Ngos, Soft Power, And Environmental Politics, Benjamin James Chambers
Ngos, Soft Power, And Environmental Politics, Benjamin James Chambers
Theses
This paper explores the connection between NGOs and the growing international environmental regime. It questions the role these groups have played in building international law, arguing that they use soft power to overcome the interests of states in negotiations. After providing background on the idea of soft power, the paper uses three case studies to demonstrate the argument: the Rio Declaration, the Montreal Protocol, and the Kyoto Protocol. The findings from these studies challenge realism and support a constructivist analysis of international regime-building.
Indigenous Peoples Under International Law: An Asian Perspective, Tashi Phuntsok
Indigenous Peoples Under International Law: An Asian Perspective, Tashi Phuntsok
Electronic Thesis and Dissertation Repository
This thesis analyzes Asian understandings of the definition of indigenous peoples in international law. The rights of indigenous peoples have emerged strongly in the international domain, culminating in 2007 with the United Nations Declaration on the Rights of Indigenous Peoples. Yet, the question of definition and identity of indigenous peoples remains uncertain and indeterminate, at least from an Asian perspective. Traditionally indigenous peoples are understood to be those who were victims of European colonial settlements. It is the aim of this research to find out whether indigenous peoples exist in Asia by analyzing the approaches taken by select Asian states …
Intellectual Property, Traditional Knowledge, And Biodiversity In The Global Economy: The Potential Of Geographical Indications For Protecting Traditional Knowledge-Based Agricultural Products, Teshager W. Dagne
PhD Dissertations
The relationship between international regimes regulating intellectual property, traditional knowledge and biodiversity has received much attention in recent times. Of the many complex and controversial issues in contemporary international legal discourse on this matter, the protection of traditional knowledge (TK) stands out as a significant challenge. Choices abound in the search for modalities to regulate rights to use and control TK systems and their underlying biodiversity. In recent times, the protection of geographical indications (GIs) has emerged as an option for protecting TK. Despite the considerable enthusiasm over it, there is appreciable research dearth on how far and in what …

Balancing Shipping And The Protection Of The Marine Environment Of Straits Used For International Navigation: A Study Of The Straits Of Malacca And Singapore, Mohd Hazmi Bin Mohd Rusli
University of Wollongong Thesis Collection 1954-2016
The importance of the Straits of Malacca and Singapore for the global shipping industry and world trade can’t be underestimated. In 2010, these routes were navigated by more than 74,000 vessels of various types. If the Straits were to be closed to navigation, global trade would be adversely affected, thus, injuring the world’s economy. Issues relating to the marine environment of these Straits have always been contentious. The littoral States may enforce marine environmental protection measures to protect the straits under the United Nations Convention on the Law of the Sea 1982 (LOSC), but their powers are limited by the …

Trans-Border Advocacy Network In Tobacco Control: The Adoption Of Who-Fctc Best Practices Into Domestic Laws In Ghana And Malawi, Edward Brenya
Graduate Theses, Dissertations, and Problem Reports
The study investigates the politics characterizing the adoption of tobacco control policy in Ghana and Malawi as a way of contributing to political science literature. It combines the global advocacy network, the multi-level policy transfer, and the liberal-constructivist theories as a single framework to examine their effects on tobacco control policy adoption. Methodologically, the study uses a comparative case study approach complemented by elite interviews, review of secondary materials, and policy documents. The study finds that neither of the Parliaments of the two countries has adopted any legislation that is properly enforced. However, both countries have certain voluntary agreements to …
