Lawyers, Courts, And The Rise Of The Regulatory State, R. C. B. Risk
Lawyers, Courts, And The Rise Of The Regulatory State, R. C. B. Risk
Dalhousie Law Journal
In 1883, when Dalhousie Law School was created, lawyers in England, the United States, and Canada stood at the edge of a watershed. Massive changes in the law began during the late nineteenth and early twentieth centuries - changes in doctrine, institutions, practice, and ways of thinking. I cannot imagine how I might describe these changes in one short paper, even if I understood them all. Instead, I have chosen to talk about one large strand, regulation, because it is an important feature of law in the twentieth century and because it offers an opportunity to consider some distinctive characteristics …
The Changing Common Law, Morton J. Horwitz
The Changing Common Law, Morton J. Horwitz
Dalhousie Law Journal
I am very pleased and honoured to have been asked to participate in this centennial celebration. For me, it underlines the common bonds between the people of Canada and of the United States, who, in spite of various stresses and strains, manage to live side by side in peace and mutual respect. May we continue to set an example for the rest of the world. Until I read John Willis' very interesting history of Dalhousie Law School, I had not fully realized that I am here simply as another link in a long-standing relationship between Dalhousie and Harvard Law Schools. …

Recollections Of The Establishment Of The Congregation Of The Mission In The United States, Part 6, Joseph Rosati C.M.
Recollections Of The Establishment Of The Congregation Of The Mission In The United States, Part 6, Joseph Rosati C.M.
Vincentian Heritage Journal
Joseph Rosati’s translated memoirs conclude in 1831, which is when his authority over the Vincentian mission in America ended. He recounts his activities as coadjutor to the bishop of Louisiana and as first bishop of St. Louis. He travels extensively, the Congregation grows, and new churches are built in various areas, including one at Saint Mary’s seminary. The seminary and college in Perryville flourish. For a time, Rosati oversees both the diocese of New Orleans and that of St. Louis. Descriptions of priests who worked with him and their efforts are also included.

Trade Friction With Japan And The American Policy Response, Thomas J. Schoenbaum
Trade Friction With Japan And The American Policy Response, Thomas J. Schoenbaum
Michigan Law Review
In Toyko recently I called upon an official of the Ministry of International Trade and Industry (MITI) to discuss trade frictions between the United States and Japan. On the way to my appointment I passed by Hibiya Park in the center of the city. About 10,000 people were gathered in a peaceful demonstration against any lifting of Japan's quotas on imports of agricultural products. Inside the MIT! building I asked the official whether the quotas on beef and oranges would be abolished soon. He told me they would eventually be liberalized or abolished to please the United States, but that …
The Supervision Of Corporate Management: A Comparison Of Developments In European Community And United States Law, Alfred F. Conard
The Supervision Of Corporate Management: A Comparison Of Developments In European Community And United States Law, Alfred F. Conard
Michigan Law Review
In 1971, Eric Stein published an account of the remarkable progress of the European Economic Community (EEC) toward a harmonized law of business corporations. The progress was particularly striking from an American viewpoint, because the harmonization was achieved by moving toward the more rigorous of the various national standards, in contrast to the "race of laxity" or "race for the bottom" that has characterized the movement toward uniformity in the corporation laws of U.S. states.
Judicial Jurisdiction In The United States And In The European Communities: A Comparison, Friedrich Juenger
Judicial Jurisdiction In The United States And In The European Communities: A Comparison, Friedrich Juenger
Michigan Law Review
Eric Stein deserves our gratitude for making European integration accessible to American students and teachers. He has taught and written widely on this important subject, and the casebook he published with Hay and Waelbroeck is a valuable aid for dispelling what a judge of the Communities' Court of Justice called "splendid mutual ignorance." Following Judge Pescatore's suggestion that it is time to take note of the experience gathered on both sides of the Atlantic, it seems worthwhile to compare the evolution of jurisdictional principles in the United States and in the Common Market.
Recollections Of The Establishment Of The Congregation Of The Mission In The United States, Part 5, Joseph Rosati C.M.
Recollections Of The Establishment Of The Congregation Of The Mission In The United States, Part 5, Joseph Rosati C.M.
Vincentian Heritage Journal
The translation of Joseph Rosati’s memoirs continues with the period after 1820. The Vincentians and their works grew, especially Saint Mary’s Seminary, which began educating non-seminarians under pressure from the local community. Several joined the Vincentians. The seminary was also influential in converting many Protestants. The Vincentians carried out missions and established mission stations for those who were unable to attend services regularly. Circumstances surrounding Rosati’s elevation to the episcopate are described in detail.

Felix Deandreis, C.M., Frederick J. Easterly C.M.
Vincentian Heritage Journal
Frederick Easterly outlines the life of Felix De Andreis in terms of his obedience to God’s will. De Andreis resolved to become a missionary early in life and preached missions to the poor in Italy. He also devoted himself to strengthening the clergy’s faith. This stood him in good stead later as he taught clergy in Rome and founded Saint Mary’s Seminary in Perryville, Missouri. He was responsible for beginning the powerful Archdiocese of St. Louis, for starting a seminary system that formed thousands of priests, and for generally establishing the Congregation in the United States.

A Civil Tongue, Edwin Newman
A Civil Tongue, Edwin Newman
Sacred Heart University Review
Edwin Newman speaks about language. We have no hope of dealing with our problems except by chance unless we understand them, and we cannot understand them or one another unless we dig ourselves out from the jargon, the mush, the smog, the dull, pompous, boneless, gassy language under which we Americans have been burying ourselves. That may not seem to be as dramatic a challenge as some others that face the country. It may be thought not to be something by which a nation lives or dies, but in the long run, it is as pressing as any, and in …
Political Asylum In The Federal Republic Of Germany And The Republic Of France: Lessons For The United States, T. Alexander Aleinikoff
Political Asylum In The Federal Republic Of Germany And The Republic Of France: Lessons For The United States, T. Alexander Aleinikoff
University of Michigan Journal of Law Reform
The recent flood of asylum claims, and the concerns it engenders, are not peculiar to the United States. Western European nations have witnessed similar increases in asylum applications over the past decade, .and institutions charged with adjudicating claims have become severely overburdened. This Article will describe the experience of the Federal Republic of Germany and the Republic of France in coping with the explosion of asylum claims. A comparative analysis may provide perspective on the American situation and perhaps suggest - or rule out - proposals for change currently under consideration in the United States. To appreciate the saliency of …
