While cognizant of their social mission, public libraries often still have found it challenging to serve one of their most marginalized constituencies - the homeless. However, bound by legal mandate as well as American Library Association (ALA) core values of access, democracy, and serving the public, libraries must find ways to serve the needs of poor and homeless patrons. Shooing The Vultures Away From The Consumer Bankruptcy Carcass: Attorney Fees Owed By Debtors For Marital Dissolution Are Not Domestic Support Obligations, Christopher V. Davis

This Note will focus on consumer bankruptcy related to chapter 7 and chapter 13 filings. Section I provides an introduction to DSOs and the goals of enforcing them through bankruptcy. Section I also discusses the impact of DSO status on the automatic stay, discharge, priority status for property distribution of the bankruptcy estate, capability to reach exempt property, and application to attorney fees. Section II argues that, where attorney fees are not owed to a spouse, former spouse, or child, and do not fit within an impact exception, the fees are not DSOs, but instead are merely general non-secured claims. …

Linking publications to published datasets in repositories is an important part of the research lifecycle. However, merely linking them does not ensure reusability. It is important for repositories to develop and provide policies for preservation that support the reusability, including lifecycle, ownership, versioning, and attribution aspects of the scholarly process (Bechhofer et al., 2013). For more than 160 years, the Pacific salmon has been an important resource for the United States and Canada. However, it has been overexploited. Proper management of the species is essential not only for maintaining healthy populations but also maintaining the interests of diverse stakeholders. One set of stakeholders consists of the indigenous peoples of North America because the Pacific salmon are crucial to their food, social, and ceremonial traditions.

This note discusses the Supreme Court’s holding in Wilkinson that OSP’s system for inmate placement in its Supermax facility does not violate the Equal Protection Clause. Part II will summarize OSP’s purpose and condition, and will focus on Ohio’s New Policy regarding inmate placement. To squarely address this decisional quagmire, this article examines the binding effect of ICJ orders, entered pursuant to its compulsory jurisdiction, on American courts; earlier decisions of the Supreme Court penalizing foreign nationals for failing to timely raise individual treaty claims; the effect on treaty enforcement in domestic courts after the executive branch’s recent foreign policy decision to withdraw from compulsory ICJ jurisdiction; the current policy disputes dividing the United States and the ICJ; and, the national interest, or lack thereof, in treaty compliance. This Article discusses two important facets of Military Regulation and veterans law. First, this Article explores how the Uniform Code of Military Justice treats veterans accused of committing self-injury. Thus, there is a prohibition on , including criminal prosecution of, attempted suicide, which this Article argues exacerbates the issues which many of our brave servicemen and women face upon returning home from combat, often carrying the burden of mental disorders such as post-traumatic stress disorder. In some cases, singers have been able to vindicate property rights in their identities when advertisers have featured sound-alike singers in commercials. However, there is no case law to support that an instrumental musician can protect herself from an advertiser imitating the characteristic sound of her playing. This Comment will explore whether and how the law should protect “musical identities”, particularly when the plaintiff is an instrumental musician rather than a singer.

Smoking material fires are the leading cause of residential fire deaths and the third leading cause of residential fire injuries. Cigarettes are the primary source of ignition in smoking material fires. Several policies and regulations have attempted to mitigate the risks associated with smoking cigarettes. This study specifically examines the impact of the states’ fire standard compliant legislation as it relates to smokingrelated residential civilian fire deaths, civilian fire injuries, and fire incidents. Functional fixedness is a cognitive function whereby an individual becomes fixated on a given function of an object, which prevents the individual from using the object in an alternative fashion to solve a problem (Duncker, 1935/1945). The current study analyzed the effect of functional fixedness on 36 children from three different age groups, preschool, second grade, and ninth grade. The children were presented with a problem solving activity based on a problem used by German and Defeyter (2000), in which they concluded that young children are immune to the effects of functional fixedness. The enhancement of existing plant breeding techniques, such as cisgenesis, allows plant breeders to enhance an existing cultivar quicker and with little to no genetic drag. Cisgenesis is the genetic modification of a recipient plant with natural gene(s) from a sexually compatible plant. Unlike transgenesis, which is the genetic modification of a recipient plant with gene(s) from any non‐plant organism, or from a donor plant that is sexually incompatible with the recipient plant, the results of cisgenesis could occur naturally over time. Virginia has undertaken a variety of actions to mitigate the emission of greenhouse gasses and adapt to climate related changes to our weather, wildlife, and sea level. However, these changes have not been undertaken in a coordinated fashion, nor have they been in clear response to the recommendations of any entity that has approached the problem of climate change as a whole. The Indiana House Enrolled Act 1481 (HEA-1481) requires that the Indiana Department of Transportation (INDOT) adopt final rules by December 31, 2014, for the issuance, fee structure and enforcement of permits for overweight divisible loads, fee structure of permits for loads on extra heavy duty highways, and fee structure of permits for overweight loads. On December 26, 2013, INDOT adopted the Emergency Rules regarding these items, as required by HEA-1481, effective January 1, 2014. Kebijakan pusat pelayanan kesehatan masyarakat (puskesmas) sebagai Badan Layanan Umum Daerah (BLUD) diimplentasikan untuk meningkatkan kualitas pelayanan kesehatan dasar. Kebijakan BLUD puskesmas telah diterapkan di Kabupaten Gianyar sejak tahun 2010 dan berlaku pada puskesmas perawatan maupun nonperawatan. Section 8 renters in the St. Louis area are highly segregated in poor neighborhoods. I recommend four local actions to increase housing choice for Section 8 renters: St. Louis City: Remove the special occupancy permit requirements for landlords who wish to rent through the Section 8 program. St. Louis City: Revise local fair housing ordinances to include Section 8 as an explicitly protected source of income. Lack of multi-dimensional, substantive research on city park systems has undermined the potential role of these public amenities in advancing urban sustainability goals. This study informs holistic policy, planning, and management of parks to balance the multiple goals of sustainability region-wide. A vision for a sustainable urban park system is introduced, informed by multidisciplinary thought and theory. This vision is then operationalized in the development of a quantitative method that examines four key dimensions of sustainability—physical, environmental, socio-economic, and built—across a citywide urban park system. The Supreme Court has stated that Congress must simply “lay down by legislative act an intelligible principle” to which the agency must conform. If this is done, a court will find the delegation of broad authority to the agency to be constitutional. There is, however, an open issue regarding whether the “intelligible principle” standard applies to delegations of authority that allow for the promulgation of both civil and criminal penalties. Although some research has examined the experiences of students with learning disabilities in Indian secondary schools (see Karande, Sholarpurwala, & Kulkarni, 2011; Karande, Mahajan, & Kulkarni, 2009), the role of policy in students’ transition into post-secondary education has been largely unexamined. A major goal for the health services research community is to provide evidence policymakers can use to improve the public’s health. However, it can be difficult to know what evidence policymakers want and how they decide what research to fund.
In order to understand where policymakers turn for evidence and how they make funding decisions amid fiscal and political constraints, AcademyHealth conducted a 3-part Fireside Chat series in the spring of 2014. In November 2014, CCSI and the Institute for Human Rights and Business co-convened a colloquium on policy, law, contracts, and sustainable development, with a particular focus on large-scale investments in the extractive industries and the agriculture sector. The colloquium provided an opportunity for practitioners to share information on their related work, as well as to reflect on current practices and remaining gaps regarding efforts to embed sustainability and human rights into large-scale deals. This outcome document provides a summary of the discussion, while its annex includes information on participants’ relevant programs, initiatives, and tools.
