Dialogue And Hierarchy In Charter Interpretation: A Comment On R. V. Mills, Jamie Cameron

This case comment focuses on two issues of methodology: the first concerns constitutional interpretation and the democratic process, or the dialogue issue, and the second, the relationship between Charter guarantees, or the hierarchy issue. To set the stage, an initial section provides an overview of the Stinchcombe/O'Connor/Mills trilogy, and is followed by a more detailed analysis of Mills that examines the tension between judicial and legislative decision making, before considering how Parliament and the Court altered O'Connor's model for balancing the rights of the accused and complainants. On the latter issue, though the article does not comment in detail on …

Gender Differences In The Effect Of Child Maltreatment On Criminal Activity Over The Life Course, Ryan E. Spohn
Criminology and Criminal Justice Faculty Publications
This paper adds to a growing body of knowledge regarding the criminal consequences of childhood victimization. A prospective research design is used to compare a group of maltreated youth to a matched control group in order to determine the extent to which child abuse and neglect influence both juvenile delinquency and adult crime. Controlling for race and sex, abused and neglected children are more likely to have a juvenile arrest record. In addition, controlling for involvement in juvenile crime, child maltreatment also influences adult criminality. Motivated by the findings of qualitative studies focusing on female offenders, I examine gender differences …

Plaintiff-appellant Mary Flaherty appeals from a summary judgment entered in favor of defendant-appellee Metromail Corporation ("Metromail"), and its alleged successors in interest, defendants-appellees Experian Corporation, Experian Information Solutions, Inc., and Experian Holdings, Inc. (collectively "Experian"), in the United States District Court for the Southern District of New York (Buchwald, J.). The action giving rise to this appeal was instituted by Flaherty to recover damages arising from her constructive discharge from employment as a consequence of gender and age discrimination and was dismissed by the district court as time-barred. Hydra vulgaris mesoglea is a primitive basement membrane that also exhibits some features of an interstitial matrix. We have characterized cDNAs that encode the full-length hydra α1(IV) chain. The 5169-base pair transcript encodes a protein of 1723 amino acids, including an interrupted 1455-residue collagenous domain and a 228-residue C-terminal noncollagenous domain. N-terminal sequence analyses of collagen IV peptides suggest the molecule is homotrimeric. Denatured hydra type IV collagen protein occurs as dimers and higher order aggregates held together by nonreducible cross-links. Hydra collagen IV exhibits no functional evidence for the presence of a 7 S domain. Type IV collagen is …

Evaluation Of Kentucky's Graduated Driver Licensing System, Kenneth R. Agent, Jerry G. Pigman, Lorena C. Steenbergen, Susan H. Pollack, Pamela S. Kidd, Caroline Mccoy
Kentucky Transportation Center Research Report
Kentucky's current GDL program, which applies to drivers up to age 18, was enacted in 1996. The program includes a six-month instruction permit for drivers under age 18 (minimum age 16), a restriction on driving between midnight and 6am and a requirement for adult-supervised driving for permit drivers. In addition, there is a six-point limit on traffic violations with a penalty of license suspension for drivers under age 18, a requirement for a four-hour driving safety education class (or driver education course) and a 0.02 ml/dl limit on blood alcohol concentration (continues up to age 21 ).
