Bail Agents And Bounty Hunters: Adversaries Or Allies Of The Justice System?, Brian Johnson, Greg Warchol

Bounty hunters are employed by the bail industry to locate and apprehend criminal defendants who “skip” bail and, subsequently, fail to appear for court appointments. While some scholars have examined bounty hunters, this work is concerned primarily with the origins, history, and legal challenges to the industry and its practices. Popular literature on this subject has created the “myth” of the bounty hunter, but it has failed to provide an accurate portrayal of the activities these individuals perform. Through the use of field research methods, this study provides a better understanding of the role that bail agents and bounty hunters …

The Concept Of Social Exclusion And Rural Development Policy, F. Dale Parent, Bonnie L. Lewis

Since the early 1970s rural research and public education programs have been intensified in efforts to improve living conditions and strengthen community life in rural America (Southern Perspectives 2000). During much of the 1990s, the nation, including the rural South, experienced a growing economy, a booming stock market, and declining unemployment rates (Gibbs 2001). However, many serious social problems traditionally associated with the rural South remain to this day (Gibbs 2001). Prosecuting Martha: Federal Prosecutorial Power And The Need For A Law Of Counts, Michael L. Seigel, Christopher Slobogin

Martha Stewart's case illustrates a wide variety of prosecutorial decision-making. We have defended the U.S. Attorney's decision to investigate and prosecute Stewart, but called into question the further decision to charge her with five counts. As a way of curtailing the redundant charging phenomenon, which is widespread, we have suggested that the courts develop a law of counts to cabin prosecutorial charging discretion. Thus, our proposal to create a law of counts would not require prosecutors to act against their short- or long-term interests. Rather, it would be implemented by judges using the interpretive method, without going so far as …

The Self-Incrimination Clause Explained And Its Future Predicted, Ronald Jay Allen, M. Kristin Mace
Public Law and Legal Theory Papers
Like many areas of the law, the Fifth Amendment has defied theoretical explanation by scholars. We examine whether the fifth amendment cases can be explained with a relatively simple theory, and find that they can. The key to that theory is the recognition that, although never acknowledged by the Court, its cases make plain that "testimony" is the substantive content of cognition - the propositions with truth-value that people hold or generate (as distinct from the ability to hold or generate propositions with truth-value). This observation leads to a comprehensive positive theory of the Fifth Amendment right: the government may …

Race, Religion, And Attitudes Toward Capital Punishment: A Test Of Attribution Theory, Sheila M. Schlaupitz

The present study attempts to provide a more thorough understanding of public attitudes toward capital punishment. Two theories are tested toward this end, utilizing a random sample taken from the jury pool in Hillsborough County, Florida.
First, An indirect test of reference group theory demonstrates the degree to which faith group, religiosity, and race affect public attitudes toward the death penalty. Surprisingly, there is little, albeit mixed, support for reference group theory as it attempts to explain attitudes toward capital punishment. Using the relationships between religion and capital punishment attitudes that we presumed would emerge from the test of reference …

Police Officers' Perception Of The Validity Of The General Theory Of Crime., William Jaison Giesler
Electronic Theses and Dissertations
This study measured police officers perception of the validity of General Theory of Crime. Using a sample of 117 officers and an adapted version of the Grasmick et al. (1993) self-control scale, this study measures the level of agreement officers exhibit that low self-control traits are present in property and violent offenders. Measurement is also performed to determine variation in officers agreement based on the personal characteristics gender, age, education, experience, and rank.
Findings indicate officers show agreement with self-control items across the six dimensions of self control traits, as well as significant variation in agreement with the property offender …

Using The Survey Of Inmates Of State And Federal Correctional Facilities To Compare Female And Male Inmate Characteristics., Jacqueline Anita Black
Electronic Theses and Dissertations
The purpose of this study was to examine the differences between female and male prison inmates using the Survey of Inmates of State and Federal Correctional Facilities, 1997. Variables examined included current offense, criminal history, drug use history, victimization history, program participation in the institution, disciplinary infractions in the institution, family history, and interaction with family while in prison. Results indicate that male inmates have worse criminal histories and longer sentences than female inmates. Female inmates have more extensive drug use histories, greater victimization histories, more program participation in the institution, and more criminality in their families of origin than …
