Here Come The Nones! Pluralism And Evangelization After Denominationalism And Americanism, William L. Portier
Here Come The Nones! Pluralism And Evangelization After Denominationalism And Americanism, William L. Portier
Religious Studies Faculty Publications
This essay begins with a four-part overview of American Catholic history focused on the building and dissolution of an immigrant Catholic subculture. The final period, “Catholics and the Dynamics of Pluralism (1968-present)” leads naturally into a discussion of the demography of Catholics in the United States. Particular attention is given to the trend to disaffiliation among millennials and how best to interpret it. Pastoral and theological reflections on the demography of disaffiliation emphasize the need for the church in the United States to take on an evangelical form more suited to a pluralism that is post-denominational and post-Americanist, and how …
Terrorism And International Law: Cure The Underlying Problem, Not Just The Symptom, Sir Arnold K. Amet
Terrorism And International Law: Cure The Underlying Problem, Not Just The Symptom, Sir Arnold K. Amet
Annual Survey of International & Comparative Law
Terrorist activities are not of recent origin on the international plane. They have been around since the beginning of humanity. Although international law may not be accused of addressing the issue of terrorism with levity, it was after the 9/11 terrorist attacks on the United States that the international community’s efforts toward fighting terrorism garnered more strength and attention.
The debatable critical question is whether terrorism under international law should be studied and treated as a specific subject in developing the legal norms and principles for its fight and regulation, or whether terrorism should be fought and regulated based on …

On Lawyers And Moral Discernment, Robert E. Rodes

Drawing on Jacques Maritain's doctrine of Knowledge through Connaturality, and on other authors including David Hume and Edmond Cahn, this article argues that judgments of right and wrong are arrived at primarily through immediate discernment, and only secondarily through the application of general principles. It is possible, therefore, for lawyers and clients to arrive at agreement on how to handle their cases, even though they do not agree on the general principles that apply.

Universal Goals & Local Application: Theological Field Education At St. John Vianney Seminary, Germaine Bruno
Universal Goals & Local Application: Theological Field Education At St. John Vianney Seminary, Germaine Bruno
Electronic Theses and Dissertations
This study presents a curriculum history of theological field education at Denver's Roman Catholic seminary, St. John Vianney. The study utilizes archival material and the historical method to construct an educational historiography of the evolution and development of theological field curricula from 1910-2010. The research questions focus on two areas: the role of the Catholic Church in shaping seminary curricula and the adaptation and application of these Church guidelines by practitioners in the local context.
The study utilizes the conceptual tools of Kelly Ritter (2009) to analyze the findings in the light of socio-historical forces which shape curricula. According to …
Voices In The Wilderness: Catholic Ngos And The Challenge Of Human Rights, Kevin Ahern
Voices In The Wilderness: Catholic Ngos And The Challenge Of Human Rights, Kevin Ahern
Biennial Conference: The Social Practice of Human Rights
For over fifty years, Catholic nongovernmental organizations have been actively engaged in the promotion and protection of human rights around the world. From grassroots training programs to targeted advocacy work in Geneva, these organizations are helping to shape both scholarly discourse and political policy.
Given the growing role played by civil society actors, this paper will critically consider the ethical and theological significance of human rights NGOs, in particular Catholic organizations, in three parts. It will begin with a brief sketch of the present reality and historical relationship of Catholic NGOs to the human rights movements. Following Vatican II and …
Targeting And The Concept Of Intent, Jens David Ohlin
Targeting And The Concept Of Intent, Jens David Ohlin
Cornell Law Faculty Publications
International law generally prohibits military forces from intentionally targeting civilians; this is the principle of distinction. In contrast, unintended collateral damage is permissible unless the anticipated civilian deaths outweigh the expected military advantage of the strike; this is the principle of proportionality. These cardinal targeting rules of international humanitarian law are generally assumed by military lawyers to be relatively well settled. However, recent international tribunals applying this law in a string of little-noticed decisions have completely upended this understanding. Armed with criminal law principles from their own domestic systems, often civil law jurisdictions, prosecutors, judges and even scholars have progressively …

Applying The Principle Of Double Effect, Andria E. Quirindongo
Applying The Principle Of Double Effect, Andria E. Quirindongo
CedarEthics Online
When ethical conflicts arise in clinical cases, physicians may need specific guidelines to help justify the decisions they make for the best interest of their patients. One such guideline is the principle of double effect (PDE), employed in terminally ill patients. Palliative care physicians look to the PDE when a single action for a terminal patient has two known effects: a desired and intended result and an unintended, yet foreseeable one (Schwartz, 2004).
Jordanian Ethical Perceptions Of Preimplantation Genetic Diagnosis, Sarah C. Miller
Jordanian Ethical Perceptions Of Preimplantation Genetic Diagnosis, Sarah C. Miller
Independent Study Project (ISP) Collection
Preimplantation Genetic Diagnosis (PGD) is a procedure that can be done during In Vitro Fertilization (IVF), involving genetic and chromosomal screening of fertilized embryos prior to implantation into a woman’s uterus. After PGD, only the embryos possessing the desired characteristics are implanted, while the other embryos are frozen for future use, or discarded. PGD is used for family balancing (gender selection for balancing the gender dynamic within a family), gender selection to screen out sex-linked diseases, or a broader genetic screening for diseases known to be present in the patient’s family history.
Many ethical questions have been raised about PGD, …
