The Role Of Levies In Canada's Digital Music Market , Jeremy F. De Beer

Parties not directly involved in the use of copyright-protected music have increasingly become the targets of established or proposed schemes to provide revenues for the music industry. It has been suggested that rather than obtaining payments directly from consumers or distributors of digital music in exchange for licenses to use or transmit that music, levies should be imposed on the goods and services of third parties, such as recording media, digital devices and/or Internet access. This paper considers whether levies are an appropriate way to deal with the challenges and opportunities that are arising in Canada's digital music market.

This paper considers whether the Government of Canada's proposed legislation addressing technological protection measures and rights management information would be constitutionally valid federal law and examines the provinces' role in the debate over these copyright reforms. The Constitution allocates exclusive legislative responsibility for various matters to either the federal or provincial governments. The constitutionality of the proposed provisions turns on their pith and substance, which seems to involve technological and contractual controls over terms of distribution of digital materials. This law reform submission, directed to the Australian Attorney-General's Department, responds to the question whether Australia should introduce a 'fair use' exception in copyright law, and whether the Australian exceptions regime has other problems with it. Specifically it considers questions of private copying, parody, and copyright exceptions for libraries and archives in a digital environment.

The software industry frequently maintains that software piracy is no more than theft and a cause of huge losses. Courts and other policy makers easily adopt that straightforward argument. Surprisingly, however, many software publishers do not employ any technological measures to protect their software from piracy and many popular software products are distributed without any means of protection and are easily pirated. This lack of protection is puzzling; a solution for that puzzle is the focus of the article. This Essay suggests possible explanations for why there is not very much legal scholarship devoted to gender issues on the Internet; and it asserts that there is a powerful need for Internet legal theorists and activists to pay substantially more attention to the gender-based differences in communicative style and substance that have been imported from real space to cyberspace. Testing The Barriers To Digital Libraries: A Study Seeking Copyright Permission To Digitize Published Works, Carole A. George

Purpose: The aim was to explore the issues related to acquiring copyright permission with the goal of determining effectiveness and efficiency using the least complex process. Methodology: A random sample of books was chosen, relevant information was recorded, request letters were sent and tracked, and results (permission received or denied) were analyzed with respect to publisher, publication data, time required, and issues related to the process. Findings: About 52 percent responded with a yes or no with 24 percent Yes responses. Nearly 25 percent never responded, addresses were not found for about 16 percent, approximately 7 percent were too complicated …
