We do not underestimate the difficulties of legislating on this subject. In addition to the inevitable confrontation with the ethical and moral issues involved, there is the question of the wisdom and effectiveness of regulating a matter so private, yet of such public interest. Legislative consideration of surrogacy may also provide the opportunity to begin to focus on the overall implications of the new reproductive biotechnology- in vitro fertilization, preservation of sperms and eggs, embryo implantation and the like. The problem is how to enjoy the benefits of the technology-especially for infertile couples-while minimizing the risk of abuse. The problem …

Lawyers are under siege. We have become objects of scorn, ridicule, and occasional hatred. If you take your child to the Stephen Spielberg movie Jurassic Park, be prepared for the cheers when the cloned Tyrannosaurus Rex gobbles the lawyer—not a bad guy at all—cowering in the outhouse. In San Francisco a client burst into a California law firm and killed eight and wounded six persons before taking his own life. In response, the president of the California bar linked lawyer-bashing to hate crimes and prevailed on the Miller Brewing Company to withdraw a television commercial depicting a "lawyer-roping rodeo" …

Background: Past studies suggested an association between human papillomavirus (HPV) and cervical intraepithelial neoplasia (CIN). In 1987, University of North Carolina (UNC) Hospitals Family Practice Center clinicians were approached for a control population to study this association. Methods: One hundred fives patients attending the UNC Hospitals Neoplasia Clinic with biopsy-proven CIN 2 or 3 and 268 control patients attending the UNC Family Practice Center for a routine Papanicolaou smear were enrolled in this case-control study. Case and control patients consented to having an additional cervical specimen taken and to being interviewed. The cervical specimens were classified by the Southern blot …

Philosophy: Faculty Publications and Other Works
Much of my background lies in social ministry, but after ordination the provincial decreed that I was to work in philosophy also. It seemed an odd mix at the time: philosophers tend to be squeamish about the rough-and-tumble of social action, while some social activists give the impression that garlic should be worn to ward off the anemia-inducing influence of philosophers. The combination has given a certain Janus-like quality to my life; but it has worked, and I have felt no need to look back.

This paper examines the role private property rights and ethics play in a market economy, and demonstrates that in order to have a free market, it is essential to have a legal system that defines private property rights. Such a legal system can only evolve on the free market itself; Chapter I examines the nature of property rights; Chapter II examines some historical examples of legal systems that have been based on private property rights; Chapter III explains the relationship between such a legal system and ethics. Outdoor adventure programming has responded to changing societal and individual needs by enlarging the goals and objectives of programs beyond the boundaries of the outdoor trip. Program missions, goals and objectives regularly include integrating people with and without disabilities, reinforcing appropriate school and societal behaviour in youth at risk, enhancing the self esteem of young people, teaching environmentally sound behaviour, and enhancing restorative healing for women survivors of abuse and people with terminal illness. In this chapter of the encyclical the Pope responds to the basic question of morality: "How can obedience to universal and unchanging moral norms respect the uniqueness and individuality of the person and not represent a threat to his freedom and dignity?"

Challenging the "de minimis risk" concept, Dr. Fischhoff argues that risks ought not to be considered apart from a particular technology's benefits. He argues, too, that the acceptability of particular kinds of risks should not be determined without considering the views of all persons who may be exposed. Finally, building upon the "reasonable person" construct, he suggests ways those goals might be achieved.

The Empire Of Death: How Culture And Economics Affect Informed Consent In The U.S., The U.K., And Japan, George J. Annas, Frances H. Miller

Historically, most Americans have treated health care as a private commodity whose price, and therefore availability, is primarily determined by market forces. In such a context, the law not unsurprisingly places a high premium on information disclosure by physicians. Personal autonomy-an individual's power to choose among medical options-enjoys its most zealous protection under U.S. jurisprudence.7 The dominant U.S. version of informed consent is grounded on principles of patient/consumer autonomy, and seems to enhance market choice. But a strong theme of collectivism now runs through some discussions of U.S. health policy.8 President Clinton was elected at least in part …
