This chapter is an invited contribution to the first English-language comparative study of subsidiarity, M. Evans and A. Zimmerman (eds.), Subsidiarity in Comparative Perspective (forthcoming Springer, 2013). The concept of subsidiarity does work in many and varied legal contexts today, but the concept originated in Catholic social doctrine. The Catholic understanding of subsidiarity (or subsidiary function) is the subject of this chapter. Subsidiarity is often described as a norm calling for the devolution of power or for performing social functions at the lowest possible level. In Catholic social doctrine, it is neither. Intellectual Strangers No More? Peter Singer And Roman Catholicism On Ecological Concern, Charles C. Camosy

Claritas: Journal of Dialogue and Culture

Peter Singer’s approach to ethics as a utilitarian preference seems to have little to say to Christian ethics. But for a host of important issues, and in particular for those related to ecological ethics, this article argues that this perception is fundamentally mistaken. When comparing Singer’s views to a Roman Catholic approach, we find that their disagreement with regard to ecological concern, though significant and important to address, is surprisingly narrow—limited to topics such as intrinsic value and overpopulation. Over time, the definition of family has shifted from being premised upon kinship to legal status. In modern times, family structure is based more upon function than form, seeking to derive its status as a family from the subjective intent of its members to act as a family. Many early settlers in the colonial territories came to America to escape religious persecution and practice their own religion.

Sexism In Practice: Feminist Ethics Evaluating The Hookup Culture, Conor M. Kelly

Hooking up—the practice of pursuing sexual activity without any expectation of a relationship—has become a fixture of the U.S. college experience, resulting in an identifiable hookup culture across the country that can and should benefit from a feminist analysis. Sociological research reveals that this practice appeals to college students by ostensibly providing greater independence than traditional relationships. An outside analysis of these claims, however, demonstrates that the heterosexual hookup culture operates in a decidedly sexist fashion. In fact, the four common features of this culture: lack of commitment, ambiguous language, alcohol use, and social pressure to conform, all undermine the …

This article reveals how St. John’s University implemented mission-focused programs to advance its unique Catholic perspective, that of the Vincentian tradition to serve the poor and remedy social inequities. Heeding the 1986 call of Pope John Paul II to Vincentian institutions, all levels of the university from incoming freshmen to the board of trustees have embraced the Pope’s message to serve the poor and needy. Major program initiatives have included an expanded and enriched academic service-learning (ASL) program with a Discover New York service component for all incoming freshmen; the creation of a Vincentian Institute for Social Action to coordinate …

The ability to harness energy is fundamental to economic and social development. Worldwide, almost 3 billion people have little or no access to beneficial energy resources for cooking, heating, water sanitation, illumination, transportation, or basic mechanical needs. Energy poverty exacerbates ill health and economic hardship, and reduces educational opportunities, particularly for women and children. Specifically, access to efficient and affordable energy services is a prerequisite for achieving the Millennium Development Goal (MDG) relating to poverty eradication.

What's A Just War Theorist?, Aleksandar Jokić

Philosophy Faculty Publications and Presentations

The article provides an account of the unlikely revival of the medieval Just War Theory, due in large part to the efforts of Michael Walzer. Its purpose is to address the question: What is a just war theorist? By exploring contrasts between scholarly activity and forms of international activism, the paper argues that just war theorists appear to be just war criminals, both on the count of aiding and abetting aggression and on the count of inciting troops to commit war crimes.

Han Solo and Luke Skywalker have a debate. Luke is learning to use and trust the invisible Force, which he believes binds the galaxy together. Han thinks hokey religions are no match for a good blaster. This debate bears on law’s legitimacy and objectivity. Law’s legitimacy depends on law’s objectivity. But before we can ask whether law is objective, we need to define legal objectivity. This article argues for a reason-based conception of legal objectivity.
