"Supervisor" Hostile Environment Sexual Harassment Claims, Liability Insurance, And The Trend Towards Negligence, Amanda D. Smith
University of Michigan Journal of Law Reform
A lack of settled standards for determining liability in supervisor hostile environment sexual harassment lawsuits combined with similar uncertainty in the context of employer liability insurance coverage has resulted in increased litigation in this area. This Note argues that the current predominant standard in the employer liability context, which is based on negligence principle should be rejected in favor of an apparent authority standard, which more appropriately strikes a balance between encouraging employers to identify harassing behaviors and exonerating them from liability when they do so and take appropriate remedial action. In recent years, many theorists and practitioners in the field of critical and creative thinking have moved beyond a discrete skills understanding of critical and creative thinking to advocate a more holistic approach. This approach focuses on recognizing underlying assumptions, analyzing frames of reference, and fore grounding personal and social biases. Yet despite this much needed move toward contextualizing thinking and the thinker, there is little attention given to the role that power and identity difference play in the development and teaching of thinking. Mother-Bereaved Women And Death Anxiety, Nicole Depriest Thompson

Death anxiety in mother-bereaved women versus women non mother-bereaved was investigated. Female graduate students and social service employees were taken from a non-random sample in the Midwest. There were 60 participants, 30 who were mother-bereaved and 30 who were non mother-bereaved. Participants were given the Templer Death Anxiety Scale and a demographic survey to complete. Dependent variables were the scores on the Templer Death Anxiety Scale. There was not a statistically significant difference in average death anxiety scores between mother-bereaved women and non mother-bereaved women. The ramifications of the results are discussed, and potential avenues for further research are suggested.

Recent research indicates that the majority of women underestimate their risk of developing coronary artery disease (CAD). CAD claims the lives of more women than all forms of cancer; however, women have not received the symptom recognition or treatment that has been accorded to men with CAD. Review of literature indicated a lack of research regarding the experiences of women with acute myocardial infarction (AMI). This phenomenological study explored the lived experience of women with AMI immediately prior to hospitalization. The lines of inquiry focused on descriptive language regarding pre-event feelings, the symptoms experienced at AMI onset, their response to …

Last year, Congress passed the Ryan White Care Act Amendments of 1996. The amendments authorize ten million dollars for each fiscal year from 1996 through 2000 for counseling pregnant women on HIV disease, for "outreach efforts to pregnant women at high risk of HN who are not currently receiving prenatal care," and for voluntary testing for pregnant women. The amendments compromise a central question: whether prenatal and neonatal AIDS testing should be compelled. The compromise is complex. Ru 486 Examined: Impact Of A New Technology On An 0 Id Controversy, Gwendolyn Prothro

Abortion is an extremely divisive issue in American politics and culture. Prothro begins this Article by analyzing the current legal standards governing reproduction, which draw a sharp distinction between abortion and contraception. Prothro then examines the function of RU 486, demonstrating that it acts both as a contraceptive and as an abortifacient. Because of this dual capacity, RU 486 does not fit neatly into the current legal framework. Prothro concludes this Article by arguing that RU 486 should force the Supreme Court to create a new framework for the "procreative right." Prothro argues that this new framework should treat the …

The decision by the Constitutional Court in Karlsruhe of placing restrictions on the right to an abortion will profoundly affect German women's right to choose. This decision is a culmination of efforts to errode the right to choose for West as well as East German women. In the former GDR, even though liberal abortion laws allowed women access to free abortions, for ideological reasons, the government devised policies that discouraged abortions as a means of birth control. Madness And The Middle Passage: Warner-Vierya's Juletane As A Paradigm For Writing Caribbean Women's Identities, Ann Elizabeth Willey

This article links Glissant's theory of an inherent Caribbean madness due to the originary rupture and alienation from Africa with Foucault's theory of the ritual significance and essential liminality of the madman as exemplified in the medieval figure of the "Ship of Fools." In calling the madman the "passenger par excellence," Foucault implies a connection between sanity and linear narratives, such as that of a voyage. Myriam Warner-Vierya's novel, Juletane, suggests that European paradigms of narrative and voyage are inadequate to provide a sense of self for Caribbean women. The novel takes the form of a diary that chronicles …

