Federal Forfeiture: Law, Policy And Practice, Greg Warchol, Dennis Payne, Brian Johnson

The purpose of this research is to first describe the origins and current state of federal asset forfeiture law, then examine of how property seized under the forfeiture laws for drug law violations is proceeded against by the federal government. The methodology, which is primarily exploratory, utilizes both qualitative and quantitative data. A sample of over 6000 federal administrative and judicial drug forfeiture cases are described and analyzed to construct a profile of the federal government's use of this policy. Findings raise questions about the use of forfeiture and the government's intent. Implications and suggestions for future research are included.

A permanent international criminal court (ICC) was created by an international treaty signed on July 17, 1998 in Rome. This article is an analysis of the newly created ICC. In it we explore both the institutional weaknesses and strengths of the Court, as well as the sea of political realities within which the Court must navigate, and which ultimately will determine its effectiveness. Finally, we analyze the impact (i.e., advantages and disadvantages) of the Court on the U.S. national interest. At an address at Carleton University in 1995 Secretary General of the United Nations Boutros Boutros-Ghali declared the need for a “renaissance of international law” as nations face the new challenges of the post-Cold War world. According to Ghali, it is only through international law that the world can “secure a basis for cooperation” and “a lasting foundation for peace.”1 Aspirations for the realization of this lofty rhetoric have centered on the creation of a permanent international criminal court (PICC). Mental health parity legislation could substantially reduce the degree to which financial responsibility for the treatment of mental illness is shifted to government, especially state and local government. There is substantial evidence that both mental health and addictions treatment is effective in reducing the utilization and costs of medical services. There appears to be a lack of substantial evidence to discourage Florida from pursuing mental health and substance abuse parity legislation.

In thinking about the family law practitioner's response to domestic violence issues over the past few decades, it is heartening to note some progress while remaining deeply concerned that many lawyers have yet to embrace even the most basic tenets of victim safety and offender accountability. The successful implementation and operation of electronic house arrest (EHA) depends upon community acceptance. Research has explored the conditions under which the public supports EHA as an alternative to incarceration, but it has failed to fully address what the public believes are appropriate program characteristics and offender activities. In order to gain insight into these issues, the present article reports the findings of a survey (n=521) of Oneida County, New York, residents. Respondents indicated that a "good" EHA program has rules and regulations and promote individual and societal safety
