On October 15, 2005 an Iraq ravaged by a civil war spawned by the 2003 American invasion and subsequent occupation voted to decide the fate of a permanent constitution for the country. Although many Sunni Arabs took part in the vote, the referendum lost in the three governorates where they form a majority. But the constitution was approved because opponents only succeeded in recording "no" votes larger than two-thirds in only two of Iraq's eighteen provinces, in effect one province short of a veto. The GWOT/Global Jihad is different from prior conflicts (including the ideological struggle of the Cold War), and these differences have important strategic consequences which are not reflected in current US policy. First, US strategy has proceeded on traditional, and inapposite, understandings of the politics that informs this war. Second, radical neofundamentalism is a new form of political organization, attuned to a globalized world, with a distinctive form of violence quite different from the violence organized by the bureaucratic apparatus of a modern professional military grounded in a nation state. Decades of internal conflict, a history overtaken with war and a delicate new government put Iraq in the midst of an explosive-remnants-of-war situation that is worsening as the security situation continues to deteriorate. The country's unstable nature poses a challenge for organizations that wish to provide much needed humanitarian assistance. Conflicts between ethnic and political parties, the Iran-Iraq War of the 1980s, the 1991 Persian Gulf War and the more recent U.S.-led invasion in 2003 left the country's 169,234 square miles (438,314 square meters) riddled with landmines, unexploded ordnance and abandoned explosive ordnance.

This monograph considers the issues of Iranian influence in Iraq, and its impact on continuing sectarian violence there. It also questions the claims that a Shi'a crescent of power is solidifying by examining the distinct features of Iraqi versus Iranian Shi'ism and political Islam. Iran and Iraq have historically influenced and threatened each other. Today, the situation has been further complicated by the post-2003 change in the Iraqi Shi'a community’s status, Iran's development of a nuclear program, and international efforts to contain that program. These issues are now influenced by a new pattern of Iraqi-Iranian, U.S.-Iraqi and Iranian-U.S. dynamics. This …

In their article “Success Matters: Casualty Sensitivity and the War in Iraq,” Christopher Gelpi, Peter Feaver, and Jason Reifler attempt to flush out the relationship between public opinion and the use of force as it pertains to the Iraq war.1 The authors promote the following proposition: “Our thesis is that expectations of future success are the key determinants of public casualty tolerance. American Soldier, Jeremy Hinzman, deserted his Iraq bound unit in 2003 and fled to Canada where he now seeks asylum with his wife and young son. The legal implications of his case are explored against the background of the American and Canadian political landscapes. Private Military Companies (PMCs) are civilian staffed corporations that provide military (and law enforcement) services, logistics, and support under contract to a government both inside and outside the country’s borders. Prior to Congress passing the Military Extraterritorial Jurisdiction Act, U.S. courts lacked jurisdiction to prosecute civilians accompanying United States’ Armed Forces overseas. This article will specifically address how the United States exercises jurisdiction and prosecutes the civilian employees of PMCs in United States courts for crimes they have committed in foreign countries while working under contract to the United States government.

This study analyzes the framing of the war in Iraq (2003) during the week before and the week after the conflict started according to the media coverage of nine leading newspapers from United States, Europe, and Latin America. Through quantitative content analysis, the researcher answered seven research questions and analyzed the framing, sources, and approaches used by the newspapers in the news coverage of the conflict. The researcher compared the news coverage of each region and found that there were significant differences in the content of the war reporting according to the geographical area of the media. The paper focuses on Saddam Hussein’s trial in front of the Iraqi High Criminal Court in Baghdad. After providing an overview of the facts surrounding the court’s installation, the applicable international law is identified and the fairness and legitimacy of the current proceedings are analyzed. The paper finishes by considering whether the trial should be relocated and addresses alternative venues that could have been chosen to prosecute Iraq’s ex-dictator.
