Federal Forfeiture: Law, Policy And Practice, Greg Warchol, Dennis Payne, Brian Johnson
Greg Warchol
The purpose of this research is to first describe the origins and current state of federal asset forfeiture law, then examine of how property seized under the forfeiture laws for drug law violations is proceeded against by the federal government. The methodology, which is primarily exploratory, utilizes both qualitative and quantitative data. A sample of over 6000 federal administrative and judicial drug forfeiture cases are described and analyzed to construct a profile of the federal government's use of this policy. Findings raise questions about the use of forfeiture and the government's intent. Implications and suggestions for future research are included.

The Perception Of Spirituality And Its Manifestations In The Lives Of African American Male College Students, Adrienne Coleman
The Perception Of Spirituality And Its Manifestations In The Lives Of African American Male College Students, Adrienne Coleman
Adrienne Coleman
This study initiated in response to the lack of information on spirituality in African Americans and more specifically African American males. It is very important that spirituality be studied to make health educators knowledgeable about its overall nature. With awareness the health educators will be prepared to implement health promotion interventions that are appropriate and consistent with the beliefs of this subculture. The literature regarding this subject addressed many different aspects of spirituality. There was only a minute amount of information on African Americans and even less on African American males. Instead the literature search concentrated on areas such as: …

MEDIATION TRAINING TO IMPROVE POLICE SOCIAL INTERACTION SKILLS. THE FEBRUARY SHOOTING DEATH OF AN UNARMED AFRICAN IMMIGRANT, AMADOU DIALLO, IN A HAIL OF 41 BULLETS FIRED BY FOUR WHITE NEW YORK CITY POLICE OFFICERS HAS FOCUSED ATTENTION ON MISTREATMENT OF PEOPLE OF COLOR BY POLICE NOT ONLY IN NEW YORK BUT THROUGHOUT THE UNITED STATES. WHETHER IT IS NEW YORK CITY OR KANASA CITY, I BELIEVE THAT WE AS ENTER INTO A NEW MILLENIUM , POLICE TRAINING NEEDS TO BE TAKEN TO THE NEXT LEVEL. Toward Universal Human Rights And The Rule Of Law: The Permanent International Criminal Court, Giulio M. Gallarotti, Arik Preis
Giulio M Gallarotti
A permanent international criminal court (ICC) was created by an international treaty signed on July 17, 1998 in Rome. This article is an analysis of the newly created ICC. In it we explore both the institutional weaknesses and strengths of the Court, as well as the sea of political realities within which the Court must navigate, and which ultimately will determine its effectiveness. Finally, we analyze the impact (i.e., advantages and disadvantages) of the Court on the U.S. national interest. As a nation which has the capacity to play a preponderant role in making the ICC either effective or ineffective, …

Politics, International Justice, And The United States: Toward A Permanent International Criminal Court, Giulio M. Gallarotti, Arik Preis

At an address at Carleton University in 1995 Secretary General of the United Nations Boutros Boutros-Ghali declared the need for a “renaissance of international law” as nations face the new challenges of the post-Cold War world. According to Ghali, it is only through international law that the world can “secure a basis for cooperation” and “a lasting foundation for peace.”1 Aspirations for the realization of this lofty rhetoric have centered on the creation of a permanent international criminal court (PICC). The sentiment for a PICC emanates from dissatisfaction with the prevailing practice of international criminal law. Supporters of the court …
Mental Health Parity: National And State Perspectives 1999, Bruce Lubotsky Levin, Ardis Hanson, Richard Coe
Mental Health Parity: National And State Perspectives 1999, Bruce Lubotsky Levin, Ardis Hanson, Richard Coe
Ardis Hanson
Mental health parity legislation could substantially reduce the degree to which financial responsibility for the treatment of mental illness is shifted to government, especially state and local government. There is substantial evidence that both mental health and addictions treatment is effective in reducing the utilization and costs of medical services. There appears to be a lack of substantial evidence to discourage Florida from pursuing mental health and substance abuse parity legislation.
Domestic Violence And The Law: An Impassioned Exploration For Family Peace, Sarah M. Buel
Domestic Violence And The Law: An Impassioned Exploration For Family Peace, Sarah M. Buel
SARAH M BUEL
In thinking about the family law practitioner's response to domestic violence issues over the past few decades, it is heartening to note some progress while remaining deeply concerned that many lawyers have yet to embrace even the most basic tenets of victim safety and offender accountability. Domestic violence impacts most lawyers and judges; however, those in the field of family law are positioned to dramatically improve the lives of all parties, if they have learned how to intervene effectively. The continuing violence indicates that we must examine the larger issues: namely, the social, cultural and economic conditions that will facilitate …

The vagueness of the reasonable doubt standard, and jurors' interpretation of it, creates serious inconsistencies in the criminal justice system that call for creating a more objective standard of proof.

Citizens' Perception Of A "Good" Electronic House Arrest Program, Preston Elrod, Michael P. Brown
Citizens' Perception Of A "Good" Electronic House Arrest Program, Preston Elrod, Michael P. Brown
Preston Elrod, Ph.D.
The successful implementation and operation of electronic house arrest (EHA) depends upon community acceptance. Research has explored the conditions under which the public supports EHA as an alternative to incarceration, but it has failed to fully address what the public believes are appropriate program characteristics and offender activities. In order to gain insight into these issues, the present article reports the findings of a survey (n=521) of Oneida County, New York, residents. Respondents indicated that a "good" EHA program has rules and regulations and promote individual and societal safety
