The basic premise of this book, by two law professors, is that humans, in spite of their differences, share one essential characteristic: "the capacity of every rational person to advance in moral self-perfection." How this is achieved, the authors argue, is more dependent on the intention to do good for one's fellow human beings than on the actual results of any efforts to do so. By this analysis, a person can become good without necessarily doing good; it is the good intention that is ultimately determinative. The purpose of this research is to first describe the origins and current state of federal asset forfeiture law, then examine of how property seized under the forfeiture laws for drug law violations is proceeded against by the federal government. The methodology, which is primarily exploratory, utilizes both qualitative and quantitative data. A sample of over 6000 federal administrative and judicial drug forfeiture cases are described and analyzed to construct a profile of the federal government's use of this policy. Findings raise questions about the use of forfeiture and the government's intent. Implications and suggestions for future research are included.

Habitat valuation is an essential tool for tracking changes in habitat quality and in adjudicating environmental mitigation. All current methods for estimating habitat values of coastal marine sites rely heavily on the opinion of experts or on data variables that can readily be manipulated to influence the outcome. As a result, unbiased, quantitative comparisons between the values of different marine habitats are generally unavailable. We report here on a robust, objective technique for the valuation of marine habitats that makes use of data that are commonly gathered in surveys of marine fish populations: density, fidelity, and mean size. This article explores one southern community's response to the 1954 Brown decision and its subsequent history of dealing with school desegregation. This local perspective is developed using historical data focusing on events immediately following the Brown decision, which provide a contextfor events leading up to a decision in the inid-1980s to consolidate the community's middle school students to reduce perceptions of inequality based on race. This consolidated school is the focus of the second half of the article, which analyzes the current status of desegregation in the school. While empirical research on school subject preferences and choices has a long history, 'interest' has infrequently been invoked as an explanatory construct. Three levels on which interest is conceptualised in educational research are identified. The most general derives from vocational psychology and may be characterised by the themes of Holland's RIASEC typology. The results of five recent Australian studies in which interests were related to school subject preferences and choices are reviewed, and a series of multi- level models of data from the most recent are presented. A scintillation model is developed for uplink-downlink optical communication channels applicable in moderate to strong fluctuation conditions that may arise under large zenith angles between transmitter and receiver. The model developed here is an extension of a recently published theory that treats irradiance fluctuations along a horizontal path as a modulation of small-scale scintillation by large-scale scintillation. For a downlink path the scintillation index is modeled like that of an infinite plane wave, and for an uplink path we consider a spherical wave model. Postlarval and juvenile densities of Farfantepenaeus aztecus, Farfantepenaeus duorarum, and Litopenaeus setiferus were compared among emergent marsh (Spartina alterniflora), submerged aquatic vegetation (Ruppia maritima), and adjacent unvegetated areas at the east end of Fowl River along Mobile Bay, AL. A total of 108 samples were collected between July 1994 and Nov. 1995, of which 76 samples contained at least one of the three penaeid species. Of the 507 penaeid shrimp collected, 303 (60%) were collected in the R. maritima beds, 152 (30%) in the S. alterniflora, and 52 (10%) in the sand/mud habitat. …

Over the past two decades there has been a marked expansion in legal challenges to local land use regulations claiming violations of the free speech clause of the First Amendment to the United States Constitution. First Amendment claims can arise whenever government enacts or enforces zoning or other regulations that deal with uses such as billboards or adult entertainment businesses. This article discusses why this litigation is taking place, provides an overview of First Amendment law, and offers local officials some guidelines to help avoid potential legal challenges.

Gamma titanium aluminide has received significant attention in recent years as a candidate material for use in aerospace and industrial gas turbine engine applications. In particular, these materials offer significant weight reductions (densities are less than half that of nickel-based superalloys), high specific strength retention at elevated temperature and high specific stiffness which is particularly important in vibrating components such as blades. This combination of weight savings and good mechanical properties has led to the possibility that γ-TiAl may be a suitable replacement for nickel-based alloys, such as Inconel 718, in low pressure turbine blades without significant redesign of the …
