Environmental Justice, Community Empowerment, And The Role Of Lawyers In Post-Katrina New Orleans, Janell Smith, Rachel Spector

City University of New York Law Review

Working together toward a common goal often requires mobilizing the strength and energy of many groups of people, all of whom share the same passion for accomplishing that goal. Hurricane Katrina and its devastating effect on the environment and communities in New Orleans and the Gulf Coast has done exactly that, bringing together numerous coalitions of concerned individuals who share the determination to clean up and improve New Orleans and the Gulf region. This Article addresses how lawyers from around the country can work with local advocates on reconstruction efforts in New Orleans in a way that increases, rather than …

Law And Public Policy Support Lockyer's Suit Against Auto Manufacturers For Co2 Emissions, Clifford Rechtschaffen, Sean B. Hecht Dec 2006

Law And Public Policy Support Lockyer's Suit Against Auto Manufacturers For Co2 Emissions, Clifford Rechtschaffen, Sean B. Hecht

Publications

Controversy has followed Attorney General Bill Lockyer’s decision earlier this fall to sue the six largest automakers, alleging that car emissions constitute a public nuisance because they contribute to global warming. Some even have dismissed the lawsuit as election year grandstanding. To the contrary, the Attorney General should be applauded for creatively using a venerable legal tool to protect California’s environment and to plug a gaping hole left by federal failures in this area.

Costing Schizophrenia, Ciorstan J. Smark Dec 2006

Costing Schizophrenia, Ciorstan J. Smark

Faculty of Commerce - Papers (Archive)

This article looks at a particular subset of mental illness in Australia: schizophrenia, and reflects on how the direct costs that fall within the parametres of the health budget are privileged (inscribed), compared to how indirect costs that fall outside this boundary fail to be inscribed appropriately. This article concludes that, from a social accounting point of view, this boundary is arbitrary and an example of poor accounting.

Understanding Environmental Concerns And Contexts: A Multilevel Exploration Of Economic, Social And Natural Environment Contexts On Environmental Concerns, Sean Thomas Huss Dec 2006

Understanding Environmental Concerns And Contexts: A Multilevel Exploration Of Economic, Social And Natural Environment Contexts On Environmental Concerns, Sean Thomas Huss

Doctoral Dissertations

That social, economic, and environmental context affect human attitude and agency is a central yet untested assumption in much of sociology. The effect of context on individual attitudes is particularly important when considering how and when environmental policy gains support from the public. Drawing on Ecological Modernization and Economic Contingency theories, this dissertation investigates the influence of economic, social, and pollution contexts on environmental concerns. These theoretical perspectives suggest that failure to protect the environment is a function of political processes that privilege economic concerns over environmental concerns. Drawing on literature indicating that periods of economic growth function as windows …

Linking Global Warming To Inuit Human Rights, Marguerite E. Middaugh Nov 2006

Linking Global Warming To Inuit Human Rights, Marguerite E. Middaugh

San Diego International Law Journal

Under international law, the United States government has violated the Inuit's human rights by failing to take action against climate change. The Inter-American Commission on Human Rights should find that the allegations of human rights violations by the Inuit are justified and rule in their favor. This Article first explores the impacts of climate change on the Inuit and each of the Inuit's basic human rights, which are implicated by the environmental changes. Next, the role and responsibility of the U.S. with respect to climate change is examined. This section discusses the current attitude and actions of the U.S. government, …

Environmental Education And A Proposal For Its Implementation In Public Schools, Casey Putnam Nov 2006

Environmental Education And A Proposal For Its Implementation In Public Schools, Casey Putnam

MALS Final Projects, 1995-2019

Human impact on nature has led to global environmental destruction and degradation. Young people are not environmentally knowledgeable, and they are not receiving the type of instruction they need in order to be environmentally literate citizens. In order to repair some of the damage that has been done and to diminish future impact, environmental education must be thoroughly and thoughtfully incorporated into people's lives.

Environmental education has existed, in various forms, for nearly a century as, at best, a supplement to "real education." Rather than being a fringe subject, environmental education warrants attention in American education that is equal to …

Protecting The Future Forever: Why Perpetual Conservation Easements Outperform Term Easements, Paul Mitchell Oct 2006

Protecting The Future Forever: Why Perpetual Conservation Easements Outperform Term Easements, Paul Mitchell

Land Use Clinic

Conservation easements are amassing increasing popularity as a private means for accomplishing a public good. In 1980, conservation easements protected 128,001 acres. By 2003, that number had jumped to over 5 million acres. In Georgia, over 131,000 acres had been protected by conservation easements by the end of 2005, more than double the acreage of just a few years before.

A conservation easement is a legal arrangement whereby a landowner chooses to transfer certain development rights to an eligible easement holder, usually a non-profit or government agency, in order to achieve a qualified purpose. The landowner can sell or donate …

Environmental Injustice In Ecuador: Endangered Indigenous Populations And Environmental Degradation, Clover Anneire Muters Oct 2006

Environmental Injustice In Ecuador: Endangered Indigenous Populations And Environmental Degradation, Clover Anneire Muters

WWU Honors College Senior Projects

Nationally and globally there is a widening disparity between the rich and poor which is reflected at every level of society. Environmental injustice is a term to describe the unjust way that natural resources are allocated, and the very real phenomenon of a disproportionate amount of the negative consequences of environmental degradation being placed on those populations that are poor and underrepresented. This paper will address this situation in Ecuador, and specifically, the connection between the environmental degradation of one of the most biologically diverse places in the world, and the destruction of indigenous and repressed populations who have lived …