This thesis is designed as an exercise in critical thinking which attempts to trace the little-known and vaguely understood international effort to address women's rights as human rights. Specifically, it is intended to introduce and actively engage the reader in the application of critical thinking processes through an analysis of the history and status of the Convention on the Elimination of All Forms of Discrimination Against Women, or CEDAW. Given the potential significance of CEDAW for the United States, it is ironic that this human rights treaty is not commonplace in discussions regarding women's rights. This thesis concerns the white women of Fredericksburg, Virginia, during and immediately after the Civil War. Between 1861-1865, Fredericksburg existed in the no-man's land between Washington, D.C. and Richmond, Virginia. The town was bombarded, occupied by enemy forces, and ransacked. Military control of the town changed hands 10 times. Four major battles were fought around Fredericksburg, resulting in over 100,000 casualties. Throughout the conflict, Fredericksburg's white women were in the thick of the action - supporting their troops, nursing the wounded, and managing the increasingly desperate struggle to provide food and shelter for their families. Using grounded theory, a semi-structured in-depth interview was conducted to explore the experiences of Taiwanese women who were caregivers for their parents-in-law. Thirty-one Taiwanese women aged 23 to 58 participated in this study. Just Doing was identified as the core category to indicate the caregivers' striving process once they committed to their in-laws' care. Recognizing Duty, Experiencing Trials, and Responding to Caregiving were subcategories and reflected how a caregiver perceived her role, how she was affected by caregiving tasks, and what responses she had to the caregiving situation. The findings also suggested that caregiving behaviors were influenced by cultural expectations …

Since 1970, the United States has seen an explosion in the rate of women working and a change towards equality in men's and women's roles. In 1980, Helal Mobasher Liaey gave a survey to measure what Utah State University students thought were proper roles for women, in categories ranging from occupations to decision making. He did this research at a time when traditional and egalitarian role views were still furiously clashing, especially in Utah, which is generally considered to be one of the most conservative states in the country since it is primarily LDS. The purpose of this study was to explore the perspectives of the woman/nurse/executive working in the managed care environment of Southern California. This research was extremely timely because (a) Southern California leads the nation in managed care market penetration, (b) changes in health care financing have resulted in a prolific expansion of nurse executive responsibilities, and (c) nurse executive experiences regarding increased responsibilities have not been researched. Role expansion impacts both male and female nurse executives, but female nurse executives must confront the dilemma of functioning in administrative domains which have been largely dominated by men. The aim of this paper is to determine whether or not female drummers are becoming a part of the tradition of drumming in Ghana. Much of the focus lies on the pioneer women's group in Ghana, the Aboase Dadziemba Mmensoun Cultural Group. It looks at the role they've played in liberating the women of Ghana and revitalizing a change in the traditional realm of drumming. Using statistical data covering a ten year period, this study examines the issue of gender representation in admissions to first year law study at common law schools in Canada. After addressing three identifiable steps in the admission process-applications, offers and registration-the author concludes that while there has been progress and the gap has narrowed, the problem of gender inequality persists.

The Roman historian Pliny recounts a story that occurred during Periclean Athens. I will utilize this story, as a trope to undertake an interrogation of perception as it is commonly understood and currently practiced by art educators in schools. In order to deconstruct vision/blindness, or the perception/non-perception binary, I have examined the psychoanalytic paradigm of Jacques Lacan. His current interpreters provided the conceptual tools for such an undertaking. Given that the question of representation has become a key sign-post of postmodernism, art educators must conceptualize a trajectory for itself in the 21st century. In this paper, I examine the relationship between women and the Irish state, particularly how the nationalist state has defined and controlled women through their reproductive capabilities. I outline the factors that have contributed to the construction of women's identity and how women have resisted the limitations of this construction in a variety of ways. The issue of abortion is an excellent point on which to base the discussion of women in Ireland because of it extraordinary impact on Irish society. In most states in Mexico, abortion is excluded as a crime in pregnancies resulting from rape. However, legislation does not specify the norms by which women can obtain a legal abortion, which makes it difficult to choose this alternative. A partial solution to unwanted pregnancies from rape would be to provide emergency contraception (EC). Psychologists were trained to provide information on EC to women who reported a rape at four public ministry agencies specialized in sexual crime. In addition, 11 medical backup referral centers were established. To scale up the strategy, workshops were provided to representatives from State Attorney General …

Legislative Approaches To Reducing The Hegemony Of The Priestly Model Of Medicine, Nancy K. Kubasek

This Article presents the case that the legal culture in many ways undergirds the priestly model's hegemony over the therapeutic relationship between a woman and her doctor. To the extent that law provides this fundamental support, it legitimizes the mistreatment of women, especially with respect to their reproductive health. The implications are that the movement toward a more just legal culture necessitates the extirpation of this support.
