Introduction And Symposium Overview: The Changing Labor Markets Of The Western Hemisphere: Labor Issues Relating To The Ftaa, Ann C. Hodges

Law Faculty Publications

In 1994, thirty-four countries in the Western Hemisphere met in Miami to begin negotiations designed to establish a comprehensive free trade agreement. The initial meeting led to a "Declaration of Principles" and a "Plan of Action" which committed the signatory countries to take steps toward open markets and free trade in the hemisphere. Subsequent meetings in 1998 and 2001 have moved the countries toward creation of the Free Trade Area of the Americas (FTAA), with an expectation that the agreement will be in place by 2005.

The State Goes Home: Local Hyper-Vigilance Of Children And The Global Retreat From Social Reproduction, Cindi Katz Oct 2001

The State Goes Home: Local Hyper-Vigilance Of Children And The Global Retreat From Social Reproduction, Cindi Katz

Publications and Research

In an early scene in The Terminator, the Cyborgian Arnold Schwarzenegger walks into an L.A. gun shop and asks to see the wares. The shopkeeper lays out Uzis, submachine guns, rocket launchers, and other sophisticated means of overkill, nervously understating, "Any one of these will suit you for home defense purposes." The situation is likewise in the growing child protection industry. In keeping with the shopkeeper's sly comment, these businesses feast on an all-pervasive culture of fear, while creating a mockery, alibi, and distraction out of what they are really about - to remake the home as a citadel through …

Universal Mother : Transnational Migration And The Human Rights Of Black Women In The Americas, Hope Lewis Sep 2001

Universal Mother : Transnational Migration And The Human Rights Of Black Women In The Americas, Hope Lewis

Hope Lewis

Community-based or personal forms of identity, as well as some externally imposed gender, race, and cultural stereotypes operate simultaneously to influence global markets. This Article explores the human rights implications of the stories surrounding a female migrant household worker as they exemplify how perceptions about identity can shape legal responses and how legal frameworks can shape perceptions of identity. The identities associated with the migrant household worker seemed to constitute a uniquely complex illustration of the intersection of race, gender, ethnicity, class, immigration status, nationality, and disability. However, the stories establish that all identities can be equally complex. This Article …

Reevaluating U.S. Intellectual Property Right Policy In The Face Of Globalization: Moving Beyond Trips And Special 301, Warren Jr. Newberry

Honors Theses

In this paper, I intend to expand upon Mastanduno's ground-breaking inquiry by analyzing the motivating factors behind the behavior of the United States in its attempt to establish and maintain an international intellectual property rights regime. The international intellectual property rights system, established at the 1994 Uruguay Round of GATT, represents an international agreement with unprecedented reach into domestic state affairs. This ambitious attempt at establishing a high international norm of intellectual property protection was created as a result of inflexible American resolve. I will attempt to identify the initial impetus that helped define U.S. action--was it relative gains considerations …

Individualism In The Age Of Internationalism, Alyson Cole May 2001

Individualism In The Age Of Internationalism, Alyson Cole

Michigan Law Review

In the brief conclusion to The Empowered Self: Law and Society in the Age of Individualism, Thomas M. Franck asserts that he cannot satisfactorily summarize his book's argument. Even if it were achievable, he clarifies, he would not engage in such an endeavor, since it would "preempt the reader's autonomy and subvert his or her individual rights" (p. 278). That the author himself rejects the desirability of doing what reviewers generally do (i.e., condense and inevitably simplify complex tomes) is perhaps a somewhat awkward way to commence a discussion of his book. Nevertheless, this comment illustrates the extent to which …

Music constitutes the bed-rock, the grass roots of popular consciousness.-Ronnie Graham As long as societies have existed on this planet, music has existed as a shared activity within these societies.Music acts as a mirrow of culture, allowing a more intimate view of the history, traditions, troubles and successes of those people brought together by the music.Whether it is traditional African music or Western pop music, the idea of sharing something withing the sounds and the silence has always remained the driving force behind musical creation. In this paper, I explore the effects of Westernization on traditional Ga music. What is …

Globalization And The Paradox Of Incorporation And Marginalization: An Exploratory Note On Sub-Saharan Africa, Charles R. Lartey Apr 2001

Globalization And The Paradox Of Incorporation And Marginalization: An Exploratory Note On Sub-Saharan Africa, Charles R. Lartey

Graduate Program in International Studies Theses & Dissertations

Globalization has of late become the lingua franca of the study of the international political economic system. As its ideological counterpart, globalization has elevated neoliberalism to the status of an international theology. To harness the benefits of a globalizing world economy, conventional wisdom consider the dictums underlying neoliberal policies as “immutable laws” that must be adopted by both the developing and the developed world.

Utilizing a structured, focused analysis based on a case study of Sub-Saharan Africa (SSA), this research challenges the orthodox notion that the new international context of development that is instigated by the imperatives of globalization, and …

Laws As Treaties?: The Constitutionality Of Congressional-Executive Agreements, John C. Yoo Feb 2001

Laws As Treaties?: The Constitutionality Of Congressional-Executive Agreements, John C. Yoo

Michigan Law Review

Only twice in the last century, in 1919 with the Treaty of Versailles, and two years ago with the comprehensive Nuclear Test-Ban Treaty, has the Senate rejected a significant treaty sought by the President. In both cases, the international agreement received support from a majority of the Senators, but failed to reach the two-thirds supermajority required by Article II, Section 2, of the Constitution. The failure of the Versailles Treaty resulted in a shattering defeat for President Wilson's vision of a new world order, based on collective security and led by the United States. Rejection of the Test-Ban Treaty amounted …

A review of Levi’s Children: Coming to Terms with Human Rights in the Global Marketplace by Karl Schoenberger. New York: Atlantic Monthly Press, 2000. 288pp.

Levi’s Children presents a sobering account of the tribulations of a transnational corporation with a heart trying its best to navigate honorably the polluted moral waters of the global economy. San Francisco-based Levi Strauss and Company, maker of the iconic Levi’s jeans and other apparel, sought to maintain a commitment to social responsibility in the face of intensifying financial pressures to do otherwise. Author Karl Schoenberger puts this account to good effect, illuminating the extraordinary …

Globalization, Diet, And Health: An Example From Tonga, Mike Evans, Robert C. Sinclair, Caroline Fusimalohi, Viliami Liava’A

Aboriginal Policy Research Consortium International (APRCi)

The increased flow of goods, people, and ideas associated with globalization have contributed to an

increase in noncommunicable diseases in much of the world. One response has been to encourage lifestyle changes with educational programmes, thus controlling the lifestyle-related disease. Key assumptions with this approach are that people’s food preferences are linked to their consumption patterns, and that consumption patterns can be transformed through educational initiatives. To investigate these assumptions, and policies that derive from it, we undertook a broad-based survey of food-related issues in the Kingdom of Tonga using a questionnaire. Data on the relationships between food preferences, perception …

The Invisible Can Or, Gendering Corporate Globalization Trouble: Technological Utopianism And The Language Of Erasure, Marleen S. Barr

Publications and Research

In the following, noted science fiction scholar Marleen S. Barr argues for an increased attention to science fiction as a literature of the potentials of globalization, a genre that has largely been marginalized in discussions of the future of a globalized techno-culture. Further, Barr argues for greater attention being paid to feminist utopian fiction which helps to reimagine women's roles in the increasingly complex, and increasingly capitalistic, globalized techno-culture that has continued to marginalize the female body (and consciousness) in much the same way that scholars have denied the possibilities of utopian science fiction.
