This Article investigates the nature of the right to property guaranteed under the First Protocol to the European Convention on Human Rights ('P1-1'). It argues that the European Court of Human Rights has been torn between two theories of the right to property. The first is the "integrated theory", and it holds that the right to property shares common values and purposes with other Convention rights. Hence, the interpretation of P1-1 should reflect principles developed in the interpretation of other Convention rights. It is argued that the application of the integrated theory should support a "social model" of property. The …

We studied the safety and efficacy of 0 U, 50 U, 100 U, 150 U (five sites), 86 Usub and 100 Usub (three sites) botulinum toxin type A (BoNTA; BOTOX); Allergan, Inc., Irvine, CA, USA) for the prophylaxis of chronic tension-type headache (CTTH). Three hundred patients (62.3% female; mean age 42.6 years) enrolled. For the primary endpoint, the mean change from baseline in the number of TTH-free days per month, there was no statistically significant difference between placebo and four BoNTA groups, but a significant difference favouring placebo vs. BoNTA 150 was observed (4.5 vs. 2.8 tension headache-free days/month; P …

This article discusses, in light of the European experience concerning harmonization of unfair commercial practices law, the impact of social, cultural, and linguistic variations on the possibility of harmonizing or transplanting rules on commercial communications to consumers. Empirical research on national variations in consumers' responses to advertising and other marketing is used to create a typology of cases in which cultural factors should be taken into account when assessing a commercial practice from a consumer point of view. Differences between countries with regard to consumers' trust, understandings, rationality patterns, decision-making behaviour, values, and preferences are discussed as relevant cases. The …

The chapter evaluates the role of strategic HRM for a firm's efficiency as well as effectiveness of nearly 3000 European enterprises (using Cranet 2001 data). A sound positive effect of the strategic orientation of management, including high variety of HRM practices, on efficiency and effectiveness of enterprises in the market sector was found in majority of dynamic European environments (especially in Scandinavia), except in Mediterranean countries and Slovenia.

In its six sections, this Article examines the role of Speakers, the nexus between their many duties and powers, possible points of conflict among their different duties, as well as the connection between their official duties and personal interests. This Article takes the role of the Speaker of the Israeli Parliament as its organizing principle. Sections Two and Three discuss the constitutional underpinnings of conflicts of interest and the way in which these apply to Members of the Knesset. In 2006, NATO is operating well out of area and conducting missions beyond the collective defense limits of its founding Treaty. NATO increasingly supports humanitarian relief operations, while also engaged in Afghanistan, the Mediterranean, and African crisis spots.
These changes provide the reason to examine the thesis: only if NATO is able to effectively transform will it be able to continue in its role as the primary European security institution. There has been widespread discussion of Russia's efforts to exploit its energy assets to influence developments in Ukraine; specifically, to put pressure on the leaders of the Orange Revolution who have adopted a Western orientation, rather than one toward the East—Russia. Psychology, in a general sense, is age-old, extending back across all cultures to the beginnings of recorded time. The healing arts of ancient doctors and the conceptual musings of ancient sages often pointed toward factors that would be considered psychological today. Nevertheless, psychology in its specifically modern sense dates from the second half of the nineteenth century, when a self-consciously scientific, academic, professional discipline took shape in Europe and North America. Examines the possibility of applying the truth commission model in Northern Ireland where the past plays a significant role in shaping daily lives & worldviews. A review of the theory & practice of truth commissions is followed by a description of Northern Ireland's long & complex conflicts that point to the need for some form of truth-seeking. Attention is given to the difficulties such a process would face. This paper reports on the transport of ozone (O3) and related species over the North Atlantic ocean and its impact on Europe. Measurements of nitrogen dioxide (NO2) and carbon monoxide (CO) columns from the GOME and MOPITT satellite instruments, respectively, are used in conjunction with the GEOS-CHEM global model of transport and tropospheric chemistry to identify the major events of long range transport that reach Europe over the course of summer 2000. Sensitivity model simulations are used to analyse observed O3 distributions with respect to the impact of long range transport events. For that purpose, …

This paper describes the European Bologna process, provides a ‘mid-term’ review of its implementation status and discusses its possible positive and negative impacts on US – European links in the fields of engineering and technology education. The first section of this paper describes the meaning and rationale behind each of the Bologna objectives, and why there is a need to establish a European area of higher education. Purpose – To develop and test a reliable and valid supplier selection measurement scale that can be applied in different geographic regions, namely, the USA and Europe. Design/methodology/approach – A three-factor supplier selection measure is developed via extensive literature review and practitioner interviews. Psychometric properties of the survey instrument are evaluated using data from the ISM-US sample via exploratory factor analysis. Based on the results, the survey instrument is modified and the revised instrument is mailed to a larger sampling group (APICS-US and APICS-Europe). Four skulls, three lower jaws, a few incomplete postcranial bones and many coprolites of the early Late Pleistocene (Early Weichselian, 90,000 – 65,000 BP) ice age spotted hyena open air prey deposit site Biedensteg at Bad Wildungen (Hessia, NW-Germany) all show crack-, bite- and nibbling-marks as a result of cannibalism. Originally, the bones belong to three young adult to adult individuals. For the first time in Europe, a skull and postcranial bones belonging to a young animal of C. c. spelaea (Goldfuss 1823) of only a few days or weeks old are described and figured. The animal was possibly killed …

This chronicle describes the events concerning the retreat of Field Marshal Walter Model’s Army Group B from the invasion of Normandy in June, 1944 to it’s ultimate destruction in the Ruhr Pocket in April, 1945. The author focuses on the German perspective of the Second World War, and describes the experiences of former Wehrmacht soldiers, Volkssturm conscripts, Hitler Youth members, and civilians as they witnessed the collapse of the Third Reich. The study encompasses events in northwest Germany, primarily in the lower Rhineland and the Ruhr Valley, as Model’s army group was encircled and destroyed by Allied forces. Detailed accounts …

Maruja Mallo's life (1902-1995) and art represent one woman's odyssey from the European vanguards to political commitment during the Spanish Republic (1931-1939) and finally to a unique transcendent art form after her wrenching exile from Spain and her residence in Latin America from 1937 to 1965. In her early career she was a leader among the avant-garde painters when few Spanish women were recognized as creative artists. In Latin America, her work diverged radically from European avant-garde trends and from her ideologically oriented subject matter of the 1930s; Mallo not only reflects the impact of her discovery of the Pacific …

This paper reviews the recent history of civil litigation in England and Wales. While previous work by Professor Kritzer has shown an absolute decline in trials over the last fifty years, with some fluctuation around this trend, this comment suggests that this may now have bottomed out. Given the evidence of a simultaneous, and continuing, decline in the number of claims filed, it may even be the case that trials are, at least temporarily, playing a larger part in the civil justice system than they have for many years. Past research, with its emphasis on affective regulatory processes, has failed to find cross-cultural differences in counterfactual thoughts. In the current study, the authors examine the tendency to generate additive counterfactuals (those that focus on the addition of new aspects that were not in fact present) and subtractive counterfactuals (those that focus on subtraction of factual aspects) among Mainland Chinese and European American university students in five life domains: schoolwork, romantic relationships, family relationships, friendships, and life in general. As in previous studies, the authors find an overall main effect, in which additive counterfactuals predominate over subtractive counterfactuals within both …
