The Best Things In Law Are Free?: Towards Quality Free Public Access To Primary Legal Materials In Canada, Teresa Scassa
The Best Things In Law Are Free?: Towards Quality Free Public Access To Primary Legal Materials In Canada, Teresa Scassa
Dalhousie Law Journal
In this article the author explores the move in several jurisdictions towards providing primary legal materials online without charge. In Canada the federal government, most provincial governments and many courts currently provide some form of online access to primary legal materials. However, this is not done in a unified, comprehensive or systematic manner. The author evaluates the "legal information institute" model as it has emerged in Australia, the United Kingdom and the United States, and considers whether such a model would be useful or workable in Canada. In the course of this assessment, the author canvasses such issues as the …

In The Face Of Adversity: The Response Of The Vincentian And Charity Families To 9/11, Regina Bechtle S.C.
Vincentian Heritage Journal
The response of the Vincentian and Charity Families to the attacks of 9/11 is chronicled, using people’s own words wherever possible. On the day itself and during the aftermath, Sisters of Charity and Vincentians prayed with and counseled grieving people, first responders, and rescue workers. Personnel from Saint Vincent’s Hospital and Medical Center were among the earliest to arrive at Ground Zero, and the Saint Vincent Catholic Medical Centers treated over one thousand victims. Among other things, Sisters of Charity served as New York Police Department chaplains, answered calls to hospital information lines, and worked at a DNA collection site …

Challenges For Cause, Stand-Asides, And Peremptory Challenges In The Nineteenth Century, R. Blake Brown
Challenges For Cause, Stand-Asides, And Peremptory Challenges In The Nineteenth Century, R. Blake Brown
Osgoode Hall Law Journal
This article examines the substantial differences that emerged during the nineteenth century between the law of England, the United States, and Canada regarding challenges for cause, stand-asides, and peremptory challenges in the jury selection process. The author argues that these differences stemmed from the unique social conditions of each country. The emergence of legal formalism-with its emphasis on certainty and predictability in the law-affected the development of jury challenges, though the result of formalist thinking had very different effects in all three jurisdictions. In addition, Canadian law regarding jury challenges reveals the influence of both American and English legal trends.
Poor Canadian Legal Education: So Near To Wall Street, So Far From God, Harry W. Arthurs
Poor Canadian Legal Education: So Near To Wall Street, So Far From God, Harry W. Arthurs
Osgoode Hall Law Journal
The recent appearance of recruiters from Wall Street firms at several Canadian law schools, and the recent hiring by American law schools of several mid-career Canadian law professors, has created a "moral panic" as journalists, academics and law firms have expressed great concern over the loss of Canada's "best and brightest" to the United States. Properly understood as part of a larger debate about globalization and regional economic integration, these developments are less important in themselves than for what they reveal about the present and future of the Canadian state, and the Canadian business community, legal profession and universities.

Book Review: Schattenkrieg Gegen Hitler: Das Dritte Reich Im Visier Der Amerikanischen Geheimdienste, Christof Muenger
Swiss American Historical Society Review
In the 1980' s the United States government decided to declassify the files of the Office of Strategic Services (OSS) which was the organization preceding the CIA. Christoph Mauch, a German historian and Deputy Director of the German Historical Institute in Washington, DC, thoroughly studied the numerous now available documents. His research in the National Archives as well as in various other archives in the United States and Europe resulted in his Habilitationsschrift [a scholar's second study after the doctoral dissertation to make one eligible for a university position in Germany]. A shortened and revised version of the study has …

Book Review: Überfahrten. Das Leben Der Margaretha Reibold (1809-1893) In Briefen. Zürich, Leo Schelbert
Swiss American Historical Society Review
The publication of Margaretha Mezger Reibold is a most welcome addition to the growing body of primary sources that highlight the migratory experiences of women. In a letter dated March 31, 1877, the historian, editor, and diplomat Heinrich Gelzer (1813-1889) of Basel had asked "his beloved friend,,: "Write for me a survey of the course of your life, inner and outer experiences, in the framework of six to seven letters,,(23). He labeled his proposal as "a Sunday task that I will enjoy and that will be beneficial to you,, (23 ). He even suggested the main chapter titles: " 1 …

The U.S. Humanitarian Demining Program In The Balkans, Matt Murphy
The U.S. Humanitarian Demining Program In The Balkans, Matt Murphy
The Journal of Conventional Weapons Destruction
As a result of years of conflict in the Balkans, countless landmines have been laid in Croatia, Bosnia and Herzegovina, and Kosovo. Bosnia-Herzegovina's landmine problem is severe, with an estimated 750,000 landmines and an undetermined quantity of unexploded ordnance infesting some 186 square miles of land. These hidden killers have killed and maimed hundreds, vastly impeded the return of refugees to their homes, and hindered international efforts to help people in the region.

Interethnic Antagonism In The Wake Of Colonialism: U. S. Territorial And Ethnic Relations At The Margins, Michael P. Perez
Ethnic Studies Review
Since the proliferation of scholarship on racial and ethnic antagonism following the Civil Rights era, neo-Marxist, colonialism, and other power-conflict theories reached popularity and have been widely applied to explain racial and ethnic conflict throughout the world, particularly in the United States. However there is a lack of scholarship on racial and ethnic relations in the U.S. territories in general and the Pacific Islands in particular. Although a few works exist in terms of interethnic antagonism and anti-immigrant sentiment in Puerto Rico, Melanesia, and Hawaii, there is a lack of research on interethnic antagonism in Micronesia; therefore comparative analyses of …
