informed by multidisciplinary thought and theory. This vision is then operationalized in the development of a quantitative method that examines four key dimensions of sustainability—physical, environmental, socio-economic, and built—across a citywide urban park system. If this is done, a court will find the delegation of broad authority to the agency to be constitutional. There is, however, an open issue regarding whether the “intelligible principle” standard applies to delegations of authority that allow for the promulgation of both civil and criminal penalties. A major goal for the health services research community is to provide evidence policymakers can use to improve the public’s health. However, it can be difficult to know what evidence policymakers want and how they decide what research to fund.

In order to understand where policymakers turn for evidence and how they make funding decisions amid fiscal and political constraints, AcademyHealth conducted a 3-part Fireside Chat series in the spring of 2014. This editorial summarizes the evidence gaps identified, and provides strategies for communicating with decision makers.

In November 2014, CCSI and the Institute for Human Rights and Business co-convened a colloquium on policy, law, contracts, and sustainable development, with a particular focus on large-scale investments in the extractive industries and the agriculture sector. The colloquium provided an opportunity for practitioners to share information on their related work, as well as to reflect on current practices and remaining gaps regarding efforts to embed sustainability and human rights into large-scale deals. This outcome document provides a summary of the discussion, while its annex includes information on participants’ relevant programs, initiatives, and tools.
