Both antitrust and IP law are limited and imperfect instruments for regulating innovation. The problems include high information costs and lack of sufficient knowledge, special interest capture, and the jury trial system, to name a few. More fundamentally, antitrust law and intellectual property law have looked at markets in very different ways. Further, over the last three decades antitrust law has undergone a reformation process that has made it extremely self conscious about its goals. While the need for such reform is at least as apparent in patent and copyright law, very little true reform has actually occurred.

Project teams that deliver high risk, complex projects in the civil construction industry need tools to enable successful delivery. Construction Manager/General Contractor (CM/GC) is an innovative alternate delivery method, providing one such a tool. CM/GC furnishes public agencies with an attractive option for delivering projects in a less adversarial and more constructive manner by involving the contractor during design. The sophisticated public owner does not have to relinquish control of the details of the design in order to accelerate the schedule or see the benefits of real-time cost estimating data. Research and educational efforts related to space engineering or requiring access to space face significant startup costs. The cost of developing a 1-U (10 cm × 10 cm × 11 cm) CubeSat from scratch can be approximately $250,000. Those buying a kit must pay amortized vendor development costs on a per-mission basis, creating a lower per-mission barrier. Kit users are also constrained by being unable to make changes to vendor subsystems without incurring substantial redevelopment costs or vendor charges. This exploratory research examined levels of innovation adoption among Juvenile Court Officers (JCOs) in a Midwestern state. The researcher applied Dr. Everett M. Rogers’ Diffusion of Innovation model as the study’s framework. According to Rogers (2003), innovation is “an idea, practice or object that is perceived as new by an individual or other unit of adoption” (p. 475). The study sought to determine the extent that demographic and work-life variables such as gender, office location, caseload, years of service, personality/temperament and employee engagement contributed to levels of innovation adoption by JCOs. On October 26, 2012, the University of Akron School of Law’s Center for Intellectual Property and Technology hosted its Sixth Annual IP Scholars Forum. In attendance were thirteen legal scholars with expertise and an interest in IP and public health who met to discuss problems and potential solutions at the intersection of these fields. This report summarizes this discussion by describing the problems raised, areas of agreement and disagreement between the participants, suggestions and solutions made by participants and the subsequent evaluations of these suggestions and solutions.

Concerns about a dearth of antibiotic innovation have spurred calls for incentives to speed the development of new antibiotics. Our data demonstrates that many of the new molecular entity (NME) antibioticsintroduced in the last 3 decades were withdrawn from the market, at more than triple the rate of other drug classes. Adjusted for these withdrawals, the net introduction of NME antibiotics is not as troubling of a trend. The reduction in NME antibiotics was partially offset by a surge in the introduction of NME antiretrovirals for HIV/AIDS and other drug classes (such as cardiovascular drugs) posted similar declines.

Methods for Extension personnel to engage clientele are developing rapidly. Social media and online content are used by eXtension members to generate information and deliver it quickly. These methods are found useful by information consumers; however, many universities fail to adequately address them in the promotion and tenure process. Engaged eXtension members understand the importance of using digital methods, yet career value of the effort is unclear. This ambiguity has caused participation issues within eXtension Communities of Practice. A new examination of how Extension content is valued by the consumer and by colleagues within the academic arena is warranted.

In Federal Trade Commission v. Actavis, Inc., the Supreme Court provided fundamental guidance about how courts should handle antitrust challenges to reverse payment patent settlements. The Court came down strongly in favor of an antitrust solution to the problem, concluding that “an antitrust action is likely to prove more feasible administratively than the Eleventh Circuit believed.” At the same time, Justice Breyer’s majority opinion acknowledged that the Court did not answer every relevant question. The opinion closed by “leav[ing] to the lower courts the structuring of the present rule-of-reason antitrust litigation.”

More than a transitory historical phase, these changes represents a fundamental transition between paradigms (Kuhn, 1962). Academic libraries and librarianship are moving from a paradigm focused on collections and books to a paradigm focused on learning. In the United States responsibility for innovation policy and competition policy are assigned to different agencies with different authority. The principal institutional enforcers of patent policy are the United States Patent and Trademark Office (USPTO), the International Trade Commission (ITC), and the federal district courts as overseen by the United States Court of Appeals for the Federal Circuit, and ultimately the Supreme Court. While competition policy is not an explicit part of patent policy, competition issues arise frequently, even when they are not seen as such.

In this case study, we researched one cohort from the Center for Animation, a higher education teaching environment that has successfully fostered group creativity and learning outcomes through problem-based learning. Through live and videotaped observations of the interactions of this community over 18 months, in addition to focused interviews with nine key community leaders, we considered the evaluative culture and actions of this community, and how these evaluative practices improved their creative problem solving. Current theories of how organizations harness knowledge for innovative activity cannot convincingly explain emergent practices whereby firms selectively reveal knowledge to their advantage. We conceive of selective revealing as a strategic mechanism to reshape the collaborative behavior of other actors in a firm's innovation ecosystem. We propose that selective revealing may provide an effective alternative to known collaboration mechanisms, particularly under conditions of high partner uncertainty, high coordination costs, and unwilling potential collaborators. We specify conditions when firms are more likely to reveal knowledge and highlight some boundary conditions for competitor reciprocity. We elaborate on strategies that allow firms to …

This paper examines how the resources of the Line of Business (LB) Program of the U.S. Federal Trade Commission (FTC) leveraged academic research to develop understanding of science and technology policy and to point to new directions for both research and policy. The paper provides an overview and discussion of the birth and death of the FTC LB Program and its unique LB data, the innovation research using the LB data, and the legacy of the program.

The "Hope Comes to Watts" program is designed to provide a 3-week May Term experience in Los Angeles, California. Students study the cultural, historical and geographical setting as well as complete pertinent readings to prepare for full-day placements in the Watts Learning Center, a public, charter school setting with elementary and middle school campuses. The Hope College students are paired one-on-one with classroom teachers and/or administrators and are fully immersed the day-to-day life of the school. They also participate in a variety of cultural and service opportunities during this experience.

State Incentives For Innovation, Star Scientists, And Jobs: Evidence From Biotech, Enrico Moretti, Daniel J. Wilson

We evaluate the effects of state-provided financial incentives for biotech companies, which are part of a growing trend of placed-based policies designed to spur innovation clusters. We estimate that the adoption of subsidies for biotech employers by a state raises the number of star biotech scientists in that state by about 15 percent over a three-year period. A 10 percent decline in the user cost of capital induced by an increase in R&D tax incentives raises the number of stars by 22 percent. This paper investigates the role of Intellectual Property Rights (IPR) protection and Environmental Policies (EPs) on clean (renewable) and dirty (fossil-based) technology diffusion from top-innovators. IPR protection and EPs are extensively debated policy tools, as IPR protection addresses knowledge market failure, while EPs respond to pressing local and global environmental externalities. A model of monopolistic competition inspired by the recent trade literature shows that the profits associated with exporting a blueprint are a function of the quality of the idea and of market and institutional characteristics of the receiving country. Firms are increasingly employing social media to manage relationships with partner organizations, yet the role of institutional pressures in social media assimilation has not been studied. We investigate social media assimilation in firms using a model that combines the two theoretical streams of IT adoption: organizational innovation and institutional theory. The study uses a composite view of absorptive capacity that includes both previous experience with similar technology and the general ability to learn and exploit new technologies.
