Rethinking The Fundamentals: Applying The Evolving Standards Of Decency Test To The Court’S Evaluation Of Fundamental Rights., Nick Wolfram
UC Law Constitutional Quarterly
In 1910, the Supreme Court recognized in Weems v. United States that a constitution “must be capable of wider application than the mischief which gave it birth.” This principle led to the creation of the Court’s two-pronged “evolving standards of decency,” test: (1) evidence of an objective indicia of a national consensus, and (2) the reviewing court’s own independent judgment. To this day the Court has yet to apply this test outside of the Eighth Amendment context. But can the “evolving standards of decency,” test identify and protect other fundamental rights? "They Could Not Guard Against It": The Failed U.S. Policy Response To German Sabotage At Black Tom Island, Benjamin Smith

In the early morning hours of 31 July 1916, German agents successfully detonated a storage facility on an island in New York Harbor named Black Tom. The facility was filled with munitions meant for the Allied powers fighting against Germany in World War I. It was at that time the single most destructive subversive act ever perpetrated on U.S. soil. But it is not surprising that such an act occurred: the United States had no specialized counter-espionage agency and the area had relatively little protection. in 1960, the Chicago Congress of World Mission declared, "in the years since World War II more than one billion souls have passed into eternity and more than half of those went to the torment of Hell fire without even hearing of Jesus Christ, who He was or why He died on the Cross of Calvary." The issue of a restricted salvation-one granted only to those who fulfil a specific set of requirements-has remained central to Christian eschatology since the pre-Nicene period and before. In 1895, the British Empire underwent a dramatic change. This change was not precipitated by war, expansion, or discovery. Instead, the empire was changed by a renewed longing for the glory of the old empire. Where the empire had been shrinking, it would now be expanded. Where claims had been ceded, they would now be defended. All of this was undergone with the greatest hopes but resulted in the gravest consequences. Yet there was a brief moment in 1898 when this new imperialist vigor was almost cut short and this terrible history nearly averted.

The Downtown Review
Focusing on the Anglicization of town names in Brian Friel’s Translations, this article analyzes the significance of translation, beyond names as agents of linguistic imperialism and functions or symbols of identity. Using a Christian lens to demonstrate the intrinsic dignity signified in a name combined with a colonization case study in the Danish West Indies attesting to the injuries of denying a given name, the irreversible damage of translating names into a non-native language is clear. At the same time, imposing Anglicized names on the Irish community allows opportunities for resistance, such as continuing the private use of the …

In 2018, the WHO has categorized gaming disorder as an official disease. One of the ways to estimate a person’s gaming disorder level or status is to use the IGD-20 Test. The purpose of our research is to determine whether or not internet gaming disorder (IGD) has a significant negative impact on academic performance using binary dependent and two-staged least squares models. We obtained data from 390 Indonesian university students, consisting of their academic performance, IGD level, gaming behavior, and several of their economic and demographic characteristics. We found that 5.13 percent of the respondents have IGD. Using both probit …

This Article describes the history of bans on particular types of arms in America, through 1899. It also describes arms bans in England until the time of American independence. Arms encompassed in this article include firearms, knives, swords, blunt weapons, and many others. While arms advanced considerably from medieval England through the nineteenth-century United States, bans on particular types of arms were rare.

Governments often seek to restrict speech on the basis of its content, navigating the ever-complex terrain between constitutional freedoms and regulatory interests. While the United States judiciary has historically endeavored to balance competing constitutional questions and government interests when scrutinizing content-based speech regulations, recent trends signify a troubling shift. The judiciary has recently embraced what this Article refers to as free speech absolutism, whereby it sidesteps the longstanding, intricate process of balancing constitutional values and public interests, in favor of an unequivocal endorsement of speech rights. This article presents the postcolonial analysis of the travel account and guidebook of Marius Buys (1837-1906), a Dutch clergyman. He not only devoted himself as a priest but also travelled in several parts of the Dutch East Indies, such as Java, Sumatra, and Sulawesi in the years 1878-1885. After returning to the Netherlands due to illness in 1885, he returned to the Indies in 1886 and was assigned to Kalimantan, Sumatra, and Java. The COVID-19 pandemic put tremendous pressure on healthcare systems worldwide, which led to heightened scrutiny of the medical services offered by hospitals. This article aims to evaluate complaints about city hospitals in Türkiye during the COVID-19 pandemic using the Healthcare Complaints Analysis Tool, which includes three main domains and seven problem categories. The complaints submitted by users on the site via “sikayetvar.com” were systematically collected. Document analysis was used as the data collection method, and 925 complaints were included in the analysis. "What Are You?": Multiracial Library Workers' Experiences In Libraries, Diana Wakimoto

While increasing attention, research, and writing have elevated issues faced by library workers who are Black, Indigenous, and People of Color (BIPOC), multiracial library workers are often, if not always, left out of the conversation around diversity, equity, and inclusion (DEI). The work around DEI in the library profession often erases the lived experiences of multiracial library workers. In turn, this erasure silences our experiences of racism and microaggressions, as well as our unique views and experiences.

This article seeks to expand scholarly inquiry regarding the Alexander Romance into twentieth century India and away the Near East of Antiquity and the Europe of the Middle Ages where it is usually confined. In particular this article will discuss the Alexander Romance’s impact upon and connection with the modern invention of the cinema. Unearthing The Ancient Metropolis: Perth Amboy's Clark-Watson Site, Richard F. Veit
Northeast Historical Archaeology
This Clark-Watson Site in Perth Amboy, New Jersey is one of the richest early colonial sites in the state. It is named for two early property owners: Benjamin Clark a Scottish stationer and bookseller who moved to New Jersey in 1683 and John Watson (1685-1768), a noted 18th-century artist. Excavations at the site by William Pavlovsky unearthed an extraordinary collection of colonial artifacts. The archaeological assemblage provides an unparalleled glimpse into the material life of settlers in Perth Amboy during a period when the city aspired to be a center of international trade and was competing directly and …
